RESOLUTION NO. 1204 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA AMENDING C.U.P. 78-17 TO ALLOW GENERAL AUTO REPAIR AS WELL AS AUTO UPHOLSTERY AT 86 WEST LIVE OAK AVENUE. WHEREAS, on July 6, 1982, a request was filed by Samuel Arellano, owner of Sam's Auto Upholstery, to amend C.U.P. 78-17 to allow general auto repair as well as auto upholstery at 86 West Live Oak Avenue, more particularly described as fol.10ws: The westerly 55 feet of Lot 2, Tract 12049 in the City of Arcadia, County of Los Angeles, as recorded in Book 224, Page 21, of Maps, in the Office of the Recorder of said County. WHEREAS, a public hearing was held on August 10, 1982, at which time all interested, persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Planning Department in the attached report is true and correct. SECTION 2. This Commission finds that the addition of the general auto repair use is an appropriate use on the subject site and would not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity and will not have a substantial adverse 1 impact on the environment. That the Commission recommends approval . of:the request to expand the auto upholstery business to tnclucle general auto repair with the following additional cO:flditions: 1. Conditions as set forth in Planning Commission Resolution 1070. 2. That all outside storage be prohibited. That pr~orto use of the building for the a~tomobile repair, all the material stored outside the building and the sunscreen shall be removed. 3. That the auto repair work be limited to minor auto repairs, including brake work, tune-ups, etc., and that no auto painting or engine rebuilding shall be done. 4. That the revision to C.U.P. 78-17 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. SECTION 4. The Secretary shall certify to the adoption of this Resolution and shall cause a copy to be forwarded to the c'rty Council of the City of Arcadia. -2- 1204 ,f .. .,. . . . . . BUTLER ASSOCIATE PLANNER The Planning Department has received a request from Samuel Arellano, owner and operator of Sam's Auto Trim and Upholstery at 86 West Live Oak Avenue to amend conditional use permit 78-17 to allow general auto repair as well as auto upholstery on the subject site. HISTORY Conditional Use Permit 71-22 was granted for an automotive garage on the subject site in October, 1971. . On October 10, 1978, the Planning Commission approved C.U.P. 78-17 for an auto upholstery business at said location. This conditional use permit was granted subject to the conditions in Resolution 1070. REQUEST The existing building contains 4,740 square feet. The appli- cant will utilize the front 2,400 square feet for his upholstery business; the rear 2,340 square feet is proposed to be used for the automobile repair. Access to the site is from a is-foot wide driveway off of Live Oak Avenue and egress is from the alley on the south side of the lot. Mr. Arellano has stated that the auto repair will be limited to minor repairs, brake service, rune-ups, etc. and, in general, will service his upholstery customers. Staff has visited the site on several occasions and has noted that the applicant is complying with all the conditions of approval for C.U.P. 78-17. ANALYSIS An auto repair business is a permitted use in the C-M zone with an approved conditional use permit. It is the Planning Department's opinion that the addition of the general auto repair would be an appropriate use on the subject site if the original conditions of approval for C.U.P. 78-17 are complied with as well as the additional conditions set forth in the "Recommendation". Attached for the Planning Commission's consideration is the letter from the applicant, a site plan showing the proposed division of the building, Resolution 1070 and the original staff report. RECOMMENDATION The Planning Department recommends approval of Mr. Arellano's request to expand the auto upholstery business at 86 West Live Oak 'Avenue to include auto repair (C.U.P. 78-17) subject to the following conditions: 1. Conditions as set forth in Planning Commission Resolution 1070. 2. That all outside storage be prohibited. That prior to use of the building for the automobile repair, all the material stored outside the building shall be removed. 3.
