RESOLUTION NO. 1203 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING C.U.P. 82-13, AN EXPANSION TO AN EXISTING BAR AND RESTAU- RANT AT 80 WEST LIVE OAK AVENUE. WHEREAS, on July 19, 1982, James Rodgers filed an application for expansion of an existing bar and restaurant, Planning Department Case No. C.U.P. 82-13, on property commonly known as 80 West Live Oak Avenue, more particularly described as follows: . The east 11.91 feet of Lot 2, all of Lot 3 and the west 16.91 feet of Lot 4, Tract No. 12049, Map Book 224, Page 31, in the City of Arcadia, County of Los Angeles, . State of California. WHEREAS, a public hearing was held on August 10, 1982, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the jactual ~ata submitted by the Department in the attached report is true and correct. \ SECTION 2. This Commission finds that: 1. The granting of Conditional Use Permit as herein- after provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such ~ zone or vicinity. 2. The use applied for at the location indicated is , . I l ~ -2- 1203 . 6. That the trash area shall be enclosed on three sides with a six-foot high masonry wall and that a gate be installed on the fourth side. 7. That the existing and proposed mechanical equipment shall be screened from view. Said screening shall be reviewed and approved by the Planning Department prior to issuance of any building permits. 8. That the gutter along the east side of the building shall be repaired. 9. That the exit doors must swing out and signs that say "this door to remain open during business hours" be located onthe.doors. . 10. That "Exit" signs be installed as per the Fire Department's requirements. 11. That a fire protection system, if necessary, be installed in the kitchen subject to the review and approval of the Fire Department. 12. That a capacity sign and fire extinguishers be installed as per the Fire Department's requirements. 13. That a modification is granted by the Planning Commission for 27 parking spaces in lieu of 30 spaces required. 14. That no outside storage shall be allowed. 15. That all weeds shall be cleared from the lot and the site maintained free of weeds at all times. 16. C.U.P. 82-13 2 SPECIAL INFORMATION Building The existing building contains 2,400 square feet with a seating capacity for 120 persons. There are some small shed-like structures attached to the south wall of the building which will be removed when the new addition is constructed. The applicant is proposing to add 544 square feet of floor area for a total floor area of 2,944 square feet. This expan- sion will include restroom facilities for men and women, a cold storage area, an office and a large storage room. There will be no increase in the seating capacity as a result of this addition. The addition will maintain the same roof line and stucco exterior as the existing building. . Parking and Landscaping The applicant's proposal shows 27 parking spaces: 21 standard spaces (9'x20'), five compact spaces (8'x16') and one handi- cap space (14'x20'). All spaces comply with code. Based upon the parking requirements for bars and restaurants (10 parking spaces per 1,001 sq. ft. of gross floor area), 30 parking spaces are required. The applicant is requesting a modification for the 27 parking spaces in lieu of the 30 re- quired. The parking lot will be patched where necessary, seal coated and restriped as per code requirements. MISCELLANEOUS INFORMATION . A 10' by 18' trash area is proposed south of the building. The trash enclosure as shown will be 5' high concrete block walls on three sides with a chain link gate. A 6' high chain link fence with barbed wire is located along the southerly property line and along a portion of the easterly property line. A 3' high wall with a 3'high chain link fence on.top is located along the westerly property line. c., (; " C.U.P. 82-13 3 . There are some minor things on the site which should be repaired or brought up to code requirements, they are: the gutter on the east side of the building is falling down; the raised planter area needs to be repaired; the mechanical equipment on the roof should be screened from view; and the weeds along the easterly and southerly property lines should be removed. ANALYSIS A bar and restaurant are a permitted use in a C-M zone with an approved conditional use permit. . Itis staff's opinion that approval of this request would upgrade the existing building and parking area and would be an improvement to the neighborhood. Staff does not feel that the requested modification for 27 parking spaces in lieu of 30 required is significant because the proposed addition will not increase the occupancy of the building. (There are currently 27 parking spaces on the site.) Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any sub- stantial or adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. . Before the Commission takes action on this conditional use permit, the Commission should "move to approve and file the Negative Dec- laration and find that the project will not have a significant effect on the environment". RECOMMENDATION The Planning Department recommends approval of C.U.P. 82-13 subject to the following conditions: 1. That the site be improved as per the plans on file in C.U.P. 82-13 . 2. That all existing and proposed landscaped areas shall be surrounded by a continuous raised 6" concrete curb. . 3. That all existing and proposed landscaped areas shall be irrigated. 4.
