RESOLUTION NO. 1202 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING C.U.P. 82-11, FOR THE EXPANSION OF AN EXISTING EATING ESTABLISHMENT (ANTHONY'S DELICATESSEN) AT 1212 SOUTH BALDWIN AVENUE. WHEREAS, on May 28, 1982, an application was filed by Richard Morreale to expand an existing establishment, Planning Department Case No. C.U.P. 82-11, on property commonly known as 1212 South Baldwin Avenue, more particularly described as follows: Northerly 56 feet of Lot 2, Tract 5659 in the City of Arcadia, County of Los Angeles, as recorded in Map Book 115, page 100, in the records of the office of the Recorder of said County. WHEREAS, a public hearing was held on said matter on July 13, 1982, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Plan- ning Department in the attached staff report is true and correct. SECTION 2. This Commission finds that: 1. The granting of a conditional use permit as herein- after provided will not be detrimental to the public health or welfare or injurious to the property or ,improvements in such zone or vicinity. 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. -1- ". ", ~ . . . 3. The site for the proposed use is adequate in size and shape to accommodate said use, including all yards, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. S. The granting of such conditional use permit will not adversely affect the General Plan. 6. The use applied for will not have a substantial adverse impact on the environment. SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a conditional use permit to expand an existing eating establishment upon the following'c~nditions: 1. That the property shall be improved and maintained in accordance with plans on file in C.U.P. 82-11. 2. That the exterior material of the proposed addition shall be consistent with the existing building. Said material shall be reviewed and approved by the Planning Department prior to issuance of the permit. 3. That the exit door shall swing out and be designated as an "Exit". 4. That the new restroom facilities shall comply with all building code requirements. S. That a modification be granted for 16 parking spaces in lieu of 70 required. -2- 1202 . . . ~ 6. That C.D.P. 82-11 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. Morreale 1212 South Baldwin Avenue REQUEST: Conditional Use Permit to enclose an existing outdoor eating area and add restroom facilities to ,Anthony's Delicatessen. EXISTING LAND USE & ZONING: Properties to the north, south, east and west are developed with commercial uses; zoned C-2 & H. SIZE: The subject site contains approximately 4,680 square feet. FRONTAGE: GENERAL PLAN DESIGNATION: HISTORY: 40 feet on Baldwin Avenue. Commercial The delicatessen has'been at this location since August, 1973. On January 21; 1975, a Conditional Use Permit 74-25 was granted to operate a delicatessen and outdoor eating establishment. The applicant was alsa proposing a limited amount of indoor seating. In August, 1977, Conditional Use Permit 77-15 was granted to Anthony's Delicatessen to enclose 'the outdoor patio area and construct customer restrooms. Construction was never begun and the application expired. . . ... " ,- ( c. C.U.P. 82-11 2 PROPOSAL BUILDING INFORMATION The existing delicatessen contains 2,535 square feet of indoor floor area and 500 square feet of outdoor patio area. The applicant is proposing to enclose the existing outdoor patio area and add restroom facilities. This addition will contain 935 square feet (545 square feet in eating area and 390 square feet in hallways and restrooms). There will be total seating for 35 people; 20 in the enclosed patio area and 15 inside. The applicant has advised that the eating area will be enclosed with stucco to match the existing building and wlndows. PARKING There are four parking spaces located directly behind the building. The delicatessen and other businesses along the east side of Baldwin Avenue are presently served by a parking area containing 191 spaces located to the rear of said businesses. Anthony's Delicatessen is allocated, by lease agreement, 12 parking spaces for customers in this parking area. If parking was based upon the parking requirements for eating establishments, (20 parking spaces per 1,001 square feet gross floor area), 70 parking spaces would be required. However, only a portion of the building is actually being utilized for the eating establishment. The remainder of the building is the retail sales area and storage. ANALYSIS It is the Planning Department's op1n10n that enclosing the out- door eating area will not substantially increase the number of customers patronizing the business. Presently, there is one employee r~stroom. This addition will provide restrooms for customers. Although the parking lot serving the businesses in this area is not ideal, parking is not crit~cal. Staff has visited the site several times during the peak business hour (lunch time). There have been anywhere from 23 to 31 parking spaces available in the lot. An eating establishment is a permitted use in the C-2 zone with an approved Conditional Use Permit. It is staff's opinion that the proposed eating establishment is an appropriate use of the property. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical, conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and object of histor~cal or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. Before the Planning Commission takes action on this project, the Commission should, "move to approve and file the Negative Declaration and find that the project will not have a significant affect on the environment." . RECOMMENDATION The Planning Commission recommends approval of C.U.P. 82-11 subject to the following conditions: 1. That the exterior material of the proposed addition shall be consistent with the existing building.
