RESOLUTION NO,. 1201
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF ARCADIA DELETING CONDITION NO.7 OF RESOLUTION
1163, GRANTING CONDITIONAL USE PERMIT 81-3 FOR OUT-
SIDE STORAGE FOR THE CAPTAIN'S BROILER RESTAURANT
AT 600 WEST LAS TUNAS DRIVE.
WHEREAS, on May 19, 1982, a request was filed by Mr. Maurice K.
Wong. on behalf of the property owner, Mr. Hsi Chin Shih, to delete
Condition No.7 of Resolution 1163, granting C.U.P. 81-3 for outside
storage at 600 ~est Las Tunas Drive, more particularly described as
follows:
Lot 25 and the northerly 101 feet of Lot 40, Tract No. 6641
in the City of Arcadia, County of Los Angeles, State of
... California, as per Map recorded in Map Book 126, Page 67 in
the Office of said County Recorder.
WHEREAS, a hearing was held on June 22, 1982, before the Planning
Commission;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA
HEREBY RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning
Department in the attached report is true and correct.
'Section 2. This Commission finds that the deletion of Condition 7
will not be detrimental to the publiC health or welfare or injurious
to the property or improvements in such zone or vicinity ,and will not
have a substantial adverse impact on t~e environment.
Section 3. That the Commission deletes Condition 7 of Section 3

"7. That 25 parking spaces be maintained in compliance
with the Arcadia Municipal Code at 538-554 Las
Tunas Drive (Lots 26 and 27 and parts of. Lots 38 '
and 39) as long as the restaurant is in use, or
else ,this C.U.P. 8'1-3 shall become null and void.
This C.U.P. 81~3 shall not take effect until there
is executed and recorded a covenant to'this effect
approved as to form and content by the City Attorney."
Section 4. That the Commission deletes Condition 7 upon the
following additional conditions:
1. The property shall be improved and maintained in
accordance with the revised plans which are on
file in subject Case No. C.U.P. 81-3 and applicable
regulations of the Arcadia Municipal Code.
2. That a landscape and irrigation plan shall be sub-
mitted to the Planning Departme~t for review and
approval prior to any improvements being made to
the parking area. '
Section 5. The Secretary shall certify to the adoption of this
Resolution and shall cause a copy to be forwarded to the City Council
of the City of Arcadia.
I HEREBY CERTIFY that the foregoing Resolution was adopted at a
regular meeting of the Planning Commission of the City of Arcadia on
the 13th day of July, 1982, by the following vote:

HISTORY
The Planning Commission, at its June 9, 1981 meeting, adopted
Resolution No. l163 granting a Conditional Use Permit (C.U.P. 81-3)
for outside storage for the Captain's Broiler Restaurant at
600 West Las Tunas Drive.
PROPOSAL
The applicant, Mr. Maurice K. Wong, on behalf of the property
owner, Mr. Hsi Chin Shih, has submitted a request to improve the
restaurant's existing parking area in order to delete condition:7
of Planning Commission Resolution l163. Said condition reads as
follows:
"That 25 parking spaces be maintained in compliance with
the Arcadia Municipal Code at 536-554 Las Tunas Drive
(Lots 26 and 27 and parts of Lots 38 and 39) as long as
the restaurant is in use, or else this C.U.P. 81-3 shall
become null and void. This C.U.P. 81-3 shall not take
effect until there is executed and recorded a covenant
,to this effect approved as to form and content by the
Ci ty Attorney."
The above-mentioned condition was required as the result of the
existing restaurant providing 23 on-stie parking spaces in lieu of
48 required by Code.
The applicant is requesting the deletion of this condition in order
that a proposed ll-unit office condominium project may be constructed
on the adjacent properties (Lots 26 & 27) at 536-554 Live Oak Avenue,
which is presently a parking lot.

REVISED PLAN - PARKING & LANDSCAPING
The proposed parking plan would provide a total of 42 on-site
parking spaces that would consist of the following:
32 standard stalls
2 handicap stalls
8 small car stalls
( 9'-0" X 20'-0")
(14'-0" X 20'-0")
( 8'-0" X 16'-0")
The small car spaces are designed in compliance with the small
car standards that have recently been approved by the City and
will become effective in August of this year.
The total number of parking spaces that would be provided (42)
was based on the recalculation of the gross floor area of the
restaurant. Staff was informed by the project's engineer,
Mr. Cheng, that the existing restaurant and its covered waiting area
contains 4,071 square feet of gross floor area; therefore, only
41 on-site parking spaces are required (10 spaces per 1,OOl square
feet) instead of the previous requirement of 48 spaces which is
based on aD incorrect gross floor area of 4,800 square feet.
. On May 16, 1982, during a field investigation of the site, staff
verified Mr. Cheng's figures regarding the gross floor area of the
restaurant. Said figures are indicated on the submitted site plan.
The proposed landscaping would consist of a 5'-3" wide landscaped
buffer adjacent to an existing 6'-0" high masonry wall along the
southerly property line, and a 11' -0" wide landscaped area along
the easterly property line. Said area would separate the restaurant's
parking area from the adjacent property to the east of the site.
RECOMMENDATION
It is staff's opinion that condition 7 of Resolution 1163 will not
be necessary since the parking area for the restaurant will be
improved to comply with the off-street parking requirements;
therefore, staff recommends approval of the applicant's request
subject to the following conditons:
1. The property shall be improved, and maintained in
accordance with the revised plans which are on file
in subject Case No. C.U.P. 81-3 and applicable regula-
tions of the Arcadia Municipal Code.
