RESOLUTION NO. 1163
A RESOLUTION OF 'THE PLANNING COMMISSION OF THE
CiTY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT
FOR OUTSIDE STORAGE FOR THE CAPTAIN'S BROILER
RESTAURANT AT 600 WEST LAS TUNAS DRIVE.

WHEREAS, on April 1, 1981 an application was filed by the
Capt~in's Broiler, Inc., for outside storage of a walk-in freezer
for a restaurant, Planning Department Case No. C.U.P, 81-3, on
the property commonly known as 600 West Las Tunas Drive, more parti-
ularly described as follows:
Lot 25 and the northerly 101 feet of Lot 40, Tract No. 6641
in the City of Arcadia, County of Los Angeles, State of

California, as per Map recorded in Map Book 126, Page 67,
in the Office of said County Recorder,
WHEREAS, a public hearing was held on said matter on May 26, 1981
at which time all interested persons were given full opportunity to
be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA
HEREBY RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning
Department in the attached staff report is true and correct.
Section 2, This Commission finds that:
1. The granting of a conditional use permit as hereinafter
provided will not be detrimental to the public health or welfare or
injurious to the property or improvements in such zone or vicinity,
2. This use applied for at the location indicated is properly
one for which a conditional use permit is 'authorized.
3. The site for the proposed use, is adequate in size and
shape to accommodate said use, including all yards, parking, loading,
landscaping and other features required t~ adjust said use with the
land and uses in the neighborhood,
4. The site abuts streets and highways adequate in width
and pavement type to carry the kind of , traffic generated by the
proposed use,

S. The granting of such conditional use permit will not ad-
versely affect the General Plan,
6. The use applied for will not have a significant effect
on the environment.
Section 3, That for the foregoing reasons, subject to the
approval of the City Council, this Commission grants a Conditional
Use Permit for outside storage of a walk-in freezer for a restaurant
upon the following conditions:
1, The property shall be improved and maintained in accord-
ance with plans in the subject Case No, C.U.P. 81-4, '
2. That a trash enclosure be provided as per Section 9263.3.3.
and as shown on the plans submitted by the applicant. .
3. That additional screening be provided, within 90 days from
the date of approval, around the refrigeration unit, Said material
to be approved by the Planning Departmen.t.
4. That the metal storage shed be removed within 90 days
from the date of approval, or be enclosed and screened with the same
material as the refrigeration unit.
S, That landscaping be provided along the east and west side
of the storage area; said landscaping material shall be submitted to
the Planning Department for its review and approval.
6. That all necessary building permits shall be obtained.
7. That 25 parking spaces be maintained in compliance with
the Arcadia Municipal Code at 536-554 Las Tunas Drive (Lots 26 and 27
and parts of Lots 38 and 39) as long as the restaurant is jnuse, or
else this C.V.? 81-3 shall become null and void, This C.U,P. 81-3
shall not take effect until there is executed and recorded a covenant
to this effect approved as to form and content by the City Attorney.
8, That C,U,P. 81-3 shall not take effect until
and owner have executed a, form available ,at the Planning
indicating awareness and acceptance of the conditions of

Section 4. The Secretary shall certify to the adoption of this
Resolution and shall cause a copy to be forwarded to the City Council
of the City of Arcadia.
I HEREBY CERTIFY that the foregoing resolution was adopted at
a regular meeting of the Planning Commission held on the 9th day
of June, 1981, by the following vote:

The restaurant was constructed in 1957, prior to the requirement of
a conditional use permit.
In December, 1980 during a routine site inspection, staff noted a
refrigeration unit and metal storage cabinet, had been placed outside
the restaurant, and that a metal awning had been placed over the unit.

Upon investigation staff found no building permits or special permits
from the Building DeEartment had been obtained. ,
Captain's Broiler was advised that Building Permits are required for
the installation of the refrigeration units and construction of the
awning, and that a conditional use permit would be required for the
outside storage.

SPECIAL INFORMATION ,;',
The restaurant contains approximately 4800 square feet. The outside
storage area is approximately 18' x 32' (576 sq. ft.) not including
the metal storage building. The refrigeration area is enclosed by
a 6' high chain link fence. .A metal awning is being proposed to
cover the refrigeration units. The plans indicate the metal storage
cabinet is temporary.
There is no existing trash enclosure. The applicant is proposing to
construct a trash enclosure south of the building.
PARKING AND LANDSCAPING
Code requires 48 parking spaces. Twenty-three parking spaces are
located south of the building. An additional 78 parking spaces are
located on the properties to,the east lall three properties are owned
by the same person), ,.
A 6' high block wall is located along the perimeter of the parking
area adjacent to the residential properties.
Code requires a minimum 5'-3" landscape buffer adjacent to residential
properties and between the street and the parking area. There is no
landscaping in the interior of the paved parking area.
ANALYSIS
Outside storage in a C-2 zone is permitted with an approved conditional
use permit,
It is staff's opinion that the refrigeration area should be screened
from view as much as possible, This can be accomplished by placing
redwood slats in the existing chain link fence, and landscape screening
along the east and west.
The metal storage shed should be removed or it should also be enclosed
and screened from view.

Because the addition of the storage area does not increase the seating
capacity of the restaurant, staff believes that said improvement does
not necessitate the upgrading of the parking area.
In order to ensure adequate parking for the restaurant, a covenant
should be recorded, guaranteeing that 25 parking spaces be maintained
on the adjoining properties (536 -554 Las Tunas) as long as the rest-
aurant is in use,
Pursuant to the provisions of the California Environmental Quality Act,
the Planning Department has prepared an initial study for the proposed
project. Said initial study did not disclose any substantial or poten-
tially substantiRl adverse change in any of the ~hysical conditions
within the area affected by the project including land, air, water,
minerals, florR, fauna, ambient noise, and objects of historical or
aesthetic sIgnificance, Therefore, a Negative Declaration has been
prepared for this project,
Before the Planning Commission takes action on this project, the Com-
mission should "move to approve and file the Negative Declaration and
find that the project will not have a significant effect on the envir-

RECOMMENDATION

The Planning Department recommends approval of C,U,P. 81-3 subject
to the following conditions:
1. That a trash enclosure be provided as per Section 9263.3.3, and
as shown on the plans submitted by the applicant.
