RESOLUTION NO. t193 A RESOLUTION OF THE PLANNING COM~lISSIONOF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT NO. 82-5 FOR A VIDEO GAME FAMILY ENTERTAINMENT CENTER AT 309 EAST FOOTHILL BOULEVARD. WHEREAS, on March 1, 1982, an application was filed by Richard J, Stephen to operate a video game family entertainment center, Plan- ning Department Case No. C.U.P. 82-5, on the property commonly known as 309 East Foothill Boulevard, more particularly described as follows: Parcel 2 of ?arcel Map No. 1081 in the City of Arcadia, County of Los Angeles, State of California, as per Map recorded in Parcel Map Book 18, Page 26 of Maps in the Office of the County Recorder of said County, WHEREAS, a public hearing was held on March 23, 1982, at which time all interested persons were given full opportunity cO be heard and present evidence; NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached staff report is true and correct. Section 2. This Commission finds that: 1. The granting of a Conditional Use Per~it as hereinaft~r provided will not be detrimental to the public health or welfare or injurious to the property or improvement in such zone or vicinity. 2. The use applied for at the location indicated is properly one for which a conditional use per~it is authorized, 3, The site for the proposed use is adequate in size and shape to accommodate said use, including all yards, parking, loading, land- scaping and other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. That for the foregoing reasons, subject to the approval of the City Council, this Commission grants a Conditional Use Permit for the operation of a video game family entertainment center, upon the following conditions: 1. That the following conditions shall be complied with to the satisfac:ion of the Chief Building Official: A. Roof mounted mechanical equipment shall be screened from public view. B. Weatherproof covers shall be placed on all outside plug receptacles. C. The electrical pull box in the parking lot shall be repai red. D. That the parking area shall be clearly delineated as per Section 9269.8 of the Arcadia Municipal Code. 2, That the following conditions shall be complied with to the satisfaction of the Fire Department: A. Exit door must swing out as per Section 3303 (6) of the Unified Building Code. B. Exit sign posted shall be 6" by 3/4" stroke. C. Fire extinguisher to be located in a conspicuous place: not more than 5'-0" off the floor (2A-10BC rated). 3. That a trash enclosure be provided as per Section 9263.6.6 of the Arcadia Municipal Code. 4. That the hours of operation be limited as follows: 11:00 a.m. to 10:00 p.m. Sunday through Thursday 11:00 a.m. to 12:00 midnight Friday and Saturday 5. That this conditional use permit shall become null and void if any transfer is made of the rights of this conditional use permit, by outright transfer, operation of law, forfeiture or any other means whatsoever, unless the applicant herein first applied for and is granted permission to make such transfer by the Planning Commission. Should such permission be requested, the Planning Commission may ~mpose aGG~t,onal conditions oZ approval as it deems necessary which shall be adhered to by the transferee, or may deny such transfer. - 2 - 1193 '. , . . . , , . , ( ( 6. That if, upon an inspe.ction of the premises by the Planning Department it is determined the proposed bike racks are insufficient, it will be required at that time that adequate bike racks shall be provided and that plans for the location and installation of such racks shall be submitted to the Planning Department for review and approval, prior to said racks being installed. 7. That a landscape plan shall be submitted to the Planning Department for its review and approval prior to the issuance of a business license, and that the landscaped areas shall be maintained to the City's saitsfaction. 8, That the rules and regulations as noted by the applicants shall be posted and clearly visible on the premises: enforced at all times, 9. That an entertianment permit be obtained from the Business License Review Board. If said permit is denied the conditional use permit shall become null and void. 13. That the existing doorway which is in the easterly side of the building shall not be used for ingress. Section 4.
