RESOLUTION NO. 1198
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARCADIA MAKING FINDINGS OF FACT
AND DENYING CONDITIONAL USE PERMIT 82-8 FOR
A VIDEO GAME ENTERTAINMENT CENTER (PUBLIC
RECREATION CENTER) AT 9954 LAS TUNAS DRIVE.
WHEREAS, on March 23, 1982, an application was filed by
Yun Sam Chung to operate a video game entertainment center
(public recreation center), Planning Department Case No.
C.U.P. 82-8, on the property commonly known as 9954 Las Tunas
Drive, more particularly described as follows:
Parcell of Parcel Map No. 11933, in the City of Arcadia,
COunty of Los Angeles, State of California, as per Map recorded
in Book 119, Pages 49 and 50 of Parcel Maps, in the Office of
said COunty Recorder.
WHEREAS, a public hearing was held on May 11, 1982, at
which time all interested persons were given full opportunity
to be beard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLtOWS: ,
Sectio~ 1. That the factual data submitted by the Planni
ing Department in the attached report is true and correct.
Section 2. That the Planning Commission hereby makes the
following xindings of fact:
1. That the site for the proposed use is not adequate in
size and shape to accommodate said use's parking which
is required to adjust said use with the land and uses
in the neighborhood.
2. That the proposed use will increase vehicular traffic
on a street in a residentially zoned district.
3. That the granting of this Conditional Use Permit would
be detrimental to the public health or welfare or in-
jurious to the property or improvements in such zone or
vicinity.

a retail art supply store occupies 9,540 square feet, the
Shapemakers Women's Health Club contains 6,000 square feet
and the proposed video game arcade will occupy 2,Ol3 square
feet. There will be 1,647 square feet of unleased area
remaining,
Approximately 1,680 square feet will remain for the placement
of video games after a bathro~m, storage room and 12' by 14'
interior bike area are constructed. New doors and windows will
be placed along Las Tunas Drive and Rowland Avenue, The win-
dows will be five feet in height starting three feet above the
curb elevation,
After reviewing the proposal, the Public Works Department had
no conditions of approval. The Building Department noted that
the occupancy would require restrooms for men and women. As
well as complying with handicap requirements the women's rest-
room would need two toilets with one lavatory and the men's
restroom would require one toilet, one urinal and one lavatory.
Also, engineered plans would be needed before remodeling could
be started. The Fire Department stated that proper doors for
existing, exit signs, a rated fire extinguisher and minimum
aisle widths will be required of the applicant.
MISCELLANEOUS INFORMATION
The proposed hOUrs of operation will be as follows:
Sunday through Thursday
Friday and Saturday
11:00 a.m. to lO:OO p.m,
lO:OO a.m, to 12:00 a.m.
The applicant will have a maximum of 40 video game machines.
OPPOSITION
Opposition to this application has been received from the City
Council of the City of Temple City, a petition signed by 25 pro-
perty owners representing 17 properties and from Continental
Bank.
The letter from Temple City's Council states in part:
"At its April 27 meeting, the Temple City Planning Com-
mission denied an application for a similar Video Arcade
on Las Tunas Drive be~ause of inadequate facilities, in-
adequate parking, and incompatability with surrounding
areas.

The Sheriff's Department has on two occasions sent letters
to Temple City expressing opposition to arcades due to in-
creased crime and other police problems. They have cited
the City of Rosemead experience as a typical example of
problems which can be expected.
The Council of the City of Temple City is opposed to an
arcade at this location b~cause we feel it will adversely
affect the residential area of Temple City to the south
and west and businesses in the vicinity of the proposed
arcade."
The petition lists four reasons for their opposition:
I. That the video center would be an attractive nuisance,
2. Excessive noise at late hours,
3. Heavy traffic on residential streets, and
4, Congested parking during the day.
Continental Bank notes that parking is becoming a problem which
will become worse if this application is approved.
PARKING
157 parking spaces that comply with code are provided within
the parking lot which includes the Wendy's Drive-Thru eating
establishment, Determining the parking requirement for all uses
is difficult due to the nature of the businesses,
The women's health club and Wendy's Drive-Thru are uses that
require conditional use permits in part due to their ability to
create high demands upon parking at any given time. A video
game center would be similar in this respect.
Staff has made seventeen site inspections from May 3 to May 6,
1982 between the hours of 9:15 a.m, to 8:00 p,m, From these
inspections staff estimates that the health club presently
creates a demand for parking between 30 to 70 spaces. If a
worst case estimate is made for the existing uses, Aaron Brothers,
the health Club and Wendy's would require 166 parking spaces,
This is due to the code requirement of 5 parking spaces per
1,001 square feet of gross floor area for retail businesses
and 20 parking spaces per 1,001 square feet of gross floor area
for eating establishments. The following is a breakdown of
the parking requirements:

Whereas most commercial centers reach their peak parking demand
periods between the hours of 8:00 a.m. to 5:00 p.m" staff's
parking survey found that the greatest demand for parking occurs
after 5:00 p.m. and continues at least through 8:00 p,m, at the
subject site.
ANALYSIS
.
Even though staff's parking survey has yet to find the lot 100%
filled, the potential exists for a parking problem as shown by
the worst case example. Aaron Brothers and ~endy's have yet to
generate the demand for parking that other retail businesses
and eating establishments are capable of producing. The City
has no control over future subdividing of the building or
other tenants that may generate a greater demand for parking.
It is also staff's opinion that the proposed use will increase
vehicular traffic along Rowland Avenue which is residentially
zoned except for those properties fronting on Las Tunas Drive,
After 5:00 p,m, parking along Rowland Avenue substantially de-
creases even though the uses generate more business. This is
due to the health club and Aaron Brothers having direct en-
trances from the parking lot and the bank closing, Besides
being situated on the corner of two streets which makes street
parking more desirable to patrons, the video center will have
its entrances directly off of Las Tunas and Rowland, and not
the parking lot, Also, staff's inspections have found that the
majority of available on-site parking spaces can be found at the
southeast corner of the lot, south of Wendy's. Street parking
will be available and more convenience to patrons of the video
center than much of the parking lot,
,Attached for your information is staff's parking survey, site
plan, floor plan, elevations, letters in opposition, the
conditional use permit application and proposed rules and regu-
lations of the video center.

Pursuant to the provisions of the California Environmental Quality
Act, the Planning Department has prepared an initial study for the
proposed project. Said initial study did not disclose any sub-
stantial or potentially substantial adverse change in any of the

physical conditions within the area affected by the project in-
cluding land, air, water, minerals, flora, fauna, ambient noise,
and objects of historical or aesthetic significance, Therefore,
a Negative Declaration has been prepared for this project.
Before the Planning Commission or the City Council take action
on this project, they should "move to approve and file the
Negative Declaration and find that the project will not have a
'significant effect on the environment.
RECOMMENDATION
The Planning Department recommends denial of C.U.P, 82-8 due to
the site for the proposed use is not adequate in size and shape
to accommodate said use's parking which is required to adjust
said use with the land and uses in the neighborhood; that the
proposed use will increase vehicular traffic on a street in a
residentially zoned district; and that the granting of this
conditional use permit would be detrimental to the public health
or welfare or injurious to the property or improvements in
such zone or vicinity.

If the Planning Commission decides to approve C.U.P. 82-8,
staff recommends the following conditions of approval:
I. That all necessary building permits be obtained as re-
quired by the Building Department. That restrooms for
men and women be provided. CQmpliance with handicap
requirements will be necessary. The women's restroom
shall have two toilets with one lavatory, while the men's
restroom shall have one toilet, one urinal and one lava-
tory. Also, engineered plans will be required prior to
any remodeling. This shall be subject to the review
and approval of the Building Department.
2. That the use shall have two exits, proper exit signs and
one 2A-IOBC rated fire extinguisher mounted not more than
5 feet off the floor, This shall be subject to the review
and approval of the Fire Department.

3. That because of the close proximity to residential uses,
the hours of operation be limited to:
Sunday through Thursday 11:00 am. to 10:00 p.m.
Friday and Saturday 10:00 a.m. to 10:00 p.m.
4, That this conditional use permit shall become null and
void if any transfer is made of the rights of this con-
ditional use permit by outright transfer, operation of
law, forfeiture or any other means whatsoever, unless
the applicant herein first applies for and is granted
permission to make such transfer by the Planning Commission.

4, Icont.J Should such permission be requested the Plan-
ning Commission may impose additional conditions of
approval as it deems necessary which shall be adhered
to by the transferee, or may deny such transfer.
5. Plans for the location and installation of bike racks
shall be submitted to the Planning Department for review
and approval prior to ~aid installation.
That upon inspection of the premises by the Planning Depart-
ment if it is determined that the proposed bike racks are
insufficient, it will be required that additional bike
racks shall be provided. Revised plans shall be required.
6, That rules and regulations as noted by the applicant shall
be posted and clearly visible on the premises, and enforced
at all times.

7. That at least one adult attendant (a minimum of 2l years
of age) shall be on duty during all hours of operation.
8. That the windows facing Las Tunas Drive and Rowland
Avenue shall have a totally unobstructed view and that
the proposed game machines shall set back a minimum of
4'0" from said windows. This shall be subject to the
review and approval of the Police Department,
9. That a maximum of forty (40) game machines be placed within
the premises,
10, That an Entertainment Permit be obtained from the City's
Business Permit and License Review Board.
11. That C,U.P. 82-8 shall not take effect until the owner
and applicant have executed a form available at the Plan-
ning Department indicating awareness and acceptance of
the conditions of approval,
After taking action on this application, the Planning Commission
should direct staff to prepare a resolution for adoption at its
next meeting. The Planning Commission's action shall not be
final until adoption of the resolution. The appeal period for
this action commences at the time the Commission adopts the
resolution.

Subject: Proposed Video Arcade at 9954 Las Tunas
Drive, Temple City
Conditional Use Permit 82-8
The City Council of the City of Temple City, on behalf of its
residents, hereby expresses its opposition to the proposed arcade
at subject location which is currently pending before your com-
mission.
At its April 27 meeting, the Temple City Planning Commission denied
an application for a similar Video Arcade on Las Tunas Drive because
of inadequate facilities, inadequate parking, and incompatability
with surrounding areas.
The Sheriff's Department has on two occasions sent letters to !
Temple City expressing opposition to arcades due to increased crime
and other police problems. They have cited the City of Rosemead
experience as a typical example of problems which can be expected.
The Council of the City of Temple City is opposed to an arcade at
this location because we feel it will adversely affect the resi-
dential area of Temple City to the south and west and businesses
in the vicinity of the proposed arcade.
