PLANNING COMMISSION RESOLUTION NO. 1195 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT TO ALLOW A CHANGE IN USE OF AN EXISTING TAKE-OUT FOOD ESTABLISHMENT TO AN EATING ESTABLISHMENT AT 108 EAST FOOTHILL BOULEVARD (BASKIN-ROBBINS ICE CREAM STORE). WHEREAS, on March 11, 1982, Dan and Raye ,Bayer ldba Baskin-Robbins Ice Cream Store) filed an application for an eating establishment, Planning Department Case No. C.U.P. 82-7, on property commonly known as 108 East Foothill Boulevard, more particularly described as follows: A portion of Lot 12, Block 89 of Santa Anita Tract, in the City of Arcadia, County of Los Angeles, State of California, as per Map recorded in Book 34, Pages 41 and 42 of Maps, in the Office of said County Recorder. WHEREAS, a public hearing .was held on April 13, 1982 at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adver- sely affe~t the General Plan. - 1 - 1195 ... ... . -." The use applied for will not have a substantial a'dvers'-, 6. impact on ~he environment. 7. ThaC the granting of C.U.P. 82-7 shall not be construed as a general reduction in parking requirements at the subjectloca- tion, except for this specific application. Section 3. That for the foregoing reasons, subject to the approval of the City Council, this Commission grants a conditional use permit for the operation of an eating establishment upon the following conditions: 1. That the sales area (square footage) shall not be enlarged beyond the area shown on the floor plan on file in the Planning De- partment. Any change in design shall be subject to the review and approval of the Planning Department. 2. Thac there shall be a maximum of six chairs with attached tables. 3. That a modification is granted allowing 27 parking spaces in lieu of 42 parking spaces required, 4. That C.U.P. 82-7 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. Sectiori 4. The Secretary shall certify to the adoption of this Resolution and shall cause a copy t~ be forwarded to the City Council of the City of Arcadia. The applicants are proposing to locate, within an existing ice cream store six (6) chairs with attached tables. Due to the . . . ," C.U.P. 82-7 2 tables, the business can no longer be considered take-out, but will become an eating establishment which requires a conditional use permit. The commercial complex, where Baskin Robbins is located was con- structed in 1978 and contains 5,400 square feet of floor a"ea. The site provides for 27 parking spaces and one loading space and complies with all landscaping and parking requirements for a retail center (5 parking spaces per 1,001 square feet of gross floor area). The proposed change in use will result in a change in the off- street parking requirements. An eating establishment requires 20 parkin8 spaces per 1,001 square feet of gross floor area. Baskin Robbins contains I,OOO square feet of floor area which requires 20 parking spaces. Based upon the general retail parking requirements of 5 parking spaces per l,OOl sq. ft. of floor ,area, the remaining 4,400 square feet of retail area would require 22 parking spaces. A modification' is necessary to allow 27 parking spaces in lieu of 42 parking spaces requi"ed for the entire commercial center. ANALYSIS An eating establishment is a permitted use in the C-2 zone with an approved conditional use permit, In this particular case, it it staff's opinion that the parking deficiency would not be detrimental to the site or surrounding properties. The addition of six chairs with attached tables will not increase the business currently generated by the existing operation. Also, there will only be approximately 280 square feet of floor soace used for the sales area. If this conditional use permit is approved, the facility will be limited to six chairs with tables. Staff believes that the site is appropriate for this type of business and the circulation and parking are adequate to accom-- ,modate the proposal. Attached for your information are the site plan, floor plan and the conditional use permit application. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land,air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project, ... ... . ., C.U,P. 82-7 3 Before the Planning Commission or City Council takes action on ' this project, they should ;'move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment." RECOM~lENDATION The Planning Department recommends approval of C.U.P. 82-7 subject to the following conditions: I.
