ORDINANCE NO. 1738
AN ORDINANCE OF THE CITY OF ARCADIA AMENDING
SECTIONS 9292.1.4 AND 9292.1.9 OF THE ARCADIA
MUNICIPAL CODE TO ALLOW UNLIMITED EXPANSION
OF TBE MAIN DWELLING ON R-l AND R-O LOTS WITH
TWO OR MORE DWELLINGS, AND D~LE~ING THE REAL
ESTATE INSPECTION REPORT REQUIREMENT.

COUNCIL OF THE CITY OF ARCADIA DOES HEREBY ORDAIN AS
THE CITY
FOLLOWS:
SECTION
1. That Section 9292.1.4 of the Arcadia Municipal Code
is hereby amended to read as follows:
II 9292.1.4. AUTHORITY. In order to secure an appropriate lmprove.
menl, prevent unreasonable hardship or to promote uniformity of development,
the Modification Committee shall ~ave the authority to approve, conditionally
. approve or deny modifications of the following:
1. Driveway and parking stall size requirements.
2. Apartment unit size.
3. Building length.
4. Distance between buildings.
5. Usable open space regulations.
6. Fence, wall and hedge regulations.
7. Sign regulations.
8. Utility and storage space requirements.
9. Swimming pool regulations.
10. R.3 building height regulations, provided that such regulations, as
modified, shall nol permit a building to exceed thirty. five feet (35') in height
nor two (2) stories or two (2) slories oC living quarters over one (1) story
oC parking.
11. Height of noncommercial structures.
12. Number of required parking spaces.
13. When the maximum number oC units permitted in the R-2 and R.3
zones has a fractional remainder greater than one half, the ModUicaUon Com-
mittee may allow the maximum number of units to be rounded of( to the next
highest whole number.
14. Front, side or rear yard setbacks, provided that a setback from a
street shall be modified only with the unanimous approval of the Committee
and a written declaration of the Director of Public Works that the moctiiica-
ticn, if granted, will not adversely aICed any Coreseeable need Cor Widening
the .street.
15. In the R-O First One-F~mily zone and the R-l Second
One-Family zone for any property with two or more one-family dwell-
ings which are nonconforming uses, structures or buildings under
Arcadia Municipal Code Sections 9251.1 and 9252.1.1:
(al For additional floor area, including covered patios to be
added t~ the" main dwelling on the lot
(b) Ot~er alteration~ to t~e ~~jn dwelling which do not create
additional space
(c) Required parking facilities for the main dwelling;
(el) A swimming pool"'

'There may be required as a condition of approval of the modification
permit, that plans be submitted for the removal or remodeling of any
other nonconforming uses, structures, and builuir:'Js to confon., to ::he
provisions of the Arcadia Municipal Code. In such case, the condition
may require the remova;! or remodeling of any s.uch nonconforming use,

structure and building prior to or concurrent with the alteration or
improvement specified in (al, (b), (cl, or (d) above."
SECTION 2. That Section 9292.1.9 of the Arcadia Municipal Code
is hereby amended to read as follows:
"9292.1.9. INFORMATION REQUIRED. A modification application
shall be accompanied by the following:
1. Completed application forms.
2. Reference to the provisions of the Code section from which
said property is sought to be excepted.
3. A scaled plot plan and description of t~e subject property,
description of the proposed use of the property with plot plans, floor
plans, and elevations for all proposed buildings drawn to scale.
4. In those residential areas of the City having architectural
review boards, the report of said boards indicating their actions rela-
tive to the proposed modification request. "
SECTION 3. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is, for any reason, held to be
invalid or unconstitutional by the decision of any court of compe-
tent jurisdiction, such decision shall not affect the validity of
t~e remaining,portions of this ordinance. The City Council of the
C~t~ of Arcad~a hereby declares that it would have adopted this
ord~~ance and each section, subsection, sentence, clause, phrase or
po~t~o~ ~hereof irrc~pcctive of t~c f.act that a~y one or more
sections, subsections, sentences, clauses, phrases or portions be
declared invalid or unconstitutional.

SECTION 4. Neither the adoption of this ordinance nor
the repeal hereby of any ord~llance shall in any manner affec~ the
prosecution for violation of ordinances, which ~iolations were
co~~itted crior to the effective date hereof, nor be construed as
affecting any of tt~ provisions of such ordinance relating to the
collection of any ~~ch license or penalty or the penal provisions
applicable to any violation thereof, nor to affect the validity of
any bond or cash deposit in lieu thereof, required to be posted,
filed or deposited pursuant to any ordinance and all rights and
obligations thereunder appertaining shall continue in full force
and effect.
SECTION 5. The Clerk of the Council shall certify to the
passage and adoption of this ordinance and shall cause the same to
be published in the official newspaper of the City of Arcadia with-
in fifteen (15) days after its adoption.
