" ; ..~ RESOLUTION NO. 1192 A RESOLUTION OF THE PLANNING COMMISSION OF THE .CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT TO OPERATE A VIDEO GAME ENTERTAINMENT CENTER (PU8LIC RECREATION CENTER) AT 122 EAST LIVE OAK AVENUE. WHEREAS, on March 1, 1982, Gary L. Allen and Mitchell Bock filed an application for a video game entertainment center (public recreation center)l Planning Department Case No. C,U.P. 82-6, on property com- monly known as 122 East Live Oak Avenue, more particularly known as follows: Lot 6 of Tract No. 13623, in the City of Arcadia, County of Los Angeles, State of California, as per Map recorded in Book 278, Page 29 of Maps in the Office of said County Recorder, WHEREAS, a public hearing was held on March 23, 1982 at which time all interested persons were given full opportunity to be heard and to present evidence, NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1, That the factual data' submitted by the Planning Departmend in the attached report is true and correct. Section 2. This Commission finds that: 1. The granting of Conditional Use Permit as hereinafter provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is pro- perly one for which a conditional use permit is authorized. 3. The site for the proposed use is adequate in size and shape to accommodate said use including all yards, parking, loading and other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. - 1 - 1192 . '.. . . . . . ',' S. The granting of such conditional use permit will not adversely affect the General Plan. 6. The use applied for will not have a substantial ad- verse impact on the environment, 7. The proposed use complies with all requirements set forth for the issuance of a conditional use permit. 8. The proposed use will not substantially increase vehic- ular traffic on any street in a residentially zoned district. 9. The proposed use will not lessen the suitability of any nearby commercially zoned property for commercial use by interfering with pedestrian traffic. Section 3. That for the foregoing reasons, subject to the approval of the Ci~y council, this Commission grants a conditional use permit for a video gam~ ent~rtainment center (public recreation centerl at 122 East Live Oak Avenue upon the following conditions: 1. That all necessary building permits be obtained as re- quired by the Building Department. 2. That the building have two exits, the rear door shall swing out, a 6" X 3/4" exit sign shall be posted, aisle widths shall be a minimum of thirty-six (36) inches, and that one 2A-l0BC rated fire extinguisher be mounted. This shall be subject to the Fire De- partment's review and approval. 3. That a trash enclosure be provided per Arcadia Municipal Code Section 9263.6.6.4. 4. That the hours of operation be limited as follows: 12:00 p.m. to 10:00 p.m. Monday through Thursday 12:00 p.m. to 12:00 a.m. (Midnight) Friday and Saturday 12:00 p.m. to 8:00 p.m. Sunday 5. That this conditional use permit shall become null and void if any transfer is made of the rights of this conditional use permit by outright transfer, operation of law, forfeiture or any other means whatsoever, unless the applicants herein first apply for and are granted permission to make such transfer by the Planning Commission. Should such permission be requested the Planning Commission may impose additional conditions of approval as it deems necessary which shall be adhered to by the transferee, or may deny such transfer, - 2 - 1192 . . That upon inspection of the premises by the Planning Department, if it is determined that the proposed bike racks are insuf- ficient, it will be required that additional bike: racks shall be provided. Revised plans shall be required, .7. That rules and regulations as noted by the applicants shall be posted and clearly visible on'the premises, and enforced at all times. 8. That at least one adult attendant (a minimum of 21 years of age) shall be on duty during all hours of oepration. 9. That the front window area facing Live .Oak Avenue shall have a totally unobstructed view and that.the proposed game machines shall set back a minimum of 4'-0" from said window. 10. That flood lights shall be located in the rear parking lot. This shall be subject to the review and approval of the Police Department and Planning Department. Lighting shall conform to Arcadia . Municipal Code Section 9263.6.1. 11. That no bicycles shall be permitted to remain in front of the building. All bicycles shall be located at the rear of the building. 12. That an entertainment permit be obtained from the Business License Review Board. If said permit is denied the Condi- tional Use Permit shall become null and void. 13. That a modification is approved to allow fourteen (14) parking spaces in lieu of fi fteen (15) spaces (9' x 20" wi th appropriate aisle width) required for 122, 124, and 126 East Live Oak Avenue (9269.5). 14. That C.U.P. 82-6 shall not take effect until the owner and applicant have executed a form available at the Planning Depart- ment indicating awareness and acceptance of the conditions of approval. Section 4. The Secretary shall certify to the adoption of this Resolution and shall cause? copy to be forwarded to the City Council of the City of Arcadia. . - 3 - 1192 . ' '. . . . . . For your information note that Arcadia Municipal Code Section 6411.4 states that no person, either as principal, agent, employee or otherwise, shall op- erate, play or utilize, or permit any person or persons to operate, play or utilize any amusement machine, game or device described in subsection 6220.4 for the purpose of gambling, betting, wagering or pledging in any manner what- soever any money, thing or consideration of value or the equivalent or mem- orandum thereof, upon the outcome, score or result of the playing or operation of said amusement machine, game or device. WONG The Planning Commission at its April 13, 1982 meeting adopted Resolution No. 1192, granting a Conditional Use Permit to oper- ate a video game entertainment center (public recreation center) at 122 East Live Oak Avenue. A condition of approval (Section 3.5) requires Commission's approval of any transfer.of the rights of Conditional Use Permit 82-6. The Commission may im- pose additional conditions of approval as it deems necessary which shall be adhered to by the transferee, or may deny such transfer. The applicants, Mitchell Bock and Gary Allen, are requesting said transfer of C.U.P. 82-6 to Ok-Soo Han and Kui-Son Han. Since they have been in operation, they have found that a capital and time investment beyond their means is necessary for the video center to be profitable and properly managed. All conditions of approval of Resolution No. 1192 have been complied with. Since May 1981, Ok-Soo Han and Kui-Son Han have operated Rain- bow Arcade at 8725 East Washington Boulevar~ Pico Rivera, Cali- fornia. After discussions with the pico Rivera Planning staff and an inspection by staff on May 20, 1982, the Rainbow Arcade has been found to be a clean and efficiently managed establish- ment. The arcade is located within a retail shopping center, containing 1,250 square feet and 21 video games. Resolution No. 1192 and letters from both the applicants and possible transferees are attached for your information. If the Planning Commission approves the transfer of C.U.P. 82-6, the Planning Department recommends the following conditions of approval: 1. That all conditions of approval found in Resolution No. 1192 be adhered to be Ok-Soo Han and Kui-Son Han. ( . 2. That a maximum of thirty (30) video or pinball games or similar game machines, be installed within the premises. 3. That the location or number of game machines shall not supersede any Fire. Department, Building Division, Planning Department or Police Department regulations. .4. That an entertainment permit be obtained from the Business License Review Board. If said permit is denied this conditional use permit shall become null and void. 5. In an effort to resolve the situation we are currently nego- tiating to sell our business. The buyers, in our opinion, would be an excellent addition to Arcadia's business community. Ok-Soo Han and her family (the buyers) own and operate a succes- sful family entertainment center in Pi co Rivera, own their own games and understand this business very well. They are totally familiar with all the conditions of the Use Permit granted for the location as well as the City's license fees and entertain- ment license requirements. They are willing and able to comply with all of same. County Retail uses and restaurant; zoned C-2 Mixed Commercial uses; zoned C-2 North: South: West: East: BUILDING INFORMATION Constructed in 1949 the building at 122-126 East Live Oak Avenue is subdivided into three 960 square foot sections, one of which the appli- cants propose to occupy. The 960 square foot area is broken down into an 80 square foot office, 32 square feet for the bathroom and 848 square feet for the placement of game machines. , 124 East Live Oak Avenue will be doing business as a takeout food establishment while 126 East Live Oak Avenue is presently an office for a nonprofit organization, which can be occupied by a retail use at a later date. Page 1 , , ':J . . . ( ( . , After reviewing the proposal the Public Works Department had no condi- tions'of approval. The Building Department noted that an electrical permit w",uld be required to provide adequate outlets, and the Fire Department stated that the rear door would have to swing out, an exit sign shall be posted, that aisle widths shall be a minimum of thirty- six (36) inches, and that a rated fire extinguisher be mounted. A clothing store was the last occupant of subject location. PARKING AND LADSCAPING If the video center's parking is based upon the same standard as retail establishments (5 parking spaces per 1001 square feet of gross floor area), the 2,880 square foot building would need 15 parking spaces. Presently, fourteen (14) parking spaces exist that are substandard in stall len~th, . aisle width and striping.. Also, the parking lot has no wheel stops, landscaping, or trash enclosure. This substandard condition is also found on Lots 1,2,3,5,6,7,8,9, and a portion of Lot 10 (See Exhibit "A"). Lot 4 has a trash enclosure and parking spaces with adequate stall widths and lengths and aisle width due to conditions of C.U.P. 79-9 (116 E. Live Oak Avenue, Steer- burger). Lots 1 and 2 will comply with the zoning requirements if the proposed Huntington Bank is constructed per C.U.P. 82-2 (100-106 East Live Oak). . Lot 6, which is the subject site, could be redesigned to accommodate twelve (12) standard ninety-degree parking spaces and a trash enclosure. A drawback of ,the restriping would be the discontin- uance of the existing driveway circulation pattern through Lots 5,6,7, 8,9 and 10. It is staff's opinion that landscaping the parking lot at this time would not be beneficial, especially if the lot is restriped to meet Code. Landscaping may create additional barriers for vehicle circula- tion. Access to the parking lot is by a twenty-foot wide alley ~outh of the site. A memorandum from the Police Department states: "We foresee problems with parking since three buildings (122,124 and 126 East Live Oak Avenue) share the same 13 parking spaces. A quick food business is going in at 124 which will create additional parking problems. Live Oak Pharmacy has parking problems now with the SteerBurger on the west of them and ':'Iill have more problems now on the east." The Police Department recommends flood lights in the rear parking area to discourage loitering (memorandum attached) C.U.P. 82-6 3/23/82 Page 2 I''. '. . . . ( ( " MISCELLANEOUS INFORMATION Proposed hours of operation will be as follows: Monday through Thursday Friday and Saturday Sunday , 12:00 p.m. to 10:00 p.m. 12:DO p.m. to 12:00 midnight 12:00 p.m. to 8:00 p.m: The applicants will have a maximum of thirty (30) video games. They state that a uniformed guard will be on the pre~ises during all hours of operation for the opening month. After the first month, the guard will only be present evenings and weekends unless a need is demonstra- ted. Also, one of the applicants will be present at all times. They will be supplemented by part-time employees over twenty-one (21) years of age. A survey taken by the applicants indicates that no parking problem exists and that their peak patronage hours will be when most of the other businesses have closed. Bike racks will be provided. ANALYSIS It is staff's opinion that requiring the parking .lot to meet code at this time would not be beneficial for the parking lot as a whole. Re- striping, wheel stops, curbing and landscaping would eliminate the existing driveway circulation pattern through six lots and would cause difficult egress situations for one of ,the adjacent lots by the creation of barriers. Both adjacent lots utilize the subject site for exiting. The only adjacent residential dwellings are buffered by a 120 foot deep parking lot and a 20 foot wide alley, It is unlikely that parking for the video center would overflow onto residential streets. A video game entertainment center (public recreation center) is a per- mitted use in a C-2 zone with an approved conditional Use Permit. It is staff's opinion that video game centers if maintained properly, can provide a positive recreational facility for all age groups. Attathed for your informatibn. is the memorandum from the Police Department, Exhibit "A", information concerning the business from the applicants, personal resumes, elevations, floor plan, plot plan, and the Conditional Use Permit application. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore a Negative Declara- tion has been prepared for this project. Before the Planning Commission or City Council takes action on this project, they should "move to approve and file the Negative Declara- tion and find that the project will not have a significant effect on the environment". After taking action on this application, the Planning Commission should direct staff to prepare a resolution for adoption at its next meeting.
