RESOLUTION NO, ll85
A RESOLUTION OF THE PLANNING COMMISSION OF THE,
CITY OF ARCADIA GRANTING CONDITIONAL USE PERMIT
81-13 TO CONSTRUCT AN 8-STORY BUILDING WHICH WILL
INCLUDE OFFICES, A BANK WITH A DRIVE-UP TELLER,
RESTAURANT DELICATESSEN WITH OUTDOOR SEATING, AND
AN AUTOMOBiLE DEALERSHIP, AT 333 - 421 EAST HUNT-
INGTON DRIVE.
WHEREAS, an application was filed by Robert J. Low to construct
an eight story building (including mezzanine) which will include
offices, a bank with a drive-up teller, restaurant, delicatessen
with outdoor seating, and an automobile dealership, Planning Depart-
ment Case No. C.U.P. 81-13, on the property commonly known as 333 -
421 East Huntington Drive, more particularly described in attached
Exhi bit "A".
WHEREAS, public hearings were held on November 24, 1981 and
December 8, 1981, at which time all interested persons were given
full opportunity to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA
HEREBY RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning
Department in the attached staff report is true and correct.
Section 2. This Commission finds that:
1. The granting of a Conditional Use Permit as hereinafter
provided will not be detrimental to the public health or welfare Or
injurious to the property or improvement in such zone or vicinity.
2. The use applied for at the location indicated is properly
one for which a conditional use permit is authorized.
3. The site for the proposed use is adequate in size and shape
to accommodate said use, iDcluding all yards, parking, loading, land-
scaping and other features required to adjust said use with the land
and uses in the neighborhood.
4. The site abuts streets and highways adequate in width and
pavement type to carry the kind of traffic generated by the proposed
Use.

5. The granting of such Conditional Use Permit will not
adversely affect the General Plan.
6. The use applied for will not have a substantial adverse
impact on the environment.
Section 3. That for the foregoing reasons, subject to the
approval of the City Council, this Commission grants a Conditional Use
Permit to construct an eight story building (including mezzanine) which
will include offices, a bank with a drive-up teller, restaurant, deli-
catessen with outdoor seating, and an automobile dealership, upon
the following conditions:
1. The property shall be improved and maintained in accord-
ance with the plans on file in the subject case C.U.P. 81-l3 and
applicable regulations of the Arcadia Municipal Code.
2. That Fire Safety shall be provided to the satisfaction of
the Fire Chief.
3. That breaks be provided in the 6' high block wall to the
satisfaction of the Police Chief.

in the parking structure and underground parking area.
6. That the applicant work with the Planning Department to
redesign the parking area to provide for better circulation; a min-

20' side and rear yard setbacks for the parking structure in lieu of
24' required.
8. That this C\U.P. shall not take effect unless Zone Change
81-5 is approved by the '~ity Council.
9. A covenant in a form and content approved by the City
Attorney shall be recorded in the County Recorder's office guaranteeing

10. Egress from the easterly driveway will be restricted to
right turns only. Egress from the other driveways shall be subject
to the review and approval of the Planning Department and the Public
Works Department.
11. All signs shall be subject to the regulations set forth
in the CPD-1 requirements.
l2. Submit grading and drainage plan for the approval of the
Director of Public Works.
13. Construct full parkway width P.C.C. sidewalk; replace all
deficient and damaged sidewalk.
14. Close all driveway openings not to be used, including
existing service road opening opposite Fourth Avenue.
15. Plant parkway trees in accordance with City Standard
Plan S-13.
16. Provide necessary easements to utility companies.
17. Existing 6 inch sewer lateral, if not to be used, shall
be removed as directed by the Director of Public Works.
18. That C.U.P. 81-13 and P.,P.R. 8l-2 shall not take effect
until the applicant and owner have executed a form available at the
Planning Department indicating awareness of the conditions of
approval.

The proposed building would be a one-story modular structure with
textured plaster exterior walls and a tile roof. The construction
will be similar to the Huntington Bank facility located at 125 North
First Avenue.

There are a total of seventeen (17) parking spaces proposed for the
project; fifteen (15) parking spaces are required based on six(6)
parking ~paces per 1001 square feet of gross building floor area.
The drive-up window facility would have two (2) lanes in full opera-
tion, the two (2) lanes should be able to accommodate at least sixteen
(16) cars at one given time.
ANALYSIS
A bank with a drive-up window facility is a permitted use in a C-2
zone with an approved conditional use permit. It is staff's opinion
that the site is appropriate for this type of business, and the cir-
culation and parking are adequate to accommodate the proposed
project.
The Director of Public Works has noted that the plan ,as submitted does
not show the existing corner cutoff at the southeast corner of Live
Oa~' Avenue and Myrtus Avenue. The proposed building, as shown on
t~e plan, may be encroaching into the street right-of-way at the
corner.

If any redesigning is necessary, staff feels that it will not cause
any detrimental 'effects upon the project or adjacent properties.
The Planning pepartment recommends that a condition of approval
state th?t the applicant may redesign the project to avoid encroaching
into the street right-of-way if all parking, landscaping, setback and
other appl.icable zoning r'equirements are met. Also, the location and
design of the drive-up window, facility must remain substantially the
same. This shal1~e'"subject to the review and approval of the Plan-
ning Department; ariy substantial changes will require the approval of
the Planning Commissiol! and any necessary fees.
Find attached for your information plot plan, floor plan and elevations
of the project.
Pursuant to the provlslons of the California Environmental Quality
Act, the Planning Department has prepared an initial study for the
proposed project. Said initial study did not disclose any substantial
or potentially substantial adverse change in any of the physical condi-
tions within the area affected by the project including land, air,
water, minerals, flora, fauna, ambient noise, and objects of historical
or aesthetic significance. Therefore, a Negative Declaration has
been prepared for this project. '
Before the Planning Commission or the City Council take action on
this project, they should "move to approve and file the Negative Dec-
laration and find that the project will not have a significant effect
on the environment".

RECOMMENDATION
.
The Planning Department recommends approval of C.U.P. 82-2 subject to
the follo~ing conditions:
1. Conditions as outlined in the attached report from the Depart-
ment of Public Works shall be complied with to the satisfaction
of the Director of Public Works.
2. That a covenant and agreement to hold the property as one parcel
be recorded in the office of the Los Angeles County Recorder for
Lots 1 and 2 of Trac~ No. 13623 1100-106 East Live-Oak Avenue).
Its form and content shall be subject to the review and approval
of the City Attorney.
3. That the applicant may redesign the project to avoid encroaching
into the street right-of-way if all parking, landscaping, setback
and other applicable zoning requirements are met. Also, the loc-
ation and design of the drive-up window facility must remain sub-
stantially the same. This shall 'be subject to the review and
approval of the Planning Department; any substantial changes will
require the approval of the Planning -Commission.
4. That C.U.P. 82-2 shall not take effect until the owner and
applicant have executed a form available at the Planning Depart-
ment indicating awareness and acceptance of the conditions of
approval. -

FINDINGS
.
To grant a conditiopal use permit for a drive-in business, the Plan-
ning Commission must make the following four findings:
1. The proposed use':complies with all, requirements set forth for
the issuance of a conditional use permit.
2. The proposed use will not substantially increase vehicular
traffic on any, street in a residentially zoned district.
3. The proposed use will not lessen the suitability of any nearby
commercially zoned property for commercial use by interfering
with pedestrian traffic.
4. The proposed use will not create increased traffic hazards to
pedestrians when located near a school, church, auditorium,
theater or other place of assembly.
After taking action on this application, the Planning Commission
should direct staff to prepare a resolution for adoptio~ at its
next meeting. The Planning Commission's action shall not be final
until adoption of the resolution. The appeal period for this action
commences at the time the Commission adopts the resolution.

The submitted plan does not show the existing corner cutoff at the southeast
corner of Live Oak Avenue and Myrtus Avenue, The proposed building, as shown
on the plan, may be encroaching into the street right-of-way at the corner.
The following conditions of approval are recommended for this conditional use
permit;
1. Submit grading and drainage plan for approval of the Director of Public Works.
2. Replace existing A.C. sidewalk on Myrtus Avenue with full parkway width
P.C.C. sidewalk.
3. Close all driveway openings not to be used.
4. Construct 18 inch width P.C.C. gutter on Myrtus Avenue.
5. Parkway trees shall be planted at locations to be determined by the Director
of Public Works, in accordance with City Standard Plan S-13.
