RESOLUTION NO. 1184 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA RECOMMENDING APPROVAL OF ZONE CHANGE 81-5 FROM CPD-l to CPD-l & H (HIGH RISE OVERLAY) FOR THE PROPERTY AT 333 - 421 EAST HUNTINGTON DRIVE. WHEREAS, an application was filed by Robert J. Low requesting Zone Change 81-5 from CPD-1 (Commercial Planned Development-i) to CPD-l & H (High Rise Overlay) for the property at 333 - 421 East Huntington Drive, more particularly described in attached Exhibit "A". WHEREAS, public hearings were held on November 24 and December 8, 1981, at which time all interested persons were given full opportunity to be heard and to present evidence. NOW, THEREFORE, BE IT RESOLVED THAT THE PLANNING COMMISSION MAKES THE FOLLOWING RECOMMENDATIONS AND FINDS AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached staff report is true and correct. Section 2. That the Planning Commission finds that the location of this site abuts a major arterial which is adequate to carry the kind of traffic which might be generated by a high rise development; that the site is adequately buffered from residentially zoned prop- erty; and that the size and shape of the property is appropriate for a high rise development. The Planning Commission also finds that in order to encourage the development as proposed in C.U.P. 81-13 and discourage speculation, which might inhibit proper development of the area, the Zone Change if approved should require development of the property in substantial compliance with plans submitted in Conditional Use Permit 81-13. Section 3. The Council approval of a Planning Commission recommends to the City Zone Change from CPD-l to CPD-l & H for the - 1 - 1184 , < . . . '-,' property at 333-421 East Huntington Drive provided that such Zone Change is conditioned upon the development of the property as per the plans on file on Conditional Use Permit 81-13. Further, that this Zone Change shall not be effective if C.U.P. 81-13 is not approved, or if said C.U.P. is approved or conditionally approved and the pro- posed project is not developed in accordance with said approved or conditionally approved plans, or said C~U.P. expires without the project being undertaken. Section 4. The Secretary this Resolution and shall cause shall certify to the adoption a copy to be forwarded to the of City Council of the City of Arcadia. FRONTAGE: EXISTING LAND USE & ZONING: 582.72 feet on Huntington Drive Developed with Arcadia Datsun Automobile Dealership; zoned CPD-l SURROUNDING LAND USE & ZONING: North: South: East: Vacant; zoned CPD-l Mixed commercial uses; zoned CPD-l Santa Anita Wash and recreational vehicle storage; zoned CPD-l Automobile Body Shop, mixed residential uses; zoned CPD-l West: GENERAL PLAN DESIGNATION: Planned Development Area - 1 HISTORY The City Council in March, 1980, directed staff to initiate proceedings for the consideration of amending the General Plan, Zoning Ordinance and zoning to allow for a greater range of uses and establish develop- ment regulations governing such uses for the area bounded by the 210 Freeway on the north, the AT&SF Railroad on the south, Fifth Avenue on the east and Second Avenue on the west. . 11/24/81 Page 1 On February 24, 1981, the Planning Commission adopted Resolution 1157 (G.P. 80-1) recommending amendments to the General Plan which would . establish a 'Planned Development Area-l land use designation and change the General Plan Map designations from Commercial and Industrial to Planned Development Area-l for the above-described area. The City Council on May 5, 1981 adopted Resolution 4955 which amended the land use element, establishing a Planned Development Area-l (PDA-l) land use designation and amending the General Plan Map designation to PDA-l for the subject area. On May 5, 1981 the City Council adopted Ordinance 1720 (Text Amendment 81-1) which established a CPD-l (Commercial Planned Development-l) Zone and regulations for said Zone. The Planning Commission on June 23, 1981 adopted Resolution 1165 recommending denial of Zone Change Z-81-2 from M-l, C-2 & D to CPD-l for the area bounded by the 210 Freeway on the north, the AT&SF Rail- road on the south, Fifth Avenue on the east and Second Avenue on the west. The Commission recommended denial of this Zone Change because upon review of the CPD-l zone regulations adopted by the City Council (T.A., 81-1) they did not see the need for allowing residential uses within this area and thought this would lead to land speculation and they also expressed concern that the minimum lot area requirement was too small. Based upon these CPD-l regulations, it was the consensus of the Commission that this zone change was not appropriate. . The City Council, however, adopted Ordinance 1728 which rezoned the above area to CPD-l and added an "H" (High Rise) overlay to the northeast corner of Huntington Drive and Second Avenue (proposed hotel site). PROPOSAL The applicant is requesting a zone change to add an "H" High Rise over- lay to the property in order to construct an eight-story building (in- cluding mezzanine) which will accommodate offices, a bank with drive-up teller, a restaurant, a delicatessen with outdoor seating and an auto- mobile dealership. The CPD-l zone allows a building of 3 stories a maximum height of 40'. The "H" high rise overlay allows an 8 story building not to exceed 85' in height. The "H" overlay would require a minimum 25' front yard setback and a minimum side and rear yard setback of 20' plus 2' for each story in excess of two stories. The "H" overlay would also limit the lot coverage to 37\% of the total area. ANALYSIS . An environmental impact report was prepared by Beland & Associates and approved by the City Council (Resolution 4924, December 16, 1980) for Z-81-5 11/24/81 Page 2 ~ the entire CPD-1 zoned area. This EIR addressed the General Plan Change, Redevelopment Plan Amendment, Text Amendment and Zone Change. The assessment of impacts was based on a hypothetical maximum potential development. The EIR did not address a high rise development on this particular site. The Datsun dealership was listed in the EIR as "Existing use to remain". Table 1 of the EIR "Maximum Potential Development Summary" illustrated 165,900 square feet of gross building area for offices ranging in building height from 5 to 8 stories. This proposed 8 story building is within the overall scope of inten- sity of development identified and considered in the EIR. However, if this Zone Change is approved, any subsequent proposal for "H" zoning within the CPD-1 area may require the preparation of a supplemental Environmental Impact Report to evaluate the potential environmental effects. The configuration and location of the subject site is adequate and appropriate for high rise development. . CEQA On December 16, 1980, Resolution 4924 was adopted by the City Council which determined that the EIR was completed in compliance with the California Environmental Quality Act (CEQA), the State Guidelines implementing CEQA, and the City of Arcadia regulations implementing CEQA.
