(,-.. ,..-, c RESOLUTION NO. 1183 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING CONDITIONAL USE PERMIT 81-14 TO PERMIT A CONSTRUCTION EQUIPMENT STORAGE YARD AT 11911 CLARK STREET. WHEREAS, an application was filed by R. D. Paving for a construc- tion equipment storage yard, Planning Department Case No. C.U.P. 81-14, on the property commonly known as 11911 Clark Street, more particularly described as follows: Lots 1185 - 1188 and a portion of Lots l177 through l184, Chicago Park Tract, Miscellaneous Records 30, Page lOO WHEREAS, a public hearing was held on November 24, time all interested persons were given full opportunity and to present evidence; 1981, to be at which heard NOW, THEREFORE,THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached staff report is true and correct. Section 2. This Commission finds that: 1. The granting of a Conditional Use Permit as hereinafter provided will not be detrimental to the public health or welfare or 'injurious to the property or improvement in such zone or vicinity. 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. 3. The site for the proposed use is adequate in size and shape to accommodate 'said use, including all yards, parking, loading, land- scaping and other features required to adjust said use with the land and uses in the neighborhood, 4\ The site abuts streets and highways adequate in width and pavement type to carry'the kind of traffic generated by the proposed use. 5. The granting of such Conditional Use Permit will not adver- sely affect the General Plan. - 1 - 1183 , - ,. i (~ ..,:: ( , -." 6. The use applied for will not have a substantial adverse im- pact on the environment. Section 3. That for the foregoing reasons, subject to the approval of the City Council, this Commission grants a conditional use permit for a construction equipment storage yard upon the following conditions: 1. Submit grading and drainage plan for approval of the Director of Public Works. 2. No trees may be planted within present and future right-of-way. 3. That Fire Safety shall be provided to the satisfaction of the Fire Chief. 4. That this Conditional Use Permit shall expire within ten years of the date of said approval. S. That, upon approval by the City Council, the temporary office building be allowed for a maximum of ten years. 6. That a landscape and irrigation plan shall be submitted to the Planning Department for its review and approval prior to any improvements being made to the site. ~ 7. That if the applicant wishes to construct a building on a permanent foundation, said plans should be submitted to the Plan- ning Commission for its review and approval, and the applicant shall comply with Conditions 2, 3, and 5 of the Department of Public Work's recommendations. ~ 8. That the site shall be cleared of all weeds and debris and shall be maintained in a neat and orderly manner. 9. That C.U.P. 81-14 shall not take effect until the applicant and owner have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. Section 4. The Secretary shall certify to the adoption of this Resolution and shatl cause a copy to be forwarded to the City Council of the City of ~!cadia. - 2 - 1183 ,. . . . -, . USE & ZONING: 23,900 square feet Approximately 312' on Clark Street The subject site is va~ant; zoned M-l & D North: South: East: Gravel excavation area; zoned M-l & D Vacant; zoned M-l & D Vacant and single-family dwellings; zoned M- 1 & D Gravel excavation area; zoned M-l & D West: GENERAL PLAN DESIGNATION: Industrial SPECIAL INFORMATION The subject site is a portion of the property leased by Livingston- Graham for gravel extraction. The applicant is proposing to sublease the property from Livingston-Graham in order to store construction equipment. The applicant is also requesting to place a 600 square foot mobile office trailer on the site. The trailer will be placed on blocks located on a concrete slab and be used for office purposes. The applicant is requesting a variance to the Building Code from the City Council to utilize the trailer for a maximum of ten years (the ma~imum lease period). The following improvements are b~ing propo~ed by the applicant: 1. Remove all weeds and debris and rough grade the property. . 11/24/81 Page 1 . . . ( 2. 3. Place gravel over dirt in unpaved areas. Construct a 6' high slumpstone block wall along the Clark Street frontage and a new chain link fence along the easterly property line. Landscape the 15' parkway area adjacent to the street. "the use will not The property is MISCELLANEOUS INFORMATION The plan has been reviewed by the Public Works Department (see attached report). It is staff's opinion taht Condition No. 1 "Submit grading and drainage plan for approval" and Condition No. 4 "No trees may be planted within the present and future right-of-way" should be complied with. However, the Commission may wish to review Conditions 2, 3, and 5 to determine the necessity of requiring said improvements at this time. The Fire Departm~nt has reviewed the plans and had no problems with the proposed use. They did recommend that a fire extinguisher for inside use be required. ANALYSIS Outdoor storage is a permitted use in an M-l zone with an approved conditional use permit. It is staff's opinion that this is an appro- priate use for this site. Although staff has some concern with the length of time the temporary office trailer is proposed to be used, it is our opinion that because the property is being subleased and the use is for equipment storage only, it would not be detrimental to the surrounding area. If at a future date the applicant wishes to construct a building on a permaneritfoundation said building should be subject to review by the Planning Commission. The Planning staff does not feel that Conditions 2, 3, and 5 of the Public Works Department recommendations should be mandatory at this time. These conditions refer to dedication of 5' for street widening purposes, construction of curb and gutter, 5' sidewalk and pave out between gutter and pavement and installation of street lights. Con- ditions 2, 3, and 5 should be complied with when and if a permanent building is constructed on the site, C.U.P. 81-14 11/24/81 Page 2 (, (',' Pursuant to the provisions of thi California Enviromental Qua~ity Act, the Planning Department has prepared an initial study for the proposed .project. Sqid initial study did not disclose any substantial or potentially substantial adverse change in any of the physical condi- tions within. the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. ' Before the Planning Commission or the City Council take action on this project, they should "move to approve and file the Negative Dec- laration and find' that the project will not have a significant effect on the environment". RECOMMENDATION The Planning Department recommends approval of C.U.P. 81-14 subject to the following conditions: 1. Conditions 1 and 4 of the Department of Public Works recommendation shall be complied with to the satisfaction of the Director of Public Works.
