RESOLUTION NO. 1123
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ARCADIA MAKING FINDINGS OF FACT AND DENY-
ING AN APPEAL OF THE MODIFICATION COMMITTEE'S
DENIAL OF MODIFICATION M-79-l24 TO ALLOW A TEN
FOOT HIGH WALL/FENCE IN LIEU OF A MAXIMUM SIX
FOOT ALLOWED FOR THE PROPERTY AT 520 CAMPESINA
ROAD.
WHEREAS, on October 2, 1979, an appeal of the Modification
Corr~ittee's denial of Modification M-79T124 was filed by George
W. Egan to allow a ten foot high wall/fence in lieu of a maximum
six foot allowed for the property at 520 Campesina Road, more
particularly described as follows:
Lot 23 of Tract No. 12900 in tbe City of
Arcadia, County of Los Angeles, State of
California, as per Map recorded in Book
262, Pages 47 and 48 of Maps in the office
of said County Recorder.
WHEREAS, the public hearing was held on November 27, 1979,
at which time all interested persons were given full opportunity
to be heard and to present evidence;
'NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning
Department in the attacbed report is true and correct.
Section 2. That we hereby make the following findings of fact:
l. That the proposed ten foot wall/fence would not
promote uniformity of development in its zone or vicinity.
2. That the proposed ten foot wall/fence would not
secure an appropriate improvement of the property.
Section 3. Based on the foregoing findings of fact, we here-
by deny the appeal of the Modification Committee's denial of
Modification M-79-l24.

Section 4. The Secretary shall certify to the adoption of
this Resolution.

SPECIAL INFORMATION
The following is a chronological summary of the events which have
preceded tonight's meeting:
It is the understanding of the undersigned that Mr. Egan had initially
contacted Associate Planner Jeff Witte of the Planning Department
regarding the addition to the existing block wall. According to
Mr. Egan, Jeff Witte explained that such an addition could be made
under the provisions of the Administrative Modification process.
According to Mr. Egan, he took the Administrative Modification
application forms to his neighbors. Upon receiving their signatures

approving his proposed wall extension, Mr. Egan constructed said
extension. At this time the Administrative Modification appli-
cation had not been submitted or acted upon by the City nor had
a required Building Permit been obtained for the extension.
On February 27, 1979, in response to a complaint by Mr. George
Schilly who resides at 526 Campesina, property maintenance inspection
of the property at 520 Campesina found that a four foot wood framed
bamboo fence was constructed on top of a six foot block wall. No
modification had been received for the ten foot high wall/fence
and no building permits had been issued for said wall/fence.
On March 7, 1979, the property owner filed an Administrative
Modification application for the ten foot wall/fence. Said appli-
cation had been signed by all of the adjoining property owners
including Mr. Schilly, approving the requested modification.

On March 9, 1979, Associate Planner Jeff Witte approved the Admini-
strative Modification application. It was noted that the adjoining
property owners had given their written approval to the request.
It was also noted that "Building permits cannot be issued until
the expiration of the five working day appeal period." (see
attached Administrative Modification form M-79-3BA dated March 9, 1979).
On March l5, 1979, the attached letter from Mr. George
526 Campesina was received by the Planning Department.

On March 19, 1979, letters were sent to Mr. Schilly and Mr. Egan
regarding the Administrative Modification which had been given by
Jeff Witte.
Upon 'the review of the Administrative Modification application by
the undersigned, it was noted that the approval by Jeff Witte should
not have been granted because at that time the enabling sections of
the Arcadia Municipal Code did not provide for the administrative
modification of fence height. Mr. Egan was advised that a regular
modification would be necessary (see attached letters).
As of April 9, 1979, Mr. Egan had not filed for the regular modifi-
cation and had not brought the wall/fence into code compliance.
A letter was sent to Mr. Egan stating that if an application was not
filed by April 17, 1979, the matter would be turned over to the
City Attorney.

On April l3, 1979, a letter was received from Mr. W. J. Schmitt
indicating that he was representing Mr. Egan (attached).
On April 25, 1979, the attached letter was sent from the Director
of Planning to Mr. Schmitt which attempted to summarize the actions
and indicated that no steps had been taken by Mr. Egan to resolve
this matter.
On May 9, 1979, the attached memo was sent to the City Attorney
turning this matter over to his office.
On May 2l, 1979, the Planning Department received the attached memo
from the City Attorney indicating that an official Notice and Order
should be sent to Mr. Egan.
On May 2l, 1979, the attached official Notice and Order was mailed
to Mr. Egan and Mr. Schmitt, requiring compliance within seven days.
On May 29, 1979, the attached letter was received from Mr. Schmitt,
stating that Mr. Egan would be out of the country until the middle
of June.
On June 7, 1979, the attached memo was sent to the City Attorney,
indicating that Mr. Egan had not complied with the Notice and Order.
On August 20, 1979, an office hearing was held with the City Attorney,
Director of Planning, Mr. Egan and Mr. Schmitt.
On August 27, 1979, Mr. Egan filed Modification application M-79-l24
for the lO foot wall/fence.
On August 27, 1979, the approval of the Santa Anita Rancho Associ-
ation was obtained for the proposed wall/fence.
On September ll, 1979, a public hearing was erroneously held before
the Modification Committee. Mr. Egan had advised the Planning
Department that he would be out of town on September ll, 1979, and
we had told him that the hearing would be held on September 25, 1979.
The actions of this meeting were invalidated and the hearing was
renoticed for September 25, 1979.
On September 25, 1979, a public hearing was held before the Modifi-
cation Committee. In order not to prejudice the proceedings entirely
different committee members were present and voting on this matter.

The modification was denied by the committee with the findings
"that the committee did not find the requested modification to
be necessary, that the lO foot height was excessive and would
not provide for an appropriate improvement." The Committee noted
that the wall addition was actually constructed before any
modification application had been filed with the City.
On October 2, 1979, Mr. Egan filed an appeal to the decision of
. the Modification Committee.
FINDINGS
To approve this Modification application, the Planning Commission
must find that the request would secure an appropriate improvement,
or prevent an unreasonable hardship or promote uniformity of
development.

Gentlemen:

This matter was presented to the subject committee on
September 25th and the request was denied. Accordingly,
I am appealing for a future hearing by the Planning
Committee as I was advised at the hearing on
September 25th by the Chairman, Mr. Hedlund.
Further, I was advised by one of the city employees,
who was on the committee, that a fee of $25.00, payable
to the City of Arcadia, would be required and check for
same is enclosed herewith. This person further advised
that the next Planning Committee meeting that I can
make would be November 27th, and it is requested that
our appeal hearing be scheduled for that date.

The Planning Director outlined the history of the application. The
applicant was present and spoke in favor of his request. Two neighbors
spoke in opposition to the requested modification. The Homeowners
Association had approved the requested modification. The Modification
Committee did not find the requested modification to be necessary, that
the lO foot height was excessive and would not provide for an appro-
priate improvement. The Committee noted that the wall addition was
actually constructed before any modification application had been
filed with the City.

Pursuant to your memo of May lB, 1979, a Notice and
Order was sent to Mr. Egan and to his attorney Mr.
Schmitt on May 2l, 1979, requiring compliance within
seven days.
On May 29, 1979, we received a letter from Mr. Schmitt
stating that Mr. Egan was in Europe and would not re-
turn until the middle of June "at which time he will
take this matter up wi th you."
A reinspection of the subject site was made today by
the Code Enforcement Officer. Said reinspection dis-
closed the continuing violation (photographs are in
the file).
This matter is forwarded to your office for subsequent
action.

garden wall in order to bring the wall into compliance with City Code.
An alternative action would be to contact the Arcadia Planning Dept.

The necessary corrections for code compliance as stated above must
be made within ~ days of this notice and order.
In the event of non-compliance, the City may cause the work to be
done and charge the costs to the property or its owner.
You are hereby advised that any person having any record title or
legal interest in the premises may appeal from this notice and
order to the Arcadia City Council, provided the appeal is made in
writing and filed with the Building Official or the City Clerk
within thirty (30) days from the date of this notice and order.
Failure to appeal will constitute a waiver of all right to an
administrative hearing and determination of this matter.
In the event that you fail, neglect, or refuse to comply with this
order, you will be guilty of a misdeameanor.

An inspection of the subject property was made this after-
noon and it was noted that the non-conforming fence had not
been brought into compliance.
As of this date this office has not, to my knowledge, received
any indication from ei ther ~Ir. Egan or his attorney Hr. Schmitt
to the effect that the subject fence has been or will be brought
into compliance with code.

Regretably, the efforts of the Planning Department have not

Dear Mr. Schmitt:
Mr. Egan constructed or caused to be constructed, without applying
for and receiving a Building Permit, an addition to an existing wall
which resulted in a structure which exceeded the maximum height allow-
able under the provisions of the Zoning Ordinance. On March 7, 1979,
Mr. Egan filed an Administrative Modification Application in order
to make legal the then existing structure. On March 9, 1979, the
Administrative Modification Application was approved by Associate
Planner, Jeffrey Witte. Subsequent to Mr. Witte's approval, this
matter was brought to my attention. On March 19, 1979, I wrote to
Mr. Egan advising him that the Administrative Modification was, in
essence, approved in error. In said letter I requested that Mr.
Egan either file for a Modification (not an Administrative Modifica-
tion) or bring the fence into compliance with code. I also requested
that Mr. Egan contact the Planning Department if he had any questions.
As of April 9, 1979, Mr. Egan had not filed for the Modification
and the fence had not been brought into compliance with code, nor
had we heard from Mr. Egan or his representative regarding this
matter.
On April 9, 1979, I sent Mr. Egan a second letter which
if a Modification Application had not been filed or the

On April 13, 1979, I received your letter which, regretably, in
no way resolves the existing code violation.
Regardless of "certain equities Mr. Egan may wish tq assert", it
appears to me that Mr. Egan has not taken any positive steps to~
wards a resolution of the illegally constructed fence and, there-
fore, I am compelled to turn this matter over to our City Attorney.

not been filed by April 17, 1979, or the subject fence has not
been brought into conformance with the Code, this matter will
be turned over to the City Attorney for prosecution.

Dear Mr. Egan:
I regret to inform you that the modification approval which you
received for the height of a fence for the property at 520
Campesina Road was issued in error and, therefore, is null and
void.

I have reviewed the case file and found that the modification
approval by Mr. Witte should not have been granted. The enabling
sections of the Arcadia Municipal Code do not provide for the
administrative modification of fence height.
You are hereby advised that you must file for a regular modifica-
tion and receive approval from the City's ~jodification Committee
or must bring the fence into compliance with the height regulations.
The regular Modification will require a public hearing before the
City's Modification Committee and notification to adjoining prop-
erty owners of said hearing, at which time they may present both
written and oral testimony regarding the requested modification.
Please contact Mr. Bud Lortz of the Planning Department at 446-4471
if you intend to file for the required modification or have any
questions.

Dear Mr. Schilly:
Thank you for your letter regarding the fence height modification
for the property at 520 Campesina Road.
I have reviewed the case file and found that the modification ap-
proval by Mr. Witte should not have been granted. The enabling
sections of the Arcadia Municipal Code do not provide for adminis-
trative modification of fence height.
If Mr. Egan wishes to have a fence exceeding six feet in height, he
will have to file for a Modification which will require a public
hearing before the City's Modification Committee. As an adjoining
property owner, you will receive a mailed notice of the date of the
hearing and you will have the opportunity to present both written
and oral testimony regarding the Modification requested.
I will be advising Mr. Egan of the fact that he must file for a
~lodification and receive approval of said ~lodification from the
Modification Committee or must bring the fence into compliance with
the height regulations.
