RESOLUTION NO. ll20
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA RECOMMENDING DENIAL
OF TEXT AMENDMENT 79-7 AMENDING SECTIONS
9275.4.7.2 and 9275.4.7.3 OF THE ARCADIA
MUNICIPAL CODE TO ALLOW CONVENIENCE FOOD
SALES IN CONJUNCTION WITH THE SALE OF
GASOLINE
WHEREAS, on October l7, 1979, Atlantic Richfield Company filed
an application for a text amendment to allow convenience food sales
in conjunction with the sale of gasoline, Planning Department Case
No. T.A. 79-7; and
WHEREAS, a public hearing was held on November l3, 1979, at
which time all interested persons were given full opportunity to be
heard and to present evidence;
NOW, THEREFORE, THE PLANNING CO~WISSION OF THE CITY OF ARCADIA
HEREBY RESOLVES AS FOLLOWS:
Section 1. That the factual data submitted by the Planning
Department in the attached report is true and correct.
Section 2. This Commission finds that public necessity has not
been demonstrated in the proposed text amendment and it is not consistent
with the General Plan.
Section 3. For the foregoing reasons the Planning Commission
recommends to the city Council denial of T.A. 79-7.
Section 4. The Secretary shall certify to the adoption of this
resolution.

REQUEST.
Text amendment amending Sections 9275.4.7.3 and
9275.4.7.3 to allow convenience food sales in
conjunction with the sale of gasoline.
PROPOSAL
Presently Sections 9275.4.7.2 and 9275.4.7.3 read:
"2. Automobile Service Stations. At an automobile service
station no activities other than the following shall be
conducted: dispensing gasoline. oil, grease, tires, batteries
and automobile accessories directly to users of motor vehicles:
tuning motors; wheel and brake adjustment and other minor
repairs and servicing of motor vehicles only to the extent
of installation of tires. batteries and automobile accessories
directly to users of motor vehicles; conducting a commercial
towing service by the operator of such service station,
provided that wrecked or damaged vehicles shall not be towed
to. nor stored upon, such service station property. All other
activities are prohibited including, but not limited to,
upholstering wprk, auto glass work, painting. welding, tire
recapping and auto dismant ling.
3. Automobile Self-Service Stations. Self-service gasoline
dispensing shall be permitted provided that approved dispensing
such as, but not limited to, remote control, token-operated
and card-operated types are used. Said use shall comply with

requirements of the Fire Department. There shall be at least
one qualified attendant on duty at all times while the station
is open to the public, for each 16 single dispensing units or
combination thereof. It shall be the responsibility of the
attendant to supervise, observe and control the dispensing of
gasoline, to prevent the dispensing of gasoline into portable
containers that are not approved as per Section 15.703(d) of
the Fire Code, control sources of ignition, to immediately
handle accidental spills and fire extinguishers if needed and
to lend assistance to handicapped persons in the dispensing of
gasoline.

At an automobile self-service station no activities other than
the following shall be conducted: dispensing gasoline, oil,
grease, tires, batteries and automobile accessories directly
to users of motor vehicles; tuning motors; wheel and brake
adjustment and other minor repairs and servicing of motor
vehicles only to the extent of installation of tires, batteries
and automobile accessories directly to users of motor vehicles;
conducting a commercial towing service by the operator of such
self-service station, provided that wrecked or damaged vehicles
shall not be towed to, nor stored upon, such service station
property. All other activities are prohibited including, but
not limited to, upholstering work, auto glass work, painting,
welding, tire recapping, and auto dismantling. There shall
be no distribution or sale on the subject site of food, carbona-
ted drinks and cigarettes except from dispensers within a
building, or other items not incidental to the operation of
motor vehicles. There shall be no storage, sale, display
or advertisement for sale or lease of motor vehicles, trucks
or trailers on the subject site. (Amended by Ord. l535

Atlantic Richfield is requesting to amend Sections "9275.4.7.2.
Automobile Service Stations" and "9275.4.7.3. Automobile Self-
Service Stations" by adding the following language:
"The following act i vi ties shall be included, t he retail sale
of those items normally found in convenience food stores, said
items being food, beverages, tobacco products, books and
periodicals, dairy products, health and beauty aides, fast
snacks and household soaps and cleansers."

Atlantic Richfield notes in its application that "the intent is
to allow convenience food stores in Arcadia to sell gasoline either
under a full or self service method."

The applicant has recently converted the service bay areas in several
of their service stations to convenience food stores and has con-
tinued to sell gasoline. These facilities are operated on a franchise
basis. Attached is a list of the stations which now have mini
markets.
ANALYSIS
The Planning Department is not opposed to the concept of a mini
market located in a service station. It is staff's opinion, however,
that the market should be an ancillary use to the service station
facility and not vice versa (i.e., convenience food store with
gasoline pumps).

It is staff's recommendation that a new conditional use permit
should be required for a service station which wishes to convert
its bays into a mini market or other use which might be incidental
or secondary to the service station function. The conditional
use permit process would allow the Planning Commission and City
Council to review plans to ensure that the location is appropriate,
that there is adequate parking and circulation and that the colors,
materials and design are compatible with surrounding areas.
The Planning Department, therefore, recommends the following additions
and changes:
Section 9275.1.39.3 and 9275.1.39.4 should be added to the
"conditional uses in specified zones":
"9275.1.39.3.

Incorporating the word "ancillary" in this section allows other uses
which the Planning Commission and City Council may determine, during
the conditional use permit process, to be incidental to the primary
function of the service station.
Section 9275.4.7.2 shall be amended to read:

There shall be no distribution or sale on the subject site

of motor vehicles, trucks or trailers on the subject site.
Pursuant to the provisions of the California Environmental Quality
Act, the Planning Department has prepared an initial study for the
proposed project. Said initial study did not disclose any sub-
stantial or potentially substantial adverse change in any of the
physical conditions within the area affected by the project including
land, air, water, minerals, flora, fauna, ambient noise, and objects
or historical or aesthetic significance. Therefore, a Negative
Declaration has been prepared for this project.
Before the Planning Commission takes action on this project, the
Commission should "move to approve and file the Negative Declaration
and find that the project will not have a significant effect on
the environment."
RECOMMENDAT ION
The Planning Department recommends that Sections 9275.1.39.3 and
9275.1.39.4 be added to the Arcadia Municipal Code and that Sections
9275.4.7.2 and 9275.4.7.3 be amended as presented by staff.
