RESOLUTION NO, 1117 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA MAKING FINDINGS OF FACT AND DENYING CONDITIONAL USE PERMIT 79-15 FOR THE CONSTRUCTION OF A 47 UNIT CONDOMINIUM AT 509 - 523 WEST DUARTE ROAD WHEREAS, on September 18, 1979, an application was filed by Sam J, Falzone to construct a 47 unit condominium, Planning Department Case No. C,U.P, 79-15, on the property commonly known as 509, 515 and 523 West Duarte Road, more particularly described in attached Exhibit "A", WHEREAS, a public hearing was held on October 9, 1979, at which time all interested persons were given full opportunity to be heard and to present evidence; NOlI', THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: . Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct, Section 2. That the Planning Commission hereby makes the follow- ing findings of fact: 1, That there is a likelihood that the oroooserl conrlominillm will conflict with the proposed land use regulations. 2, That the proposed condominium is too intense for the subject site. Section 3. Based on the foregoing findings of fact we hereby deny the application for Conditional Use Permit 79-15, Section 4. The Secretary shall certify to the adoption of this Resolution. BUTLER ASSOCIATE PLANNER On October 11, 1979, Sam J. Falzone appealed the Planning Commission's denial of Conditional Use Permit 79-15 for the construction of a 47 unit condominium at 509-523 West Duarte Road. Mr. Falzone noted in his letter nIf it is at all possible, at the time of the hearing of denial, it would be appreciated lf we could receive an approval of the project with conditions, even if it required deletion of 1, 2 or 3 of the units in order to create the additional open space requested by the Planning Commission.n The City Council at lts November 6, 1979 meeting referred this back for its review and recommendation. This is not a public hearing. The applicant's revised plans have deleted two center of the project for a total of 45 units. plans show the following characteristics: Building units in the The revised The applicant is requesting a modification to allow thirty-five foot high buildings measured at the garage level (same as the original plan). There will be 26 two-bedroom units ranging in size from 1186 square feet to 1565 square feet and 19 three- bedroom units with 1629 square feet. Parking Nine guest parking spaces are provided on the site and each unit has an attached two-car garage (2.2 parking spaces per unit). Six guest parking spaces are centrally located, the remaining three are interspersed among the buildings. . C.U.P. 79-15 November 13, 1979 Page Two Access will be from two 26 foot wide driveways off of Arcadia Avenue. There will be no access from Duarte Road. Open Space The units will have the following approximate amount of private open space: Includin:l Access Excluding Access Unit A 194.75 sq. ft. * 139.2 sq. ft. Unit B 194. 75 sq. ft. * 139.2 sq. ft. Unit C 259 sq. ft.* 202.5 sq. ft. Unit D 226.25 sq. ft. 170 sq. ft. * This figure does not take into account the encroachment of the fireplace. . There is approximately 39% (not including the planter strips adjacent to the driveway and open parking spaces) open space on the site, 6.9% of which is in common open space. Miscellaneous Information The trash areas have been equally distributed between the units. The proposed 4' high slumpstone wall has been moved out of the required setback on Duarte Road. Analysis The revised plan is not consistent with the following amendments to the R-3 regulations being considered by the Planning Commission ad hoc committee: 1) 2.5 parking spaces per unit II 2) A 30 foot back-up area 3) A minimum of 200 square feet of private outdoor open space shall be provided; when access is gained through this private area, a minimum of 230 square feet shall be provided. The subject condominium meets all of the reauirements of the present R-3 Code and we believe it would be"a definite improvement for the area in which it is to be built. It is respectfully requested that the City Council at its' meeting of October 16, 1979, set a date for hearing an appeal of the denial. If it is at all possible at the time of the hearing of denial, it would be appreciated if we could receive an approval of the project with conditions, even if it required the deletion of 1, 2, or 3 of the units in order to create the additional open space requested by t~e Planning Commission. since time is of the essence, we would request that the hearing date be set as soon as possible. A condominium is a permitted use in a R-3 zone with an approved conditional use permit, This development complies with the existing R-3 requirements and is consistent with the General Plan. Pursuant to the provisions of the California Environmental 0uality Act, the Planning Department has prepared an initial study for the proposed project, Said initial study did not disclose any substan- tial or potentially substantial adverse change in any of the phy- sical conditions within the area affected by the project including land, air, water, minerals, flora, fauna ambient noise, and objects of historical or aesthetic significance.
