RESOLUTION NO. 1116
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT
FOR THE ADDITION OF A PLANT NURSERY TO AN EXISTING
HARDWARE STORE AT 150 EAST LIVE OAK AVENUE
WHEREAS, on September 18, 1979, Dave Szany filed an application
for the addition of a plant nursery, Planning Department Case No. 79-16
on property commonly known as 150 East Live Oak Avenue, more particular-
ly described as follows:
Lots 11-15 and portion of Lot 10 of Tract 13623,
Map Book 278, Page 29 of Maps located in the City
of Arcadia, County of Los Angeles, State of
California
WHEREAS, a public hearing was held on October 9, 1979, at which
time all interested persons were given full opportunity to be heard
and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA
HEREBY RESOLVES AS FOLLOWS:'
Section 1. That the factual data submitted by the Planning De-
partment in the attached report is true and correct.
Section 2. This Commission fin~s that:
1. The granting of this Conditional Use Permit and modifica-
tions as hereinafter provided will not be detrimental to the public
health or welfare or injurious to the property or improvements in such
zone or vicinity.
2. The use applied for at the location indicated is properly
one. for which a Conditional Use P~rmit is authorized.
3. The site'for the proposed use is adequate in size and shape
to accommodate. said use including all yards, parking, loading, land-
scaping and other features required to adjust said use with the land
and uses in the neighborhood.
4. The site abuts streets and highways adequate in width
and pavement type to carry th~ kind of traffic generated by the proposed
use.

5. The granting of such Conditional Use Permit will not
adversely affect the General Plan,
6. The use applied for will not have a substantial adverse
impact on the environment,
7, The proposed use complies with all requirements set forth
for the issuance of a Conditional Use Permit.
8. The proposed use will not substantially increase vehicular
traffic on any street in a residentially zoned district.
9. The proposed use will not lessen the suitability of any
nearby commercially zoned property for commercial use by interfering
with pedestrian traffic.
10. The proposed use will not create increased traffic hazards
to pedestrians when located near a school, church, auditorium, theater
or other places of assembly.
Section 3. That for the foregoing reasons, subject to approval
of the City Council, this Commission grants a Conditional Use Permit
for the addition of a plant nursery to an existing hardware store upon
the following conditions:
1. The proposed building shall comply with Building Division
regulations,
2. Conditions as outlined in the attached report from the
Department of Public Works shall be co~plied with to the satisfaction
of the Director of Public Works,
3. The proposed building shall comply with regulations set
forth by the Fire Department,
4. The Planning Commission grant the following modifications:
A. (9263.5.1,) To delete the required 3% of the in-
terior parking area to be landscaped,
B. (9269.5.) To permit 100 parking spaces in lieu of
122 spaces required.
5. Conditional Use Permit 79-16 shall not take effect until
the owner and applicant have executed a form available at the Planning
Department indicating awareness and acceptance of the conditions of
approval.

Section 4. The Secretary shall certify to the adoption of
this Resolution.

SPECIAL BUILDING INFORMATION
The area of the existing building is approximately 15,000 sq. ft.
The proposed nursery will contain a total area of 9,500 sq. ft. and
will be attached to the south east corner of the existing building.
The main entrance would consist of a covered area of approximately
1,912 sq. ft.
The entrance enclosure will have a stucco exterior with wrought iron
railings within the breezeways and a simulated tile roof, The non-
enclosed portion of the nursery will be contained by a 10' chain
link fence with redwood lath inserts.
PARKING
The proposed project will provide 100 parking spaces with ingress
and egress from three driveways on Live Oak Avenue, one driveway
on Second Avenue and incorporates the 20' alley adjacent to the
south property line of said project.
ANALYSIS
The proposed nursery is a permitted use in a C-2 zone with an approved
Conditional Use Permit.
The addition of a nursery to the existing building on the subject site
would be consistent with the General Plan and Zoning Ordinance.
Pursuant to the provisions of the California Environmental Quality
Act, the Planning Department has prepared an initial study for the
proposed project. Said initial study did not disclose any substan-
tial adverse change in any of the physical conditions within the
area affected by the project including land, air, water, minerals,
flora, fauna, ambient noise and objects of historical or aesthetic
significance. Therefore, a Negative Declaration has been prepared
for this project.
Before the Planning Commission takes action on this project, the
Commission should "move to approve and file the Negative Declaration
and find that the project will not have a significant effect on the
environment."
RECOMMENDATION
The Planning Department recommends approval of C.U.P. 79-16 subject
to the following conditions:
1. The proposed building shall comply with Building Division
regulations.
2. Conditions as outlined in the attached report from the Depart-
ment of Public Works shall be complied with to the satisfaction
of the Director of Public Korks.
