RESOLUTION NO. 1114
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA RECOMMENDING DENIAL
OF A TEXT AMENDMENT TO ALLOW THE SALE OF
CHRISTMAS TREES AND FIREWORKS ON PROPERTY
ZONED R-3 WHICH ABUTS COMMERCIALLY ZONED
PROPERTY
WHEREAS, a text amendment was initiated by the City for. the
consideration of allowing the sale of Christmas trees and fireworks
on property zoned R-3 which abuts commercially zoned property; and
WHEREAS, a public hearing was held on September 25, 1979,
at which time all interested persons were given full opportunity
to be heard and to present evidence;
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION
. OF. THE CI~Y OF ARCADIA AS FOLLOWS:
SECTION 1. That the factual data submitted by the Planning
Department in the attached report is true and correct.
SECTION 2. This Commission finds that the proposed Text
Amendment is an unwarranted commercial intrusion into a residential
zone; is an inconvenience and a hazard to the residential areas and
that there are adequate areas presently zoned commercial which would
allow the sale of fireworks and Christmas trees.
SECTION 3. For the foregoing reasons the Planning Commission
recommends to the City Council denial of T. A. 79-6.
SECTION 4. The Secretary shall certify to the adoption of
this resolution.
I HEREBY CERTIFY that the foregoing resolution was adopted
at a regular meeting of the Planning Commission of the City of Arcadia
on the 9th day of October , 1979, by the following vote:

TEXT AMENDMENT TO ALLOW THE SALE OF CHRISTMAS
TREES AND FIREWORKS ON PROPERTY ZONED R-3
WHICH ABUTS COMMERCIALLY ZONED PROPERTY
PROPOSAL & ANALYSIS

On September 4, 1979, the City Council instructed staff to in-
itiate the following text change in order to allow the sale of
fireworks and Christmas trees on property zoned R-3 which abuts
commercially zoned property. The proposed addition would read:
"9281.4. Christmas Tree and Fireworks Sales. By a vote
of 3/5 of the membership of the City Council, the City
Council may authorize the sale of Christmas trees and
fireworks on property zoned R-3 where it abuts commercially
zoned property, Any such sales shall otherwise be conducted
in compliance with the Arcadia Municipal Code and any re-
quirements of the Building & Planning Departments. For the
purpose of this Section 9281.4 only, R-3 zoned property is
deemed to abut commercially zoned property when they are
separated by a street or alley."
As noted, any sales of fireworks or Christmas trees on an R-3
zoned lot would have to comply with the other regulations in the
Arcadia Municipal Code. The sales would also require review and
majority approval of the City Council.

Pursuant to the provisions of the California Environmental Quality
Act, the Planning Department has prepared an initial study for the
proposed project, Said initial study did not disclose any substan-
tial or potentially substantial adverse change in any of the phy-
sical conditions within the area affected by the project including
land, air, water, minerals, flora, fauna, ambient noise, and ob-
jects of historical or aesthetic significance. Therefore, a
Negative Declaration has been prepared for this project.

Before the Planning Commission and City Council takes action on
this project, the Commission and Council should "move to approve
and file the Negative Declaration and find that the project will
not have a significant effect on the environment."
RECOMMENDATION
The Planning Department recommends approval of T.A. 79-6 as
noted above.
