RESOLUTION NO, 1109 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA MAKING FINDINGS OF FACT AND DENY- ING CONDITIONAL USE PERMIT 79-12 FOR THE EXPANSION OF AN EATING ESTABLISHMENT AND THE ADDITION OF DRIVE- THRU SERVICE FACILITIES AT 100 EAST LIVE OAK AVENUE WHEREAS, on July 20, 1979, an application was filed by Joseph Alfi to expand an existing eating establishment and add drive-thru service facilities, Planning Department Case No. C.U.P, 79-12, on the property commonly known as 100 East Live Oak Avenue, more par- ticularly described as follows: Lots l"and 2 of Tract NO,.13623 in the City of Arcadia, County of Los Angeles, State of California, as per map recorded in Book 278, Page 29 of Maps in , the office of said County Recorder, . WHEREAS, a public hearing was held before the Planning Commission on August 14, 1979, at which time all interested persons were given full opportunity to be heard and to present evidence; . NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning Department in the attached report is true and correct, Section 2. That we hereby make the following findings of fact: 1, That the site for the proposed. use is not adequate in size and Shape to accommodate said proposed expansion including all.parking, landscaping and other features required to ad- just said expansion with the land uses in the neighborhood. 2, That the proposed expansion will generate an increase in vehicular traffic which cannot be accommodated on the sub- ject site, 3, That the granting of the permit would be detrimental to the public health and welfare, and injurious to the property or improvements in its zone or vicinity, -1- 1109 .. ." . 4It Section 3. Elimination of the required four trees in the parking area (one tree for every ten parking spaces or any fraction thereof - 9269,13,A) -1- . . . , , 5, Elimination of the required 5'-3" wide landscape buffer and 35" high landscaped berm or 35" high solid masonry wall between parking area and Myrtus Avenue (9269,13,A) 6, Elimination of the required screening of the roof mounted mechanical equipment (9263,6.3) SPECIAL INFORMATION Building: Building Area: 1,475 square feet Existing Restaurant Area: 1,414 square feet Floor Area for Proposed Restaurant: 1,752 square feet (see Exhibit "A") Seating Capacity: The existing seating capacity is 36 persons, with the propo~ed expansion the total seating capacity will be approximately 50, Parking, Landscaping and Buffers: Thirty-five parking spaces are required for the expanded restaurant use, Forty-five substandard parking spaces exist (approximately 7 foot wide parki8g spaces and 9 foot aisle width in lieu of 15,7 feet required for 30 angled parking. The applicant proposes to rest ripe the lot to provide for 24 substandard parking spaces (see Exhibit "B" and modifications required), Twelve of the existing forty-five parking spaces have wheel stops, The wheel stops on the westerly property line are situated so that cars overhang the public right-of-way, Access to the parking lot is through a twenty foot alley to the south of the subject site and two-way driveways off of Live Oak Avenue and Myrtus AVfOnue, There is no landscaping on the subject site, MiscellanfOous Information: The mechanical equipment on the roof can be seen from the rear of the adjoining properties. Driving east or west on Live Oak Avenue, the mechanical equipment is noticeable. There is no trash enclosure on the site, The propo$ed hours of operation are 11 A,M, to 10 P,M, -2- , , . . . ANALYSIS A drive-thru eating establishment is a permitted use in a C-2 zone with an approved Conditional Use Permit. .The existing Burger Queen is a legal nonconforming use and'therefore does not have a Conditional Use Permit, A preliminary analysis by staff on the number of standard parking spaces that can be accommodated on this site is 24 (see Exhibit "C"). This would allow for the trash enclosure, 3% interior landscaping, trees and a 5'-3" wide landscaped buffer along the westerly property line. Therefore, to approve this project the Planning Commission would need to grant a modification for 24 parking spaces in lieu of 35 spaces required or a 31% reduction in the required parking. It is staff's opinion that egress from the drive-thru service area may create significant traffic problems in the area (see Exhibit "C"). Staff would recommend that traffic be prohibited from entering through the driveway located on Live Oak Avenue and that the proposed drive- thru service facility be extended 5 feet. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project, Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance, Therefore, a negative declaration has been prepared for this project. Before the Planning Commission takes action on this project, the Commission should "move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment". RECOMMENDATION Due to the parking deficiency and the numerous modifications required, the Planning Department recommends denial of C.U.P. 79-12, However, should the Planning Commission wish to consider approval, the Planning Department recommends the fOllowing conditions: 1, Conditions as outlined in the attached report from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works, 2. That a trash enclosure be provided to the satisfaction of the Planning Department. 3, That a modification be granted for 24 standard parking spaces in lieu of 35 required and that the lot be restriped to the satisfaction of the Planning Department. -3- . . . 4. That all mechanical equipment be screened from view. 5, That the expansion meet all Building and Fire Departments require- ments. (A preliminary plan check by the Fire Department requires the installation of an automatic extinguishing system over the cooking area,) 6, That the hours of operation be restricted to 11:00 A.M. to 10:00 P,M. 7, That the size and location of all directional signs shall be approved by the Public Works and Planning Departments, 8, That the driveway located on the northerly property line (Live Oak Avenue) be restricted to only egress (only if drive-thru service is approved). 9, That the drive-thru service facility be extended 5 feet to the satisfaction of the Planning Department, 10, That all landscaping shall comply with code. After taking action on this application, the Planning Commission should direct staff to prepare a resolution for adoption at its next meeting. The Planning Commission"s action shall not be final until adoption of the resolution. The appeal period for this action commences at the time the Commission adopts the resolution, -4- . . .
