RESOLUTION NO. 1108 A RBSOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A ZONE VARIANCE TO CONSTRUCT A SINGLE FAMILY DWELLING ON A SITE WITH AN EXISTING DWELLING AT 1109 SOUTH FIRST AVENUE WHEREAS, on July 13, 1979, an application was filed by John and Vasiliki Giakas for a zone variance to permit the construction of a single family dwelling on a site with an existing dwelling, then upon completion of the new dwelling, to convert the existing dwelling into a guest house, Planning Department Case No, V-79-1, on property commonly known as 1109 South First Avenue, more partic- ularly described as follows: Portion of Lot 6, Arcadia Acreage Tract, Map Book 10, Page 18, in the City of Arcadia, County of Los Angeles, State of California WHEREAS, a public hearing was held on said matter on August 14. 1979, at which time all interested persons were given full opportunity to be heard and to present evidence, NOW. THEREFORE, TEE PLANNING COI.IMISSlON OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1, That the factual data submitted by the Planning . Department in the attached staff report is true and correct, Section 2. This Commission finds that: 1, That there are exceptional or extraordinary circumstances or conditions applicable to the property involved, 2, That the granting of such variance will not be materially detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity in which the property is located. 3. That such variance is necessary for the preservation and enjoyment of a substantial property right of the applicant possessed bv other property in the same zune and vicinity. -1- 1108 . . . 4. That the granting of such variance will not adversely affect the comprehensive General Plan. Section 3, That for the foregoing reasons, subject to approval of the City Council, this Commission grants a zone variance for the construction of a single family dwelling on a site with an existing dwelling upon the following conditions: 1. That the property shall be improved as per plans on file in the subject case No, V-79-1. 2. That the Building Department inspect the property prior to the issuance of any permits to ensure that all existing structures comply with the Building Code requirements. 3, All building code violations shall be brought into compli- ance prior to final inspection of the premises and occup- ancy of the new dwelling, 4. The Planning Commission grants a modification for a 19' rear yard setback for the accessory living quarters in lieu of 25 feet required. 5, The Planning Commission grants a modification for the access- ory buildings to contain 102% of the ground floor area of the main dwelling in lieu of 50% allowed by code. 6. The Planning Commission grants a modification for the exist- ing garage which was constructed without building permits to have a two foot side yard setback in lieu of 3 feet required by code, 7. That the applicant shall file a covenant in a form and con- tent approved by the City Attorney, guaranteeing that upon completion 'of the front dwelling, the kitchen 'will be removed from the :rear dwelling and that said rear dwelling shall be used only as a guest house, 8, V-79-1 shall not take effect until the applicant and owner have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. -2- 1108 . . . BUTLER ASSOCIATE PLANNER GENERAL INFORMATION APPLICANT: JOHN AND VASILIKI GIAKAS LOCATION: 1109 SOUTH FIRST AVENUE REQUEST: ZONE VARIANCE TO CONSTRUCT A HOME ON A SITE WITH AN EXISTING DWELLING, THEN CONVERT THE EXISTING DWELLING INTO A GUEST HOUSE, EXISTING LAND THE SITE IS DEVELOPED WITH TWO DWELLINGS AND ACCESSORY USE & ZONING BUILDINGS; ZONED R-l AREA: 17,617 SQUARE FEET 69 FEET ON FIRST AVENUE FRONTAGE: SURROUNDING LAND USE & ZONING: PROPERTIES TO THE NORTH, SOUTH, EAST AND WEST ARE ZONED R-l AND DEVELOPED WITH SINGLE FAmLY DWELLINGS, GENERAL PLAN: AREA IS DESIGNATED FOR SINGLE FAMILY RESIDENTIAL (0-6 dufac) SPECIAL INFORMATION The front dwelling was constructed in 1926 with additions made in 1936, 1938.~nd 1950, This house is'in poor condition and in need of major repair, The rear dwelling with an attached garage was constructed in 1957, It appears that some time in the past the attached garage was con- verted into a room and a carport was constructed on the north side of the house (no building permits are on file). -1- , . . . The applicant is proposing to demolish the front dwelling and replace it with a two-story dwelling containing 3,205 square ~~~t (including an attached-~garage), He is also proposing to demolish the shed adjacent to the existing garage and the carport which is attached to the rear house, The applicant is requesting the zone variance so that he may live in the rear dwelling while the front house is being constructed. Upon completion of the front house, the kitchen in the rear house would be removed and the house converted into a guest house. The rear dwelling contains approximately 1,478 square feet and the detached garage contains 540 square feet, for a total area of 2,018 square feet, The ground floor of the proposed house contains only 1,970 square feet. Section 9252,2,11 of the Arcadia Municipal Code states ".. ,The total area of accessory buildings, shall not exceed 50% of the ground floor area of the main building." The accessory buildings (garage and rear dwelling) exceed the allowable 50% by 52%, The applicant has stated he wishes to utilize the existing garage for additional parking and storage. If this application were approved, the following modifications would be required: 1. Accessory living quarters to be located 19 feet from the rear property line in lieu of 25 feet required, 2. Accessory buildings to contain 102% of the ground floor area of the main dwelling in lieu of 50% allowed by code. 3, The existing garage (no building permits on file) to have a two foot side yard setback in lieu of 3 feet required by code, REQUIRED FINDINGS The Planning Commission should examine the information and make findings which are relevant to the prerequisite conditions below: Section 9291.1,2 of the Arcadia Municipal Code states: "Prerequisite Conditions, Before a variance may be granted, it shall be shown: a, That there are exceptional or extraordinary circumstances or conditions applicable to the property involved, or ~o the intended use of the property, that do not apply generally to the property or class of use in the same zone or vicinity. b, That the granting of such variance will not be materially detri- mental to the public health or welfare or injurious to the property or improvements in such zone or vicinity in which the property is located. -2- . c, That such variance is necessary for the preservation and enjoyment of a substantial property right of the applicant possessed by other property in the same zone and vicinity, d. That the granting of such variance will not adversely affect the comprehensive general plan." Attached for your consideration are those pages of the application in which the applicants have stated their case regarding the aforementioned prerequisite conditions, ANALYSIS The granting of this variance would allow the temporary retention of two single family dwellings on a lot. However, at the time the rear house is converted to a guest house, the uses would be conforming. Because of the age and condition of the front dwelling, the construction of a new dwelling would be a substantial improvement in the neighborhood, If this application is approved, in order to ensure that the kitchen in the rear dwelling will be removed and the dwelling used as a guest house only, a covenant in a form and content approved by the City Attorney should be filed on the property. . Also. in order to determine that all remaining buildings will comply with the building code requirements, a real estate inspection should be performed by the building division prior to the issuance of any building permits. Any building violations noted on the real estate inspection report should be brought into compliance prior to final inspection of the premises. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project, Said initial study did not disclose any substan- tial or potentially substantial adverse change in any of the phy- sical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration bas been prepared for this project, Before the Planning Commission takes action on this project, the Commission sbould "move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment," RECOMMENDATIONS The Planning Department recommends approval of V-79-1 subject to the following conditions: . -3- . 1, That the Building Department inspect the property prior to the issuance of any permits to ensure that all existing structures comply with the Building Code requirements. 2.
