RESOLUTION NO. 1106 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CON- DITIONAL USE PERMIT FOR A CHURCH EXPANSION AT 725 AND 805 NORTH FIRST AVENUE WHEREAS, on June 25, 1979. Victory Chapel Church of the Foursquare Gospel, filed an application for a church expansion, Planning Department Case No. C.U,P. 79-11 on property commonly known as 725 and 805 North First Avenue, more particularly described as follows: Lots 67-72 of Tract 7820, Map Book 83 Page 30 of Maps and portions of Lots 6 and 8, of Tract 3112, Map Book 29 Page 68 of Maps located in the City of Arcadia, County of Los Angeles, State of California. WHEREAS, a public hearing was held on July 10, 1979 at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Planning Department in the attached report is true and correct. SECTION 2. This Commission finds that: 1. The granting of conditional use permit as hereinafter provided will'not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity, 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized, -1- 1106 ; . . . 3. The site for the proposed use is adequate in size and shape to accommodate said use including all yards, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the General Plan. 6. The use applied for will not have a substantial adverse impact on the environment. 7. The proposed use complies with all requirements set forth for the issuance of a conditional use permit. 8. The proposed use will not substantially increase vehicular traffic on any street in a residentially zoned district. 9. The proposed use will not lessen the suitability of any nearby commercially zoned property for commercial use by interfering with pedestrian traffic. 10. The proposed use will not create increased traffic hazards to pedestrians when located near a school, church, audi- torium, theater or other place of assembly. SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a conditional use permit for the church expansion upon the fOllowing conditions: 1. The property shall be improved and maintained in accordance with plans on file in the subject case C.U.P. 79-11 and applicable regulations of the Arcadia Municipal Code. -2- 1106 . . . .' 2. That a landscape and irrigation plan be provided for the area along First Avenue and for the area west of the two story addition. 3, That final elevations be presented to the Planning Department for its review and approval prior to issuance of the building permits. 4, A trash enclosure with gates shall be provided as per Section 9262.6.9, 5. The parking area shall be cleaned of all weeds. 6, That the vacant lot north of the driveway onto First Avenue be maintained free of weeds and debris, 7, That a lot consolidation for the entire church property (including the lot at 725 North First) shall be filed prior to January 1, 1980, and approved and recorded for the subject site, No building permits shall be issued until said consolidation is recorded with the County. 8. Submit a grading and drainage plan for approval of the Director of Public Works, 9. On First Avenue adjacent to the proposed addition, construct P.C.C. sidewalk; close existing driveway aprons not to be used; plant parkway trees in accordance with plans to be approved by the Director of Public Works. 10. Construct ramp for handicapped at the southwest corner of Forest Avenue and First Avenue. 11. C.D,P. 79-11 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. -3- 1106 . . . APPROXIMATELY 199 feet ON FIRST AVENUE APPROXIMATELY 218 feet ON FOREST AVENUE NORTH: Developed with Single-Family Dwellings; Zoned R-2 and R-l SOUTH: Developed with mixed residential uses and the 210 Freeway; Zoned R-2 EAST: Developed with mixed residential uses; Zoned R-2 WEST: Developed with Single Family dwellings and the 210 Freeway; Zoned R-2 SINGLE FAMILY RESIDENTIAL 0-6 du/ac. The church was constructed in 1963, prior to the requirement for a Conditional Use Permit. In 1967 a Conditional Use Permit was grant- ed to the Arcadia Baptist Church to operate a pre-school day nursery on this site (CUP 67-8). Between 1967 and 1976 ownership of the church changed. . . . In 1976 a Conditional Use Permit was granted to expand the church parking area and to operate a pre-school at 805 North First. (CUP 76-8) A condition of approval for this C.U.P. was that "A lot con- solidation be filed prior to January 1, 1979, and approved and re- corded for the subject site including 723-725 South First Avenue." This condition has not been complied with. SPECIAL INFORMATION Building Size: The existing sanctuary and annex contain 8912 sq. ft. The church is proposing to construct a 725 sq. ft. addition to the sanctuary which will be used for offices; a 3,778 sq. ft. two-story addition will be added to the churCh annex and will front on First Avenue. This building will be used for a children's nursery and Sunday School room~. The exterior of the two story building along First Avenue will be brick veneer to match the existing church. A duplex and driveway will be removed in order to construct this addition. The proposed two-story building will set back 24'9" from the First Avenue property line. (This is the same setback as the church sancturay). 81 parking spaces exist on the site. There will be two driveway exits; one on Forest Avenue and one on First Avenue. ANALYSIS A church is a permitted use in a R-2 zone with a Conditional Use Permit. Presently, the church is utilizing the duplex for class- rooms. Church attendance will not increase with the construction of the new additions. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substan- tial or potentially substantial adverse change in any of the phy- sical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. Before the Planning Commission and City Council take action on this proj ect, ,the Commission and Council should "move to approve and file the Negative Declaration and find that the Droiect will not have a si,gnif:Lcant effect on the environment." . . -2- . . . " RECOMlllENDATIONS 1. Conditions as outlined in the attached report from the Depart- ment of Public Works shall be complied with to the satisfaction of the Director of Public Works. 2.
