RESOLUTION NO. 1104 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CON- DITIONAL USE PERMIT FOR A CHURCH AND EXPANSION OF THE CHURCH PARKING LOT AT 400 WEST DUARTE ROAD WHEREAS, on June 13, 1979, Daniel A. Munns on behalf of the Church of the Good Shepherd, filed an application for a church, expansion of the church parking lot and expansion of the pastor's dwelling, Planning Department Case No. C.U.P. 79-10 on property commonly known as 400 W. Duarte Road, more particularly described as follows: . Portion of Lot 1, Tract 4090 in the City of Arcadia, County of Los Angeles, State of California, as per Map Book 43, Page 47. WHEREAS, a public hearing was held on July 10, 1979 at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Planning Department in the attached report is true and correct. SECTION 2. This Commission finds that: 1. The granting of conditional use permit as hereinafter provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. '2. The use applied for at the location indicated is tIJ' properly one for which a conditional use permit is authorized. -1- . . . , , 3. The site for the proposed use is adequate in size and shape to accommodate said use including all yards, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the General Plan. 6. The use applied for will not have a substantial adverse impact on the environment. 7. The proposed use complies with all requirements set forth for the issuance of a conditional use permit. 8. The proposed use will not substantially increase vehicular traffic on any street in a residentially zoned district. 9. The proposed use will not lessen the suitability of any nearby commercially zoned property for commercial use by interfering with pedestrian traffic. 10. The proposed use will not create increased traffic hazards to pedestrians when located near a school, church, auditorium, theater or other place of assembly. SECTION 3. That for the fOfegoing reasons, subject to approval of the City Council, this Commi~s~on grants a conditional use permit for a church, expansion o,~ the parking lot, and expansion of the pastor's dwelling upon the following conditions: -2- . 1. The property shall be improved and maintained in accordance with the plans which are on file in the Subject Case C.U.P. 79-10 and applicable regulations of the Arcadia Municipal Code. 2. Dedicate a 15 feet radius corner cutoff at the south- west corner of Duarte Road and Holly Avenue. 3. Close existing driveway aprons not to be used on Duarte Road. 4. Submit grading and drainage plan for approval of the Director of Public Works. 5. A modification is granted to allow a 42" high decorative brick wall and a 42" high decorative identification sign within the special setback along Duarte Road. Said location to be approved 4It by the Planning Department. 6. A modification is granted to delete the wheel stops in the interior of the parking lot. 7. A modification is granted to delete the requirement of a 6' high block wall along the southerly and westerly property lines. 8. A modification is granted to delete the requirement of a 5' wide landscape buffer along the south property line for a distance of 45'. 9. That a landscape and irrigation plan be submitted to the Planning Department for its review and approval prior to restriping the lot. , ; I ~ -3- . . . 10. That the existing planting buffers along the southerly and westerly property lines be cleared of all dead vegetation and debris and be maintained in a neat and orderly manner. 11. That the property south of the main church buildings be cleaned up and maintained in a neat and orderly manner. 12. Light standards shall not exceed 15' in height. 13. Wheel stops shall be provided for (1) the parking stalls located along the westerly property line (2) the easterly parking stalls located adjacent to the dwellings and (3) the northerly parking stalls fronting Duarte Road. 14. That a plot plan showing the location of the future carport for the Pastor's house shall be submitted to the Planning Department for its review and approval. 15. That a trash enclosure shall be provided in a location approved by the Planning Department. 16. The parking area shall be resurfaced and the parking spaces comply with Code. 17. C.U.P. 79-10 shall not take effect until the owner and applicant have executed a form available at the Planning Department indicating awareness and acceptance of the conditions of approval. SECTION 4. The secretary shall certify to the adoption of this resolution. DUARTE ROAD CONDITIONAL USE PERMIT FOR: 1) Existing church, which is presently a legal non-conforming use; 2) Expansion of the church parking lot; and 3) Expansion of the Pastor's house THE SUBJECT SITE IS PRESENTLY DEVELOPED WITH THE GOOD SHEPHERD CHURCH, RELATED CHURCH BUILDINGS, PARKING, HOUSES AND ACCESSORY BUILDINGS: AND ZONED R-3. Approximately 227~156 sq. ft. (5.21 acres) 441 feet on Duarte Road; 550 feet on Holly Avenue North: South: East : West : Multiple-Family Residential, Zoned R-3 Single-Family Dwellings; Zoned R-l Holly Avenue Elementary School. Zoned R-l Apartments, Zoned R-3 Multiple-Family Residential (7+ du/ac). MODIFICATIONS REQUESTED , The applicant is requesting the following modifications: 1. Modification to allow the installation of a 42"+ high decorative brick wall and a 42"+ high decorative identi- fication sign panel within the special setbacks along Duarte Road (9320,15.14 and 9320.15.15) -1- . 2. Waiver of the requirement for wheel stops in the interior parking stalls (9269.9.A) 3. Waiver of the requirement for a 6' high block wall around the parking area (9269.l3.A); presently there is an existing block wall and chain link fence along the property line. 4. Waiver of the requirement of a 5' wide landscape buffer along the south property line for a distance of 45' (9269.13). SPECIAL INFORMATION BUILDING No additions or alterations are being proposed to the church build- ings other than a covered walk and porte-cochere at the entrance to the sanctuary building. The Pastor's house, located south of the church, will be expanded. The existing attached garage will be converted to a family room and a new carport will be constructed north of the dwelling. This property south of the church, which contains several houses, is overgrown with weeds and should be cleaned up. . PARKING The church is proposing to remove three dwellings located west of the church and another structure south of the church in order to expand and redesign the parking area, to produce a total of 237 spaces. All the parking spaces meet code requirements. The applicant is requesting to delete the wheel stops in the interior of the parking lot. This area is used for the church festival which is held once a year. The existing parking area is in poor condition and should be resurfaced as part of the overall improvements. There is an existing 5' wide landscape buffer along the westerly and southerly property lines adjoining the parking area. The plant- ing in this area exceeds 6' in height, however, it is overgrown and should be cleaned up. A wall with a 6' high chain link fence is located along the westerly property line. A 6' high chain link fence is located along the southerly property line. A 17' to 27' landscape buffer is proposed between the parking area and Duarte Road. A 42" high brick wall will be located in this area. MISCELLANEOUS INFORMATION There is no trash enclosure on ,the site. The applicant is propos- ing lighting in the parking area. ANALYSIS . A church is a permitted use in a R-3 zone with an approved Conditional Use Permit. -2- . . . ". It is staff's opinion that the requested modifications would provide for an appropriate improvement of the site. Pursuant to the provisions of the California Environmental Quality Act. the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substan- tial or potentially substantial adverse change in any of the phy- sical conditions within the area affected by the project including land, air. water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. Before the Planning Commission takes action on this project, the Commission should "move to approve and file the Negative Declara- tion and find that the project will not have a significant effect on the environment." RECOMMENDATION The Planning Department recommends approval of C.D.P. 79-10 subject to the following conditions: 1. Conditions as outlined in the attached report from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works. 2. A modification is granted to allow a 42" high decorative brick wall and a 42" high decorative identification sign within the special setback along Duarte Road. Said loca- tion to be approved by the Planning Department. 3. A modification is granted to delete the wheel stops in the interior of the parking lot. 4. A modification is granted to delete the requirement of a 6' high block wall along the southerly and westerly property lines. 5.
