RESOLUTION NO. 1101
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARCADIA RECOMMENDING DENIAL OF
TEXT AMENDMENT 79-2 ADDING A HOME OCCUPATION
ORDINANCE TO THE ARCADIA MUNICIPAL CODE.
WHEREAS, a text amendment was initiated by the City for
the consideration of adding a home occupation ordinance to the
Arcadia Municipal Code;
WHEREAS, public hearings were held on January 23, 1979,
February 27, 1979, April 24, 1979 and May 8, 1979, at which time
all interested persons were given full opportunity to be heard
and to present evidence;
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION
~ OF THE CITY OF ARCADIA AS FOLLOWS:
SECTION 1. That the factual data submitted by the Plan-
ning Department in the attached report is true and correct.
SECTION 2. This Commission finds that the proposed text
amendment would be unenforceable as written, that the residential
properties should be used for residential purposes only and that
business activities should be conducted in commercial and industrial
zones only.
SECTION 3. For the foregoing reasons, the Planning Com-
mission recommends to the City Council denial of T.A. 79-2.
SECTION 4. The Secretary shall certify to the adoption
of this resolution.

T.A. 79-2 proposing the addition of a "Home Occupation" ordin-
ance to the Arcadia Municipal Code was continued from the Plann-
ing Commission's February 27. 1979 meeting.
Attached are changes recommended by the City Attorney which modify
certain sections of the proposed ordinance and add one new section.
(See Addendum A).

Staff has also received a letter from the Arcadia Board of Realtors
in opposition to the text amendment.
Attached for your consideration is Addendum "A", the staff report
and the Arcadia Board of Realtors letter.

ADDENDUM "A"
Sections to be modified (Additions underlined):
9285.3. PREREQUISITE CONDITIONS. A home occupation shall
be subordinate to the principal use of a building as a dwelling.
No permit for a home occupation shall be issued for a home occupa-
tion that will violate any of the following subsections which
shall be conditions of permit approval.
9285.3.2. SAME. EQUIPMENT AND MACHINERY. No person shall
use any mechanical, electrical equipment, or stock material other
than that customarily found in the home associated with a hobby
or avocation not conducted for gain or profit, providing that
such machinery, equipment, or stock material does not generate,
emit or create noise, dust, vibration, odor, smoke, glare, elec-
trical interference, fire hazard or any other hazard or nuisance
to any greater or more frequent extent than normally experienced
in residential neighborhoods. No machinery or equipment shall
cause noises or other interference in radio or television recep-
tion.
9285.3.9. SAME. ALTERATION OF DWELLING. No person shall
dis lay or create outside the buildin an external evidence of
operation 0 a home occupatlon. No person shall alter t e appear-
ance of any structure on property or conduct a home occupation on
the property in a manner that causes a change in the residential
character of property or that of the surrounding neighborhood for
the purpose of conducting a home occupation (including but not
limited to color, materials or construction, lighting, signs,
sounds or voices, vibrations).
The following section should be added:
9285.3.13. SAME. DISPLAY OF PRODUCTS. No display of pro-
ducts shall be visible from the street.
Change recommended by Planning Department staff:
9285.4.1.14. SAME. SAME. PROFESSIONAL OFFICES specified
in Section 9261.1.2 excluding medical and clinical laboratories

REQUEST:
Text amendment adding a Home Occupation Ordinance
to the Arcadia Municipal Code.
PROPOSAL
The City is proposing a text amendment to allow certain home
occupations and home businesses in residential zones.
Presently there are many persons in the City that are conducting
occupations in their home which are not legally permitted by code.
Because these uses are not permitted, the City does not have the
authority to license these uses. A rough guesstimate is that there
could be as many as 1,000 persons conducting home occupations
within their residence.
In order to make these uses legal and in order to allow the
conducting of certain types of businesses within the City, the
Planning Department, at the request of the City Manager, has
initiated this text amendment.
The following is a brief summary of the ordinance:
9285.1. PURPOSE.
Outlines the purpose of this new ordinance which is to permit
the conducting of certain types of home occupations in residential
zones.

9285.2. APPROVAL.
Indicates that no person shall engage in a business without
an approved and unrevoked or unsuspended home occupation permit.
Also denotes that no home occupation permit shall be issued for
a property on which there exists a violation of the Arcadia
Municipal Code. Each application must be approved by the Planning
Department and Fire Department.
9285.3. PREREQUISITE CONDITIONS.
This section establishes prerequisite conditions for conducting
a home occupation and business (noted below).
9285.3.1. SAME. EMPLOYMENT.
Limits employment to members of the household occupying the dwelling.
9285.3.2. SAME. EQUIPMENT AND MACHINERY.

Limits the type of equipment, machinery and material to that
customarily found in the home associated with a hobby or
avocation not conducted for gain or profit. Requires that

No contact with the public on the property except by mail or
telephone (except as stated in "permitted uses").
9285.3.5. SAME. TRAFFIC.
No person shall conduct a home occupation that generates
pedestrian or vehicular traffic.
9285.3.6. SAME. PICKUP AND DELIVERY.
Restricts delivery to or from the premises by any vehicles
other than in noncommercial vehicles by the proprietor or
resident help of the home occupation.

9285.3.7. SAME. FLOOR AREA.
No more than 200 square feet of the main dwelling may be employed
for a home occupation. No required parking or open ground space
may be used for the home occupation or storage of equipment and
supplies. '

9285.3.8. SAME. ADVERTISING.
No commercial advertising or identifying signs shall be allowed
on the property.
9285.3.9. SAME. ALTERATION OF DWELLING.
The appearance of any structure on the property may not be
altered or no person shall conduct a home occupation in a manner
that causes a change in the residential character of the property
or that of the surrounding neighborhood.
9285.3.10. SAME. UTILITIES.
No utilities or community facilities beyond that normal to the
use of the property for residential purposes may be allowed.
9285.3.11. SAME. INSPECTION.
Stipulates that no person with a permit shall refuse to allow
an inspection of the property by the Fire Department or Plan-
ning Department.
. 9285.3.12. SAME. CONDITIONS OF PERMIT APPROVAL.
This permits the Planning Department and Fire Department to
approve a home occupation permit subject to any additional
conditions that either may deem necessary to carry out the
purpose and intent of the Arcadia Municipal Code.
9285.4. PERMITTED USES.
This section spells out the types of uses permitted in the
zones indicated. (See attached matrix)
9285.5. REVOCATION AND SUSPENSION.
This gives the Planning Commission authority to revoke or suspend
any home"occupation permit after a public hearing upon at least
10 days', written notice to the permittee upon the finding that
there is probable cause that the permittee has committed a
violation of any law or a condition of the permit.
FEES
The Planning Department is recommending a Home Occupation Permit
Fee of $25. This fee should be established by resolution of the
City Council.

The $25 fee will not adequately cover the initial start-up cost
of this new permit. This cost will be relatively high because
it will require computer programming by the Business License staff,
home inspections by either the City Planning Department or Fire

Department and insurmountable paperwork in processing the applications.
Once the system is set up, the annual cost of processing these
permits will be relatively low.
In addition to the Home Occupation Permit, a Business License
will be required for those uses being conducted as a business.
ANALYSIS
This proposed ordinance will establish guidelines and regulations
for home occupations and set specific limitations on the types
of uses which will be allowed.
Planning Department staff and the City Attorney have thoroughly
reviewed this ordinance and feel that it is restrictive enough
to ensure that the residential character of a neighborhood will
not be altered by the implementation of this division.

Pursuant to the provisions of the California Environmental
Quality Act, the Planning Department has prepared an initial study
for the proposed project. Said initial study did not disclose
any substantial or potentially substantial adverse change in any
of the physical conditions within the area affected by the project
including land, air, water, minerals, flora, fauna, ambient noise,
and objects of historical or aesthetic significance. Therefore,
a Negative Declaration has been prepared for this project.
Before the Planning Commission and City Council take action on
this project, the Commission and Council should "move to approve
and file the Negative Declaration and find that the project will
not have a significant effect on the environment."
RECOMMENDATION
The Planning Department recommends approval of T.A. 79-2, adding
Division 5, Part 8, Chapter 2 of Article IX, entitled "Home
Occupations".' The Planning Department also recommends that a fee
of ,$25 be established for a Home Occupation Permit.

should direct staff. to prepare a resolution for adoption at its
'next' meeting. The Planning Commission's action shall not be
final untii adoption of the resolution. The appeal period for
this action commences at the time the Commission adopts the resolution.

GENERAL PROVISIONS
HOME OCCUPATIONS IN RESIDENTIAL ZONES
9285.1. PURPOSE. The purpose of this Division is to permit
the conducting of certain types of home occupations as specified in
this Division in residential zones.
9285.2. APPROVAL. No person shall engage in business or trans-
act and carryon any business, trade, profession, calling or
occ~pation on any property zoned for residenttalpurposes without an
approved and unrevoked or unsuspended home occupation permit. No
home occupation permit shall be issued for a property on which
there exists a violation of the Arcadia Municipal Code. Each appli-
cation for a home occupation permit must be approved by the Planning
. Department and Fire Department. Before accepting an application for
a home occupation permit, the City shall charge and collect a fee
which shall be paid in an amount established by resolution of the
Ci ty Council.
9285.3. PREREQUISITE CONDITIONS. No permit for a home occupa-
tion shall be issued for a home occupation that will violate any
of the following subsections which shall be conditions of permit

tact with the pUblic on the property except by mail or telephone
(except as stated in "Permitted Uses").
9285.3.5. SAME. TRAFFIC. No person shall conduct a home
'occupation that generates pedestrian or vehicular traffic.
9285.3.6. SAME. PICK UP AND DELIVERY. No person shall make
any delivery to or from the property by commercial vehicles,
cars, vans or station wagons. A resident of the property for
which a permit is issued hereunder may make deliveries to or from
the property by noncommercial vehicles.
9285.3.7. SAME. FLOOR AREA. No person shall use more than
two hundred (200) square feet (18.58 square meters) in the main
, dwelling for the home, occupation. No person shall use any parking
space required by this Article or open ground space for home
occup!ltion purposes or for storage of equipment, supplies or
products, except in the vehicle used for the home occupation.
9285.3.8. SAME. ADVERTISING. No person shall place, allow
or cause to be placed commercial advertising or identifying signs
on the property.

Re: T.A. 79-2 Proposed Amendment Allowing Home Occupations
in Residential-Zones
Honorable Planning Commission:

The Arcadia Board of Realtors has always bee~ opposed to a
licensed Real Estate Broker being allowed to operate in any
zone other than a commercially zoned area. Article II,
Sec. 3 (B) of our by-laws pro'"ides that "such applicant
(for membership) shall be so engaged in an o:fice within the
jurisdictional boundaries of this Board and ~eeting the re-
quirements of all local ordinances and zoning regulations."
We have required that all applicants produce a copy of their
City business license prior to granti~g membership in the
Board and we have relied on the City requiri~g that the
Brokers office be located in a proper business zone.
Recently the City has been issuing business licenses to
Real Estate Brokers in other than business zones which has
caused the Board great concern. We feel that this practice
does not coincide with the professional image that the Board
has been trying to maintain of its membership and for the
image of the city.

We request that when considering this text amendment you give
consideration to our concerns as expressed above and would
recommend that:
1. A Real Estate Broker be specifically required to maintain
an office in a business zone in order to receive a City
business license
2. Allowing business, of any type, in a residential zone could
have a harmful effect on surrounding property values.
