A RESOLUTION OF THE PLANNING CO~WISSION OF THE CITY OF ARCADIA MAKING FINDINGS OF FACT AND DENYING AN APPEAL OF THE MODIFICATION COMMITTEE'S APPROVAL OF MODIFICATION M-79-3 ALLOWING A FENCE TO REMAIN ON THE STREET SIDE OF,A CORNER LOT AT 740 WEST LEUON AVENUE WHEREAS, on March 13, 1979, an appeal of the Modification Com- mittee's approval of Modification M-79-3 was filed by Elizabeth R. Tesiris allowing a fence to remain on the street side of a corner lot at 740 West Lemon Avenue, more particularly described as follows: Lot 1 of Block H of the Santa Anita Land Company Tract as recorded in Map Book 6 Page 137. WHEREAS, the public hearing was held on March 13, 1979, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Section 1. That the factual data submitted by the Planning De- partment in the attached report is true and correct. Section 2. That we hereby make the fOllowing findings of fact: 1, That the setbacks of the fence provide adequate viSibility for safe egress from the driveway at 1810 South Rowland Avenue. ,2.cThat the fence would not be detrimental to the public heal th and>welfare, and injurious to the property or improvements in its zone or vicinity. ..,.-,:,3.'. LORTZ ASSISTANT PLANNER This is an appeal to the Planning Commission from a decision of the Modification Committee approving a modification to allow a recently constructed six-foot high wood fence to remain five feet from the street side property line of a corner lot in lieu of a four-foot high openwork fence allowed. (9283.8.7) This appeal was filed by Elizabeth R. Tesins, 1810 South Rowland, the owner of the property immediately south of the subject site. A copy of Ms. Tesins letter of appeal is attached. GENERAL INFORMATION APPLICANT : John Wilkes LOCATION: 740 West Lemon Avenue EXISTING ZONING: R-l EXISTING LAND USE: Two single-family dwellings SIZE: Approximately 10,600 sq. ft. SURROUNDING LAND USE AND ZONING: Properties are developed with single-family dwellings and zoned R-l. GENERAL PLAN: Single-Family 0-6 dwelfing units per acre . There is no curb, gutter, sidewalk or parkway along this private street. Eight properties use Rowland for ingress and egress to their properties. Staff conducted a study of the visibility of ingress and egress to the property at 1810 South Rowland. Using a Ford LTD, staff found that there was adequate visibility for the driveway at 1810 South Rowland to the north when ~he back of the car was at the property line (not in the street). There was no problem with visibility to the south. FINDINGS To approve this modification application, the Planning Commission must find that the request would secure an appropriate improvement, or prevent an unreasonable hardship, or promote uniformity of development. SUBJECT: 1810 ,Referencing your recent inquiry, pursuant to Arcadia Municipal Code Section 9283.8.8, 6ft. fences may not extend into the side yard required along the side street on a corner lot, however, Arcadia Municipal Code Section 9283.8.7. allows openwork fences in the side yard required along the side street on a corner lot if not more than 4 ft, in height. SUbject property is zone R-l.The R-l regulations, specifically Arcadia Municipal Code Section 9252.2.5, requires a side yard on the street side of a corner lot of 10% of the lot width, but not less than 10 ft.. Rowland Avenue is the street side of 740 W. Lemon (Arcadia Municipal Code Section 9220.,59). The term "street" includes both public and private streets, such as Rpwland Avenue (Arcadia Municipal Code Section 9220:57). . The City Code prohibits any obstacles whatsoever in the street, parkway or sidewalk, (Arcadia Municipal Code Section 7230), The property owner at 740 West Lemon should, therefore, be noticed to remove or reconstruct the fence in accordance with the afore- described sections. It has recently been no~ed that a fence has been constructed adjacent to your west property line which may be in violation of Arcadia Municipal Code Section 9252.2.5 that requires a street side setback on a' corner lot for u fence of 10% of the lot width, but not lcss than 10 feet. I feel that the City of Arcadia has been negligent in setting up city codes for private streets because I corresponded with the City Attorney and the Planning Department way back in 1977 regarding the need for same. It would appear that according to Proposition l3. the city fathers have indeed procrastinated in the establishment of procedures and in the interpretation of the city codes. As a result. no restraining order was issued to ~~. Wilkes pend- ing an investigation and the outcome was Mr. Wilkes' illegal fence height and obstruction to my front yard. As a result of this procrastination. I have suffered much abuse in time and expense. At the inception of r~. Wilkes' intended fence. scraggly bushes with strong roots separated our properties. Mr. Wilkes obviously wished to be spared the expense and labor of remov- ing the bushes and set his own line of demarcation for his fence. leaving the debris for me to remove at an expe,nse of$lOO for the removal of the weeds and $240 to asphalt the gap. Mr. Wilkes did not ,compensate me for this expense; yet one member of the r10dification 'Committee insinuated before the hearing officer that I had been at fault. I warned r~. Wilkes that he was building his fence against ',', city codes 'and gave ,him a copy of code regulations. but he insisted hecould,do,anything'he wanted. , By an appeal to the Arcadia City Council. said Council determined in the latter part of 1978. as confirmed by Mr. Woolard's letter of December 11. 1978. that the city codes apply to private streets as well as nonprivate streets. " .. , f , 'Arcadia Planning Committee : Mr. Wilkes was allowed to appeal for a modification of the rules, .:'which he did in an ambiguous manner. vleb ster defines modification , as a change or moderation; Mr. Wilkes did not ask for a change or 'moderation of the illegal fence height, but a right to retain said : illegal fence height; in fact his illegal fence height exceeds six, , feet in several areas. 'During the Public Hearing on January 9>>' 1979, two members of the Modification Committee openly supported Mr. Wilkes' request for retainment of the illegal fence height by presenting false and misleading arguments on his behalf to. the hearing officer. One such misleading argument was that the fence is five feet from the street, whereas the fence at my front yard is onlY four feet from the redwood strip of the street; further that a survey of a possible safety hazard had been made from my drive- way. This is false in that I was at home at the time the survey was made and there was a plumbing truck in my driveway and no such survey was conducted. Further, the hearing officer did not appear to be familiar with Sections 9283.8.7, 9283.8.8 and 9283.5.l of the Arcadia City Code. I submit, therefore, that the City of Arcadia and Mr. Wilkes are legally liable for any accidents occurring at the site of the safety hazard because the City of Arcadia and the City Attorney have abused their discretion as to what constitutes a safety hazard. It is also my opinion that the l~odification Committee is a pUblic body supported by tax money, that I am a member of the tax paying public and that no objectivity was shown by any member of the Modification Committee in its decision; that support of Mr. Wilkes was obvious from the inception of the hearing and that such lack of objectivity should indeed be the subject to further discussion with an objective third party. I request in view of the above facts that a fair and just decision , now be :made by this Planning Committee and that Mr. Wilkes be re- .' ,quested to comply immediately to city codes as regards to his 'illegal fence height and encroachment in my front yard, and that 11r.. Wilkes be advised that all bushes and hedges obstructing view , , are, ,also part of- such compliance. It should be noted also that ,,:,"shouldl1r.
