RESOLUTION NO. 1085
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARCADIA RECOMMENDING APPROVAL
OF A ZONE CHANGE FROM C-O D TO R-l FOR THE
PROPERTY AT 2633 LOUISE AVENUE.
WHEREAS, the Planning Commission of the City of Arcadia
held a public hearing on January 23, 1979, for the purpose of
considering changing the zone from c-o D to R-l P (parking Overlay)
for the property located at 2633 Louise Avenue, more particularly
described as follows:
Lot 9 of Tract 11430 as shown on map recorded in Book 234,
page 22 of Maps, Records of said County.
WHEREAS, all interested persons were given full opportunity
to be heard and to present evidence;
NOW, THEREFORE, BE IT RESOLVED THAT THE PLANNING COMMISSION
MAKES THE FOLLOWING RECOMMENDATION AND FINDS AS FOLLOWS:
SECTION 1. That the factual data submitted by the Plan-
ning Department in the attached staff report is true and correct.
SECTION 2. That the Planning Commission in its consideration
determined that the Parking Overlay which would allow the property
to be developed as a parking lot should be deleted. It was the
Commission's opinion that a parking lot on this site could create
additional traffic on Louise which would be detrimental to the
adjacent residential properties.
SECTION 3. The Planning Commission recommends to the City
Council a zone change from c-o D to R-l (Second One-Family) for the
property at 2633 Louise Avenue.
SECTION 4. That the Planning Commission finds that the
proposed zone change would be consistent with the General Plan,
would eliminate the possibility of an interior commercial lot

fronting on Louise Avenue, would eliminate a nonconforming use, and
that the public convenience, necessary and welfare justify the
proposed zone change.
SECTION 5. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.
I HEREBY CERTIFY that the foregoing resolution was
adopted at a regular meeting of the Planning Commission of the
City of Arcadia held on the 13th day of February 1979, by the
following vote:

The first 100 feet of lot depth is developed with
a single-family dwelling and the rear 100 feet is
developed with a parking lot. The entire site is
zoned C-O D.

The General Plan Land Use Map was prepared with the
intent that development with Live Oak frontage be
designated as commercial and that development with-
out Live Oak frontage be designated as Single
Family Residential (0-7 du/acre).

HISTORY
On August 7, 1962, the City Council adopted Ordinance 1181 reclassi-
fying this property from R-2 to C-O D. One of the conditions of
this zone change was that the property at 2633 Louise and 2637
Louise Avenue be developed as one building site. 2637 Louise is
located at the northwest corner of Louise Avenue and Live Oak Avenue.
In 1967, the Planning Commission received a request (M-67-26) to
develop part of Lot 9 of Tract 11438 (2633 Louise) as a parkins
lot in lieu of developing this lot and 2637 Louise as one commercial
building site. The Planning Commission at the time approved this
request with a stipulation that its approval was for a three-year
period. The Commission noted that "there was difficulty in having
the two properties developed as a unit and this may be a move to
expedite the development".
The parking lot still exists.

On March 1, 1978, Robert Metz filed an application for a modification
to construct an office building at 2637 Louise. Several modifications
were required including a request for waiver of the requirement
that this lot and the lot at 2633 Louise (subject property) be
developed as one. The Planning Commission at its March 28 meeting
denied the modification. The Planning Commission was concerned
that the development of this lot would create a commercial lot
(2637 Louise) fronting on a residential street. The Planning
Commission in its resolution directed staff to initiate a zone change
from commercial to residential for the property at 2637 Louise.
The applicant appealed the Planning Commission's decision to the
City Council. The Council upheld all recommendations of the
Planning Department including the recommendation that a zone change
be initiated on the property at 2637 Louise.
PROPOSAL FOR ZONE CHANGE
The parking lot on the rear of this property is presently leased
to the Pie King Restaurant.
The house and garage on the front of the lot were built in 1941.
The house has recently been painted and reroofed and is occupied.
The proposed zone change will make the existing house and parking
lot permitted uses. This zone change would allow improvements and
additions to the house if they met code requirements, Presently,
the only improvements allowed are those providing upkeep maintenance
on t he house.
. The Parking Overlay would allow the entire lot to be developed as
parking. If the entire lot were developed with parking, one concern
might be the effect a driveway opening and the resulting traffic
might have on the residential properties on Louise Avenue.

The zone change to R-l P would create more stringent commercial
development requirements for the property to the south at 2637
Louise Avenue in regard to building setbacks, building height and
landscape buffers. Although development of the properties at
2633 and 2637 Louise as one site might possibly provide a more
desirable development, since the inclusion of these properties in
the design overlay in 1962, neither of the owners of the property
have been able to combine the two properties for a commercial
development.
ANALYSIS
Approval of this ,zone change would eliminate the possibility of
an interior commercial lot fronting on Louise Avenue; would
provide flexibility in the lot usage; and would create two legal
uses on the lot, the parking lot and the house.
Pursuant to the provisions of the California Environmental
Quality Act, the Planning Department has prepared an initial study
for the proposed project. Said initial study did not disclose
any' substantial or potentially substantial adverse change in any
of the physical conditions within the area affected by the project
i~cluding land, air, water, minerals, flora, fauna, ambient noise,
and objects of historical or aesthetic significance. Therefore,
a Negative Declaration has been prepared for this project.
Before the Planning Commission and City Council take action on
this project, the Commission and Council should "move to approve
and file the Negative Declaration and find that the project will
not have a significant effect on the environment."
RECOMMENDATIONS
The Planning Department recommends approval of zone change Z-79-2
from C-O D to R-l P (Parking Overlay).
After taking action on this application, the Planning Commission
should direct staff to prepare a resolution for adoption at its
next meeting. The Planning Commission's action shall not be final
until adoption of this resolution. The appeal period for this action
commences at the time the Commission adopts the resolution.

We agree with the proposed zone change to R-l, but we are opposed to the R-l P
stipulation. We are concerned that at a later date this property can be used
as a parking lot with access onto Louise Avenue, a quiet residential street, and
create more traffic and congestion than already exists.
An example of this situation does now exist across the street from this location
at the Cal Hornia Federal Savings & Loan. It was planned and built \~ithout
access onto Louise Avenue. At a later date, they were granted an access onto
Louise Avenue adjacent to residential property, This has caused additional
traffic and a hazard to pedestrians.
With this in mind, we the undersigned respectfully request that the zoning change
be limited to R-l.

We regret that some of the property owners are unable to attend
the hearing covering the subject property due to prior committments
and out-of-town reservations as this is Arcadia School District's
Spring vacation.
However, we respectfully request that the City Council accept the
Planning Commission's recommendation that the proposed zone change
be made to R-l only without the Up" stipulation for parking overlay.
As mentioned in our letter to the Planning Commission dated
January 23, 1979, we are concerned that this property may be used
at a later date as a parking lot with access onto Louise Avenue.
