RESOLUTION NO. 1001
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARCADIA GRANTING A CONDITIONAL
USE PERMIT FOR THE EXPANSION OF AN EXISTING
EATING ESTABLISHMENT AT 1212 SOUTH BALDWIN
AVENUE.
WHEREAS, on July 6, 1977, an application was filed by
Anthony's Italian Gourmet to expand an existing eating establish-
ment, Planning Department Case No. C.U.P. 77-15, on property
commonly known as 1212 South Baldwin Avenue, more particularly
described as follows:
Northerly 56 feet of Lot 2, Tract 5659 in the City
of Arcadia, County of Los Angeles, as recorded in
Map Book 115, page 100, in the records of the
office of the Recorder of said County.
WHEREAS, a public hearing was held on said matter on
July 26, 1977 at which time all interested persons were given
full opportunity to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Plan-
ning Department in the attached staff report is true and correct.
SECTION 2. This Commission finds that:
1. The granting of a conditional use permit as herein-
after provided will not be detrimental to the public health or
welfare or injurious to the property or improvements in such zone
or vicinity.
2. The use applied for at the location indicated is
properly one for which a conditional use permit is authorized.

3. The site for the proposed use is adequate in size
and shape to accommodate said use, including all yards, parking,
loading, landscaping and other features required to adjust said
use with the land and uses in the neighborhood.
4. The site abuts streets and highways adequate in
width and pavement type to carry the kind of traffic generated by
the proposed use.
5. The granting of such conditional use permit will not
adversely affect the General Plan.
6. The use applied for will not have a substantial
adverse impact on the environment.
SECTION 3. That for the foregoing reasons, subject to
approval of the City Council, this Commission grants a conditional
use permit to expand an existing eating establishment upon the
following conditions:
1. The property shall be improved and maintained in
accordance with plans on file in C.U.P. 77-15.
2. All restroom facilities shall comply with the
Uniform Plumbing Code.
3. A modification shall be granted for 16 parking spaces
in lieu of 68 spaces required.
4. The proposed two-foot landscape buffer adjacent to
the dining area shall be expanded to six feet and allow for a
39-inch automobile overhang.
SECTION 4. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.

History

The delicatessen has operated since August 15, 1973. On
January 21, 1975 the applicant was granted a conditional use
permit to operate a delicatessen and outdoor eating estab-
lishment.

Existing Facility
The present facility contains approximately 2,480 square
feet of enclosed floor area and the outdoor eating area
contains approximately 400 square feet which accommodates
nearly twenty patrons. Inside the establishment there
are additional tables for six patrons. There is presently
one restroom within the building which is used by employees.
Proposed Facility
The applicant is requesting to enlarge and enclose an out-
side eating patio and to construct two restrooms for patrons.
The proposed dining room will contain approximately 785
square feet. The restrooms will contain approximately 132
square feet, 66 square feet of which will be used for a
vestibule and storage.
Parking:
The applicant is proposing to install four parking spaces to
the rear of the proposed dining area.

The delicatessen and other businesses along the east side of
Baldwin Avenue are presently served by a large parking area
consisting of 191 spaces located to the rear of said
businesses. Anthony's Delicatessen is allocated by lease
agreement, 12 parking spaces for customers in this parking
area.
Said parking lot does not meet the three percent landscaping
required by code.
According to the Arcadia Municipal Code the proposed eating
establishment is required to have 68 parking spaces.
ANALYSIS
Although the parking situation in the area is not ideal,
neither is it critical and the proposed use is not expected
to substantially alter the current situation.
It is the Planning Department's opinion that the proposed
eating establishment is an appropriate development of the
property.

Pursuant to the prov1s1ons of the California Environmental
Quality Act, the Planning Department has prepared an initial
study for the proposed project. Said initial study did not
disclose any substantial or potentially substantial adverse

change in any of the physical conditions within the area
affected by the project including land, air, water, minerals,
flora, fauna, ambient noise, and objects of historical or
aesthetic significance. Therefore, a Negative Declaration
has been prepared for this project.
Before the Planning Commission takes action on this conditional
use permit, the Commission should "move to approve and file
the Negative Declaration and find that the project will not
have a significant effect on the environment."
RECOMMENDATION
The Planning Department recommends approval of C.U.P. 77-5
subject to the following conditions:
1. All restroom facilities are to comply with the Uniform
Plumbing Code.
2. A modification shall be granted for 16 parking spaces
in lieu of 68 spaces required.
