HomeMy WebLinkAbout0998 . . .. -~ RESOLUTION NO. 998 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A ZONE VARIANCE TO PERMIT TWO RESIDENTIAL LOTS WITH DEPTHS OF 85 FEET AND 92 FEET IN LIEU OF 100 FEET AT 1212-1218 SOUTH FIRST AVENUE, WHEREAS, on June 20, 1977, an application was filed by Bade and Olson Co., Inc" for a 7-1ot subdivision and variance to permit substandard lot depths of 85 feet and 92 feet in lieu of 100 feet required for two lots located at 1212-1218 South First Avenue, more particularly described as follows: Portion of Lot 8. Tract 808, in the City of Arcadia, County of Los Angeles, as per map recorded in Book l6, pages 82 and 83, of Maps in the office of the Recorder of said County. WHEREAS, a public hearing was held on said matter on July 12, 1977, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: Planning SECTION 1. ro; Department in the attached staff report is true and That the factual data submitted by the correct. SECTION 2. This Commission finds that: 1. There are exceptional or extraordinary circumstances or conditions applicable to the property involved, or to the intended use of the property, that do not apply generally to the property or class of use in the same zone or vicinity. 2. The granting of such variance will not be materially -1- 998 . . .. detrimental to the pUblic health or welfare or injurious to the property or improvements in such zone or. vicinity in which the property is located, 3. That such variance is necessary for the preservation and enjoyment of a substantial property right of the applicant possessed by other property in the same zone and vicinity, 4. That the granting of such variance will not adversely affect the comprehensive general plan. SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a zone variance for two residential lots with depths of 85 feet and 92 feet in lieu of 100 feet upon the following condition: 1. That all conditions of Tentative Tract 33732 be complied with. SECTION 4, The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. -2- 998 . . .. Tentative Tract 33724 Variance V-77-2 2 ANALYSIS A cul-de-sac street is proposed for the subject site which would extend approximately 200 feet east from First Avenue and provide for a 5-foot planting easement. Proposed Lots 1 through 6 would front on the new street. The existing residence and garage on Lot 7 would remain in their present location and continue to front onto First Avenue, The existing house at 1218 First Avenue (Lot 7) was built in 1959, Staff recommends that the driveway entrance for proposed Lot 7 should open onto the new stree~ and the existing driveway adjacent to the house and in the front yard should be removed and the area should be landscaped. All other existing structures would be removed. The proposed lots would have the following approximate dimensional characteristics (see attached map): Width at Front Average Lot Property Line Depth 1 60' 101.25' . 2 75' 101' 3 45'* 85'** 4 45'* 109' 5 45'* 106' 6 51' 92'** 7 65' 130,25' *Width on cul-de-sac lot **Substandard lot depth Area (sq, ft.) 7,546 7,515 8,201 7,840 7,731 8,293 10,372 Lots 3 and 6 do not conform to the mlnlmum depth requirement of 100 feet and would require a variance. The Arcadia Municipal Code defines lot depth as the horizontal distance between the front and rear lot lines measured in the mean direction of the side lot lines, . To approve the subdivision, the Planning Commission should grant a variance for an 85-foot lot depth for Lot 3 and a 92-foot lot depth for Lot 6, Staff feels the requested variance would be appropriate for the proposed subdivision, Properties with depths similar to Lots 3 and 6 have previously been approved by the Planning Commission and developed without any appreciable problems. . Tentative Tract 33724 Variance V-77-2 3 Pursuant to the provlslons of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic signifi- cance. Therefore, a Negative Declaration has been prepared for this project. Before the City Council takes action on this project, the Council should "move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment." To approve Tentative Tract 33724, pursuant to Sections 66473.5 and 66474,6 of the 1977 Subdivision Map Act, the City Council must find that the aforesaid tract is consistent with the Arcadia General Plan and that the waste' discharge from said tract would not result in a violation of the existing requirements set forth in the Water Code. . RECOMMENDATIONS The Planning Department recommends that Tentative Tract 33724 and Variance V-77-2 be approved subject to the following conditions: 1, Conditions as outlined in the attached report from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works. 2. That all existing buildings and structures be removed from Lots 1 through 6. 3. That the existing driveway approach to Lot 7 on First Avenue be closed and all excess driveway area in the front and side yard be removed and landscaped and a new driveway approach to Lot 7 be constructed on the new street. 4. That prior to the issuance of a grading permit and prior to the issuance of any building permits, the developer shall submit to the Planning Department for its approval, a plot plan indicating the location of all existing trees with a diameter larger than six inches which are proposed to be removed. 5. That the Commission make the following findings: . a, That there are exceptional or extraordinary circum- stances or conditions applicable to the property . Tentative Tract 33724 Variance V-77-2 4 involved, or to the intended use of the property, that do not apply generally to the property or class of use in the same zone or vicinity. b. That the granting of such variance will not be materially detrimental to the public health or wel- fare or injurious to the property or improvements in such zone or vicinity in which the property is located, c, That such variance is necessary for the preservation and enjoyment of a substantial property right of the applicant possessed by other property in the same zone and vicinity. d. FIRST AVENUE The following should be made conditions of approval of the proposed subdivision: 1. The preparation and recordation of a tract map in accordance with the requirements of the State Subdiv.5ion Map Act. The map shall be submitted to the County Engineer for checking, and after checking, the County Engineer's letter recommending approval and map shall be submitted to the City Engineer for map certification. Concurrent with the map being submitted to the County Engineer for checking, the applicant should submit a copy of the City's conditional requirements to enable the County Engineer to check for applicable conditions. 2. Dedicate streets 60 feet wide or 50 feet plus a 5 foot planting and sidewalk easement on each side. 3. Provide all easements required for rear line utilities and install all utilities underground, 4. Install all standard street improvements required by the subdivision ordinance; including concrete sidewalks and gutter on First Avenue in accordance with plans to be approved by the City Engineer. NOTE: If a bond is posted to guarantee completion of the required improvements, all work specified in the Subdivision Agreement shall be completed within 12 months. 5. Remove all trees and structures within the street right of way and all buildings and structures within the tract boundary. 6. Arrange with the Edison Company to install street lights with underground circuits. Location and number of lights subject to approval of the City Engineer. 7.
