A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT TO OPERATE A RECREATIONAL FACILITY FOR SKATEBOARDING AT 131-l37 EAST LIVE OAK AVENUE, WHEREAS, on June 20, 1977, an application was filed by Robert G. Margett to operate a recreational facility for skate- boarding, Planning Department Case No. C.U.P. 77-12, on property commonly known as 131-137 East Live Oak Avenue, more particularly described as follows: Lots 1 and 43, Tract No, 12915, in the City of Arcadia, County of Los Angeles, as shown on map recorded in Book 270, page 10, of Maps, as recorded in the office of the Recorder of said County. WHEREAS, a public hearing was held on said matter on July 12, 1977 at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Plan- ning Department in the attached staff report is true and correct. SECTION 2. This Commission finds that: 1. The granting of a conditional use permit as herein- after provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. -1- 996 . . . . . 3. The site for the proposed use is adequate in size and shape to accommodate said use, including all yards, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the General Plan. 6. The use applied for will not have a substantial adverse impact on the environment. SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a conditional use permit for a recreational facility for skateboarding upon the following conditions: 1. The property shall be improved and maintained in accordance with plans on file in C.U,P. 77-12. 2. Grading and drainage plan shall be submitted for the approval of the Director of Public Works. 3. Three lS-gallon bottle brush trees shall be planted in Live Oak Avenue sidewalk at locations to be determined by Public Works Department. Tree wells shall be filled with red common brick. 4. Hours of operation shall be limited to 8 a.m. to 10 p.m. Monday through Thursday and 8 a.m. to 11 p.m. Friday through Sunday and nights preceding the legal holidays set forth in the Arcadia Municipal Code. -2- 996 . . . . . 5. Parking shall be striped and wheel stops provided as per Section 9269.S.A and 9269.9.A of the Arcadia Municipal Code. 6. Pedestrian access shall be provided from Live Oak Avenue as indicated on the applicant's plan. 7. Final plans shall be submitted to the Planning Depart- ment for its review and approval. S. A landscape and irrigation plan shall be submitted to the Planning Department for its review and approval. 9. All lighting shall be screened from view of adjoining properties. 10, That a modification be granted to allow a six-foot high fence in the special 50-foot setback. A six-foot high fence shall be installed around the entire skateboard park area. 11. That a modification be granted to allow the northerly parking spaces to overhang two feet six inches into the required five-foot landscape buffer. SECTION 4. C.U.P. 77-12. 2 MODIFICATIONS REQUESTED: 1. Parking to overhang 2-1/2 feet into the required 5 foot landscape buffer. 2. Lighting in the skateboard area to be a maximum of 25 feet in height in lieu of 15 feet allowed. 3. A 6 foot high chain link fence with barbed wire to be located in the special 50 foot setback on Live Oak Avenue. SPECIA~ INFORMATION EXISTING SITE: Building Area: 896 square feet Golf Course Area: The minature golf course occupies approximately 22;227 square feet . Access and Parking: A driveway extends along the westerly property line from Live Oak to the parking area. Access to the parking area is from the alley north of the golf course. A total of 33 parking spaces exist north and south of the alley. Landscape Buffers, Walls and Fences: A 5 foot landscape buffer and a six foot high block wall are located along the northerly property line adjacent to the residential property. A 4 to 5 foot chain link fence encloses the golf course on the easterly and northerly side. A 3 foot high chain link fence encloses the golf course along the southerly (street side) and westerly boundary. Since the miniature golf course has been vacated, the parking area and landscape strip have not been maintained by the property owner. PROPOSED SKATEBOARD PARK: Building Area: use the building amusement area. 896 square feet. The applicant is proposing to for rental office, snack bar, restrooms and . The roof will be expanded to provide a shade area for spectators. Building and shade area will total 2,560 square feet. Park Area: The skateboard park area will occupy approximately 24,163 square feet. The existing Live Oak driveway will be incor- porated into the park. The applicant is proposing the following in the park: Slalom runs, Bowl and Free style areas. . . . C.U.P. 77-12. 3 Final plans for the precise park layout have not been completed. Access and Parking: Access to the parking will be from the alley. 31, 9 x 20 parking spaces are proposed. There is a space reserved for bicycle parking. Landscape Buffers, Walls and Fences: The 5 foot planting strip and 6 foot high block wall will remain along the northerly property line. Cars will overhang the planting strip a maximum of 2-1/2 feet. A "decorative screen" is proposed between the parking area and the skateboard park. A 6 foot high chain link fence with barbed wire is proposed along the Live Oak Avenue property line. Low-profile landscaping will be located along the periphery of the skateboard area. There will be minimum landscaping in the park interior. Astro-turf will be used between the slalom and bowl areas. . Lighting: area. Proposed hours of operation are 8:00 a.m. to 11:00 p.m., seven days a week. The Planning Department contacted the Fire and Police Departments requesting their comments on this application. Both departments replied that they had "no objections" to such a use. There will be a maximum of four employees per shift. ANALYSIS A skateboard park is a permitted use in a C-l zone with an approved conditional use permit. It is also consistent with the General Plan designation of Commercial. I I I I . Site inspections of skateboard parks in Anaheim, Covina, Reseda, Upland and Pomona have indicated the following: . . . C.U.P. 77-12' 4 1. Noise resulting from these uses is minimal. Most noise eminating from these parks are from spectators rather than persons using the facility. Staff does not believe there will be a substantial increase in noise levels from this skateboard park. 2. During the day, there was more than adequate parking at all sites. However, during an inspection of the Upland skateboard park on Friday, July 1, the parking demand was double the avail- able paved parking. This location is in an undeveloped area and is not convenient for most people to walk to or ride bicycles to. . It is staff's opinion that parking will not be a substantial problem. There is parking for adjacent uses which might be available for the skateboard park during evening hours. Also, the location of the proposed skateboard park is more convenient for walking and bicycling. 3. There is limited landscaping and considerable use of Astro-turf in the park interiors. One of the main reasons for this is safety for the participants using the skateboard park. Dirt falling into the runs or bowl areas can create serious hazards. 4. The hours of operation of the five skateboard parks vary from opening hours of 8 or 9 a.m. to closing hours of 10 to 12 p.m. It is the Planning Department's op1n1on that the 8 a.m. to 11 p.m. proposed by the applicant would not be detrimental to the adjoining property owners. Access to the skateboard park is from the alley. There is no pedestrian access from Live Oak. In order to facilitate the use of the on-street parking in this area pedestrian access should be provided from Live Oak. RECOMMENDATION The Planning Department recommends approval of C.U.P. 77-12 subject to the following conditions: 1. Conditions as outlined in the attached report from the Depart- ment of Public Works shall be complied with to the satisfaction of the Director of Public Works. . . . . . . C.D.P. 77-12. 5 2. Hours of operation shall be limited to 8 a.m. to 11 p.m., seven days a week. 3. That parking be striped and wheel stops provided as per Section 9269.'8.A. and 9269.9.A, of the Arcadia Municipal Code. 4. pedestrian access shall be provided from Live Oak Avenue. 5. That final plans be submitted to the Planning Department for its review and approval. 6. That a landscape and irrigation plan be submitted to the Planning Department for its review and approval. 7. That a modification be granted for 25 foot high light standards in the skateboard park area in lieu of 15 foot allowed. 8. All lighting shall be screened from view of adjoining properties. 9. That a modification be granted to allow a 7 foot high chain link fence in the special 50 foot setback (6 foot high fence with 1 foot of barbed wire, if necessary). 10. That a modification be granted to allow the northerly parking spaces to overhang 2' 6" into the required 5 foot landscape buffer. DLB/kf Attachments . . . . . "-.-- July 27, 1977 The City Council City Hall Arcadia, California Dear Sirs: I am representing the Green Oak I,jedical l'-uilding at 115-117 East Live Oak Avenue in Arcadia and am hereby presenting this request for an ap~eal hearing regarding the proposed construction of a skateboard park at the property adjacent to us at 137 East Live Oak Avenue where at the present time there exists a miniature golf course. . Due to an unfortunate set of circu~stnnccs, the Green Oak f1edical Eluilding never rec'?ivcd notice of the original hearing regarding the request for permission to construct the skatehoard park. Therefore, we were unable to present our concerns regarding this project. Our concerns and the appeal are hased on the following considerations: 1. The inevitable increase in traffic and people in this vicinity who would be using the new facility will create a parking problem. 2. We can anticipate an enormous increase in the noise factor adjacent to our medical buildino. 3. Since we have already been subjected to saine vandalism on a r~(J1Jl;lr h;lSic at our building, we anticipate that the increase in individuals in this vicinity would probably result in an increase of damaging vandalis~.
