RESOLUTION NO. 992 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA RECOMMENDING APPROVAL OF T.A. 77-3 AMENDING THE FRONT YARD REQUIREMENTS IN THE R-3 ZONE TO RESTRICT VEHICULAR ACCESS- WAYS. WHEREAS, a public hearing was held on June 14, 1977 before the Planning Commission to consider amending the front yard requirements in the R-3 Zone to restrict vehicular accessways from occupying more than 25 percent of the required front yard; and WHEREAS, all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF . ARCADIA RECOMMENDS TO THE CITY COUNCIL: SECTION 1. That Section 9255.2.3 of the Arcadia Municipal Code be amended to read as follows: "9255.2.3. FRONT YARD. There shall be a front yard of not less than twenty-five feet (25'). Vehicular accessways shall not occupy more than twenty-five percent (25%) of the required front yard, and at least fifty percent (50%) of the required front yard shall be irrigated and landscaped with lawn, trees, shrubs, or other plant materials. Said yard shall be permanently maintained in a neat and orderly manner." SECTION 2. The Planning Commission finds that the proposed text amendment will facilitate better R-3 development '.\ and that the public necessity, convenience, general welfare and good zoning practice justify the above recommendation. -1- 992 . . . The Planning Commission at its May 10, 1977 meeting directed the Planning Depart- ment to study a text amendment limiting the paved area in the front yard setback in an R-3 zone. REQUEST: Text amendment restricting vehicular accessways from occupying more than 25% of the required front yard in an R-3 zone~ SPECIAL INFORMATION The R-O, R-l and R-2 zones have specific limitations on the percentage of area that pedestrian walkways and vehicular accessways may occupy in the required front yard. . The R-3 ordinance does not limit the amount of paving allowed in the required front yard. This omission could result in an R-3 development that would have almost the entire front yard paved. Although the R-3 code prohibits parking in the required front yard, it does not prohibit vehicular accessways from being located in the front yard. Figures C and D are two examples of the type of development that could occur under present code requirements. . The Planning Department would recommend that vehicular access- ways be restricted to 25% of the required front yard. This " . . . T.A. 77-3 2 would permit a driveway 25 feet in width to be located in the required front yard on a standard IOO-foot wide lot. Figures A and B are examples of what would be permitted under the proposed ordinance. If a developer wished to exceed the 25% requirement, the developer could apply for a modification. Section 9255.2.3 reads "Front Yard. There shall be a front yard of not less than twenty-five feet (25')." It is staff's opinion, that in order to facilitate better R-3 development and to ensure that the required front yard is not excessively paved, Section 9255.2.3 should be amended to read: "Front yard. There shall be a front yard of not less that twenty-five feet (25'). Vehicular accessways shall not occupy more than twenty-five percent (25%) of the required front yard." Pursu~nt to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been pre- pared for this project. Before the City Council takes action on this project, the Council should "move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment." RECOMMENDATION The Planning Department recommends approval of text amendment T.A. 77-3 as follows: "9255.2.3. FRONT YARD. There shall be a front yard of not less than twenty-five feet (25').
