RESOLUTION NO. 989 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR AN EATING ESTABLISHMENT AT 231 EAST FOOTHILL BOULEVARD. WHEREAS, on May 18, 1977, an application was filed by Ronald T. Rosen to operate an eating establishment, Planning Depart- ment Case No. C.U.P. 77-10, on property commonly known as 231 East Foothill Boulevard, more particularly described as follows: Those portions of Lots 2 and 3 of Tract 12834 in the City of Arcadia, County of Los Angeles, State of California, as shown on map recorded in Book 264, page 24 of Maps, in the office of the County Recorder of said County. . WHEREAS, a public hearing was held on said matter on June 14, 1977 at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Plan- ning Department in the attached staff report is true and correct. SECTION 2. This Commission finds that: 1. The granting of a conditional use permit as herein- after provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is . properly one for which a conditional use permit is authorized. -1- 989 -~- ~~-~ . . . 3. The site for the proposed use is adequate in size and shape to accommodate said use, including all yards, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the General Plan. 6. The use applied for will not have a substantial adverse impact on the environment. SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a conditional use permit for an eating establishment upon the following conditions: 1. The property shall be approved and maintained in accordance with plans on file in C.U.P. 77-10. 2. That a trash enclosure be provided as per Section 9263.6.6 of the Arcadia Municipal Code and that said plans for a trash enclosure be submitted to the Planning Department for its review and approval. 3. That seating be limited to 50. 4. That restrooms comply with the Uniform Plumbing Code. SECTION 4. Rosen LOCATION: REQUEST: EXI STING ZONING AND LAND USE: SIZE: FRONTAGE: SURROUNDING LAND USE AND ZONING: GENERAL PLAN: 231 East Foothill Blvd. Conditional use permit to operate an eating establishment (ice cream parlor) C-2 D and is developed with a neighborhood shopping center. There are 4 lots under 2 separate owner- ships. Ralph's Market is located on 3 lots and the shops are located on one lot which is under separate ownership. 145,122 square feet (3.3. acres) 305 feet on Second Avenue and 467.5 feet on Foothill Blvd. North: C-2 D & R-l, developed with Ralph's loading area and single-family dwellings C-2, developed with offices and residential uses C-2 and PR-l, developed with mixed commercial uses, eating establishments and parking C-2 D, developed with Ralph's Market South: East: West: Commercial . . . . c . , C.U.P. 77-10 2 SPECIAL INFORMATION BUILDING: Approximately 1,642 square feet of building area MISCELLANEOUS INFORMATION: The dining area will have seating for a maximum of 50 persons. Food served will be ice cream, sundaes, malts, hot and cold drinks and hot dogs. One restroom presently exists and the applicant is proposing to construct another. Hours of operation will be approximately 11 a.m. to 10 p.m., Monday - Saturday and 11 a.m. to 7 p.m., Sunday REQUIRED PARKING, LANDSCAPING AND BUFFERS: 234 spaces are re~uired, 156 stalls exist. 33 parking spaces are required for the ice cream parlor. The parking area is substandard in terms of parking, landscaping, buffers and trash enclosures. INGRESS AND EGRESS: From Second Avenue and Foothill Blvd. ANALYSIS The proposed eating establishment is a permitted use in a C-2 zone with an approved conditional use permit. It is the Planning Department's opinion that the ice cream parlor will not create a substantial increase in parking. Any major parking improvements to the site would create a substantial hardship on the applicant. The Planning Department would recommend that a trash enclosure be provided for this use, the location to be approved by the Planning Department Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not dis- close any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this proj ect. . . . , , C.U.P. 77-10 3 Before the Planning Commission takes action on this project, the Commission should "move to approve and file the Negative Declaration and find that the project will not have a significant effort on the environment." RECOMMENDATION The Planning Department recommends approval of C.U.P. 77-10 subject to the following conditions: 1. The area. in which I would like to open my business seems 8pproprlately developed with a re a.sonable balance of services businesses, retail esta.blishments and fast food stores. There is a medium-high residential density composed mainly of single family homes nearby. The streets are wide and adequate to carry present trarfic. The businesses on foothill, including the shopping center in which I would like to open, seem '3.ppropriately placed and are a.pparently convenient to the nearby residences without causing noise ortrarfic inconveniences. Inside the bUllding, I will install ice cream freezers, a. frozen yogurt dispenser, and a.ll the other necessary equipment to provide sundaes, malts and ice cream cones, soft drinks and hot dogs with chili. Since I will provide chairs and tables for up to 50 pleople, I will also install an additional restroom. There will then be a men's restroom with a toilet, urinal and sink with soap dispenser and disposable cloth towels. The women's restroom will have two toilets along with the above washing facilities. Also, doors will be wide enough for the handicapped and bars will also be insta11ed along side one toilet in each restroom for their convenience. MINUTE RESOLUTION OF THE PLANNING COMMISSION CLARIFYING SECTION 9255.2.7 OF THE ARCADIA MUNICIPAL CODE RELATING TO UNDERGROUND PARKING BONUS PROVISIONS. WHEREAS, Arcadia Municipal Code Section 9213 stipulates that to clarify any ambiguity within the meaning or intent of the Zoning Ordi~ance, the Planning Commission shall set forth its findings in a resolution of record which shall be referred to the City Council where, if approved, said resolution thereafter shall govern said meaning or intent; and WHEREAS, the intent of the R-3 density bonus was to provide additional landscaped areas and open space by encouraging less paved ground surface area; and WHEREAS, said intent was not clearly expressed in Section 9255.2.7; NOW, THEREFORE, THE PLANNING COMMISSION RESOLVES that a project shall have both the required parking and driveway areas below grade and under a structure with additional landscaped open space above, before qualifying for the R-3 density bonus provision as set forth in Arcadia Municipal Code Section 9255.2.7.
