HomeMy WebLinkAboutItem 11a - Regular Meeting Minutes of November 1, 2022 1 11-01-2022 ARCADIA CITY COUNCIL REGULAR MEETING MINUTES TUESDAY, NOVEMBER 01, 2022 CALL TO ORDER – Mayor Beck called the Closed Session to order at 6:00 p.m. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Danielson, Tay, Verlato, Cheng, and Beck ABSENT: None The City Manager and City Attorney explained the need to add a closed session item to the closed session agenda, in light of correspondence received late Friday afternoon. City Attorney Deitsch further explained to the City Council that to add a closed session item under Government Code section 54956.9(d)(4) to the agenda pursuant to Section 54954.2(b) of the Brown Act, they would need to make the following two findings: (1) case, pursuant to Section 54954.2(b) of the Brown Act based on findings that (1) need to take action tonight (2) and that the need to take action arose after the agenda was posted and the finding was based on correspondence received late Friday afternoon after the agenda was posted It was moved by Council Member Verlato, seconded by Mayor Pro Tem Cheng and carried on roll call vote to adopt the two findings, as cited by the City Attorney, to add an item to the closed session agenda, under Government Code Section 54956.9(d(4), to confer with legal counsel regarding potential litigation – one (1) case AYES: Verlato, Cheng, Danielson, Tay, and Beck NOES: ABSENT: PUBLIC COMMENTS – There was no public comment. CLOSED SESSION b. Pursuant to Government Code Section 54956.9(d)(4) to confer with legal counsel regarding potential litigation – one (1) case a.Pursuant to Government Code Section 54957.6 to confer with labor negotiators. City Negotiators: City Manager Dominic Lazzaretto, Assistant City Manager/Development Services Director Jason Kruckeberg, and Administrative Services Director Hue Quach. Employee Organizations: Arcadia Public Works Employees Association, Arcadia City Employees Association, Arcadia Police Civilian Employees Association, Arcadia Police Officers’ Association, Arcadia Firefighters’ Association, and unrepresented employees: Department Heads, Division Managers, Supervisors, and part-time employees. No reportable action was taken on Closed Session Item b. 2 11-01-2022 The City Council did not complete their discussion of Closed Session Item a. in the time allowed. Therefore, the Closed Session recessed to the Regular Meeting at 6:54 p.m. with the intent to return to Closed Session at the completion of the Regular Meeting. Regular Meeting City Council Chambers, 7:00 p.m. 1. CALL TO ORDER – Mayor Beck called the Regular Meeting to order at 7:00 p.m. 2. INVOCATION – Reverend Eva Thai-Erwin, Church of the Good Shepherd 3. PLEDGE OF ALLEGIANCE – Fire Chief Spriggs 4. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Danielson, Tay, Verlato, Cheng, and Beck ABSENT: None 5. REPORT FROM CITY ATTORNEY REGARDING CLOSED/STUDY SESSION ITEMS City Attorney Deitsch reported that at the October 18, City Council Meeting the City Council recessed to a Closed Session at the conclusion of the Regular Meeting to complete its discussion on the labor related matter posted on the Closed Session Agenda; and indicated that no reportable action taken on Closed Session Item b. City Attorney Deitsch announced that the City Council met in a Closed Session Meeting prior to the regular meeting, and reported that by a unanimous vote, City Council voted to add a Closed Session under Government Code Section 54956.9(d)(4), to confer with legal counsel regarding potential litigation – one (1) case, pursuant to Section 54954.2(b) of the Brown Act based on findings that (1) there was a need to take action tonight (2) and that the need to take action arose after the agenda was posted and the finding was based on correspondence received later Friday afternoon after the agenda was posted; and indicated that no reportable action was taken. City Council also considered the one item that was listed on the posted agenda and will continue after the conclusion of the Regular Meeting; and recommended the City Council recess the Regular Meeting to a continued Closed Session. 6. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto had nothing to report. 7. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Council Member Verlato and seconded by Mayor Pro Tem Cheng to read all ordinances and resolutions by title only and waive the reading in full. 8. PRESENTATIONS a. Presentation of adoptable dog by the Pasadena Humane Society. 3 11-01-2022 b. Presentation of Arcadia Festival of Bands Proclamation. c. Presentation of the San Gabriel Valley Council of Government’s Efficient San Gabriel Valley (“ESGV”) Program. 9. PUBLIC COMMENTS (5-minute time limit each speaker) Gerri Lyn, an Arcadia resident appeared and expressed her frustration with the Development Services Department; and expressed frustration with her unsuccessful attempts to reclassify her property to a single-family residence. 10. REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense [AB 1234]). Mayor Beck called for recess at 7:24 p.m. Mayor Beck reconvened at 7:25 p.m. City Clerk Glasco announced that residents may complete a Refusal Register Form available through the City Clerk’s office and City website to avoid door to door solicitations; he further reminded vendors and solicitors that they must obtain a solicitors permit through the Business License office. Council Member Tay announced that last Friday he shared the history of his time as a Mayor and Council Member with the Rotary Club of Arcadia; he reminded everyone to respect one another and not to be discouraged when you fail; he announced that it is campaign season and reminded everyone to work together. Council Member Danielson announced that on October 25, he attended the Arcadia Board of Education meeting; on October 26, he attended the Building Industry Association of Southern California Gala, which focused on Veteran housing; on October 27, he visited the Jim Lahey Maintenance Yard; on October 28, he attended the Mayors Breakfast followed by the Downtown Arcadia Improvement Association Halloween Haunting and then Trunk or Treating at Camino Grove Elementary School; on October 29, he attended the Chinese Health Fair at the Community Center, and then later that day attended the Arcadia Historical Society Gala; on October 30, he attended the Arcadia Chinese Association Halloween Fundraiser; on October 31, he attended the Senior Boo Bash at the Arcadia Recreation Center; on November 1, he attended the Arcadia PTA meeting; and attended the Anti-Asian hate round table in San Gabriel later that evening. Council Member Verlato announced that she attended the Arcadia PTA meeting; she attended the San Gabriel Valley Council of Governments Mobile Crisis Response Launch also known as SGV Care; the Mayor’s Breakfast with keynote speaker Candice Parker; and the Downtown Arcadia Improvement Association Halloween Haunting; and the Arcadia Chinese Association Halloween Fundraiser. She shared photos of these events as well as of the Arcadia Police Department’s new K9, Kopper; and she reminded residents that the Downtown Arcadia Holiday Fair is December 10. Mayor Pro Tem Cheng announced that improper allegations have been made against City Council and stated that there is no fraudulent action occurring among any Council Member; he reminded residents of all the actions City Council took in response to the COVID-19 pandemic and other collaborations and accomplishments spearheaded by the Council; and thanked residents for choosing Arcadia to be their home. 4 11-01-2022 Mayor Beck announced that he attended the Arcadia Chinese Association Halloween fundraiser; he thanked Mary Buttice, Jennifer Brutus, and Justine Bruno for putting together the Mayor’s Breakfast, and shared photos of these events; on October 29, he attended the Arcadia History Makers celebration hosted by the Arcadia Historical Society; on October 30, he attended the Arcadia Chinese Association Gala; he announced that Council Member Verlato will be honored for all of her achievements, amongst other women, at NOOR Event Space in Pasadena and congratulated her; that on November 5, the Arcadia Beautiful Commission will be hosting the annual clean-up day in honor of Mary Hansen; that on November 12 a free shred event at the Arcadia Library beginning at 8 a.m.; that November 15, will be the last Coffee with the Mayor and dedication of the garden to Mary Hansen at the Arcadia Library; and that December 1, there will be the Christmas tree lighting at the Foothill Transit Plaza. 11. CONSENT CALENDAR a. Special and Regular Meeting Minutes of October 18, 2022. Recommended Action: Approve b. Resolution No. 7467 amending the Fiscal Year 2022-23 General Fund Budget and authorizing a budget appropriation for the Police Department Chiller Replacement Project in the amount of $247,605, offset by a reduction in the General Fund Reserve; and approving a contract with Carrier Corporation for the Police Department Chiller Replacement Project in the amount of $247,605. Recommended Action: Adopt and Approve c. Professional Services Agreements for On-Call Engineering Services with HR Green Pacific, Inc., Kreuzer Consulting Group, and Psomas. Recommended Action: Approve d. Extension to the Professional Services Agreement with ABM Industry Groups, LLC. for Janitorial and Porter Services at various City facilities in an amount not to exceed $398,360.49. Recommended Action: Approve e. Service Agreement with Motorola Solutions Inc., for the Police Department Radio Consoles for Fiscal Year 2022-2023 through 2027-28 in an amount not to exceed $191,795. Recommended Action: Waive the Formal Bid Process and Approve f. Reject low bid from Bluesky Diversified dba Puente Hills Ford and approve Purchase Order with Ernie’s Auto Parts for the purchase of automotive repair parts for City vehicles in an amount not to exceed $60,677.06. Recommended Action: Approve g. Accept all work performed by Ramona, Inc. for the Sewer Main Replacement Program as complete. Recommended Action: Approve It was moved by Council Member Verlato, seconded by Mayor Pro Tem Cheng, and carried on a roll call vote to approve Consent Calendar Items 11.a through 11.g. AYES: Verlato, Cheng, Danielson, Tay, and Beck NOES: None ABSENT: None 5 11-01-2022 12. CITY MANAGER a. Allowable hours and rules of operation for noise related to gardening/landscaping and use of gas-powered leaf blowers in residential areas. Recommended Action: Provide Direction Assistant City Manager/Development Services Director Kruckeberg presented the Staff Report. The Council discussed changing the permissible hours for construction activities, but a consensus was not reached to pursue any changes to the existing code. After City Council discussion, a motion was made by Mayor Pro Tem Cheng and seconded by Council Member Verlato to bring back an Ordinance that amends the existing code to prohibit the operation of mechanical equipment for gardening and landscaping purposes on Sundays. AYES: Cheng, Verlato, Tay, and Beck NOES: Danielson ABSENT: None The City Council had discussion regarding state regulations around electric leaf blowers, costs to transition, grants available, noise produced, battery life, and the implications of legislating in this area. After further discussion, it was the consensus of the City Council to have staff bring back more information regarding electric leaf blowers and the questions they raised. b. Resolution No. 7468 revising Resolution No. 7407 (Sixth Cycle Housing Element Adoption) with a categorical exemption under the California Environmental Quality Act ("CEQA"). Recommended Action: Adopt Assistant City Manager/Development Services Director Kruckeberg presented the Staff Report. City Manager Lazzaretto expressed that the actions being asked by the state are unnecessary but nevertheless recommended that the City Council adopt this Resolution in order to be cooperative. Mike Veerman, an Arcadia resident appeared and urged the City Council to move forward with the housing element adoption; and thanked the City Council and Staff for their time and thorough review of this item. A motion was made by Council Member Verlato, seconded by Council Member Tay, and carried on roll call vote to adopt Resolution No. 7468 revising Resolution No. 7407 (Sixth Cycle Housing Element Adoption) with a categorical exemption under the California Environmental Quality Act (“CEQA”). AYES: Verlato, Tay, Danielson, Cheng, and Beck NOES: None ABSENT: None The City Council recessed at 9:15 p.m. The City Council reconvened to Closed Session at 9:26 p.m. to discuss Closed Session Item a. and no reportable action was taken. 6 11-01-2022 13.
