A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARCADIA GRM,TING A CONDITIONAL
USE PERMIT TO COnSTRUCT A RADIATOR SHOP A."lD
INDUSTRIAL PARK AT 401-405 NORTH FIRST AND
53 LA PORTE.
WHEREAS, on March 21, 1977, an application was filed by
Benny and Paula Joseph, Planning Department Case No. C.U.P. 77-8,
to construct a radiator shop and industrial park at 401-405 North
First Avenue and 53 La Porte Street, more particularly described
as follows:'
Lots l4, 15 and 16, Block 82, Arcadia Santa Anita Tract,
City of Arcadia, County of Los Angeles, as recorded in
Map Book 15, page 89, in the office of the Recorder of
said County.
~mEREAS, a public hearing was held on April 12, 1977, at
which time all interested persons were given full opportunity to
be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Planning
Department in the attached report is true and correct.
SECTION 2. This Commission finds that:
1. The granting of a conditional use permit as herein-
after provided will not be detrimental to the public health or
welfare or injurious to the property or improvements in such zone
or vicinity.
2. The use applied for at the location indicated is
properly one for which a conditional use permit is authorized.

'... 3. The site for the proposed use is adequate in size
and shape to accommodate said use, including all yards, parl:ing,
loading, landscaping and other features requirec to adjust said
use with the land and uses in the neighborhood.
4. The site abuts streets and highways adequate in
width and pavement type to carry the kind of traffic generated by
the proposed use.
5. The granting of such conditional use permit will not
adversely affect the General Plan.
6. The use applied for will not have a significant
effect on the envir0nment.
SECTIO~ 3. That for the foregoing reasons, subject to
approval of the City Council, this Commission grants a conditional
use permit to construct a radiator shop and industri~l park upon
the following conditions:
1. The property shall be improved and maintained in
accordance with plans on file in the sQbject Case No. C.U.P. 77-3.
2. Submit grading and drainage plan which shall be subject
to the approval of the Director of Public Works.
3. Existing driveway aprons not to be used shall be closed.
4. Eighteen-inch P.C.C. gutter shall be constructed on
La Porte Street.

5. Parkway trees shall be required on La Porte Street.
Location and number of trees to be determined after submittal of
final plans.

shall be recorded in the office of the County Recorder in a form
and content approved by the City Attorney indicating that the
owner of the property at 53 La Porte and 401-405 ;,orth First shall
continue to maintain parking for the use of 56 La Porte as long as
said uses are maintained.
7. That the lots located at 53 La Porte and 4~1-~05 ~orth
First be consolidated and that a lot consolidation be filed with and
approved by the City and recorded by the County prior to issuance
of any building permits.
8. That modifications be granted for the following:
a. Zero front yard setback for existing glass shop
in lieu of 10 feet required.
b. Zero side yard setback in lieu of 5 feet required
fer proposed radiator shop.
c. Five-foot three-inch side yard setback for the
existing building.
d. Two substa,ldard parking spaces 9 feet 9 inches
by 20 feet in lieu of 11 feet 6 inches by 20 feet required.
e. Twenty-seven parking sraces in lieu of 32
required.
f. Six-foot front yard setback in lieu of 10 feet
required as per plans on file in the subject case.
9. All work at the radiator shop shall be done inside
the building.
10. The roof design shall be incorporated on the e::isting

The exterior of the buildings will be cinder block
and slump stone with a tile mansard roof. The
mansard roof will also be incorporated on the existing
building.
PARKING, LANDSCAPING
AND BUFFERS:
The parking lot at 53 La Porte is required
parking by covenant for the uses at
56 La Porte. The uses at 56 La Porte
include a music school (C.U.P. 76-5),
garage and metal fabricator shop, -
(total area 6,920 sq. ft.) There is no
on-site parking.
These uses require 21 parking spa~es, 11 for the music school
(based on 5 spaces per 1,000 sq. ft.) and lO spaces for the
industrial uses.
The applicant has indicated that the lease for the music school
has expired and will not be renewed. The total number of required
parking spaces for this site (56 La Porte) based on industrial
requirements will be 14.
Eighteen parking spaces are requuired for the proposed new complex.
A total of 32 parking spaces are required for 56 La Porte and
the proposed development. Twenty-seven parking spaces are
provided.

Planting is proposed in front of the westerly building and tree
wells are provided in the parking interior.

The radiator shop will have 4 bays. All work
will be done inside the building. A maximum of
II cars are usually serviced each day during the
months of June - August. The remaining months
av~rage approximately 4 cars per day. All work
is done by appointment.
There are presently 4 ,employees for the radiator and glass shop.
MISCELLANEOUS
INFORMATION:
The applicant is the property owner at 4ll North First, north of
the subject site. He has stated that this proposal is the
first of a two-phase development. The property at 4ll North
First will be ,included in the second phase;
ANALYSIS
Although the proposed use is inconsistent with the General Plan,
it is consistent with the zoning of.the area and would allow for
proper development of the site.
It is the Planning De~artment's opinion ~hat there is no
justification for granting a modification for a 6' front yard
setback on First Avenue. Approval of said setback could set
a precedent for development to the north.
If the applicant were to comply with the lO' setback, the
easterly building might be reduced in size by 291 square feet
(3,346.5 sq. ft.). This decrease would reduce the number of
required parking spaces to 17 in lieu of l8 required.
The Planning Department ~oes'not believe the request for 27
parking spaces in lieu of 32 would cause a parking deficiency.
The request for 9'9" stalls in lieu of ll'6" required would
provide for adequate parking spaces. However, when the second
phase of this project is developed, all parking should comply
with Code.
Pursuant to the prOVIsIons of the California Environmental
Quality Act, the Planning Department has prepared an initial
study for the proposed project. Said initial study did not
disclose any substantial adverse change in any of the physical
conditions within the area affected by the project including
land, air, water, minerals, flora, fauna, ambient noise, and
objects of his,torical or aesthetic significance. Therefore,
a Negative Declaration has been prepared and filed for this
project. '
Before the Planning Commission takes action on this project,
the Commission should "move to approve and file the Negative

Declaration and find that the project will not have a signifi-
cant effect on the environment."
RECOMMENDATION
The Planning Department recommends approval of C.U.P. 77- ,
subject to the following conditions:
1. Conditions outlined in the attached report from the Depart-
ment of Public Works shall be ~omplied with to the satis-
faction of the Directo~ of Public Works.
2. Prior to issuance of any building permits, a covenant shall
be recorded in the office of the County Recorder in a form
and content approved by the City Attorney indicating that
the owner of the property at 53 La Porte and 40l-405 North
First shall continue to maintain parking for the use of
56 La Po~te as long as said uses are maintained.
3. That the lot~located at 53 La Porte and 40l-40S North First
be consolidated and that a lot consolidation be filed with
and approved by the City and recorde9 by the County prior
. to issuance of any building permits.
4. That the applicant shall comply with a lO' setback on First
Avenue for the proposed new building.
S. That modifications be granted for the following:
a. Zero front yard setback for existing glass shop in lieu
of lO' required.
b. Zero side yard setback in lieu of 5' required for proposed
radiator shop.
c. '5'3" side yard and zero front yard setback for the
existing building.
