RESOLUTION NO. 984
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARCADIA GRANTING A CONDITIONAL
USE PERMIT TO OPERATE A SELF-SERVICE STATION
WITH AN INSTA-TUNE AUTOMOTIVE SERVICE AT
5 WEST LIVE OAK AVENUE.
WHEREAS, on March 1, 1977, an application was filed by
Powerine Oil Company, Planning Department Case No. C.U.P. 77-7,
to operate a self-service station with an Insta-Tune automotive
service on property commonly known as 5 West Live Oak Avenue,
more particularly described as follows:
Portion of Lot 69 of Santa Anita Colony in the City of
Arcadia, County of Los Angeles, State of California,
as per map recorded in Book 42, page 87 of M.R., in the
office of the Recorder of said County.
WHEREAS, a public hearing was held on March 22, 1977, at
which time all interested persons were given full opportunity to
be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Planning
Department in the attached report is true and correct.
SECTION 2. This Commission finds that:
1. The granting of a conditional use permit as herein-
after provided will not be detrimental to the public health or
welfare or injurious to the property or improvements in such zone
or vicinity.
2. The use applied for at the location indicated is

properly one for which a conditional use permit is authorized.
3. The site for the proposed use is adequate in size
and shape to accommodate said use, including all yards, parking,
loading, landscaping and other features required to adjust said
use with the land and uses in the neighborhood.
4. The site abuts streets and highways adequate in
width and pavement type to carry the kind of traffic generated by
the proposed use.
5. The granting of such conditional use permit will not
adversely affect the General Plan.
6. The use applied for will not have a significant
effect on the environment.
SECTION 3. That for the foregoing reasons, subject to
approval of the City Council, this Commission grants a conditional
use permit to operate a self-service station with an Insta-Tune
automotive service upon the following conditions:
1. The property shall be improved and maintained in
accordance with plans on file in the subject Case No. C.U.P. 77-7.
2. The landscape area shall be cleaned and maintained.
3. The trash bin shall be kept in the trash enclosure
located north of the building.
4. The parking area shall be restriped as per Section
9269.8.A.
5. Both operations (gasoline and service area) shall
operate in compliance with Section 9275.4.14.
6. That when the Insta-Tune facility is not in operation,
the bay doors shall remain closed.

7. Signing shall comply with Code.
8. Exterior colors and materials shall be submitted to
the Planning Department for its review and approval.
9. The Insta-Tune hours of operation shall be from
8:00 a.m. to 6:00 p.m.
10. The noise level of mechanical equipment shall not
exceed ~t any point on or beyond the property line a maximum of
70 decibels. No impact type sound shall exceed this value by an
amount greater than 10 decibels. If the noise is not smooth and
continuous, the corrections in the following table shall be applied:

SECTION 4. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.

The existing bays are presently served by 2 rear
doors. The applicant is proposing to add 2 doors
in the front to create drive-thru bays.
OPERATION: InstaTune will operate the lube bays. Their work
would be limited mainly to tune-ups. Hours of
operation will be approximately 8:30 a.m. to 6:00 p.m.
Customers of the service station will drive in,
pay at the cashier's window (walk-up) for the amount
of gas they wish to purchase, then pump their own
gas. The pumps automatically turn off when the
amount purchased is received. A 24-hour operation
is proposed.

ANALYSIS
Self-service stations are permitted in a C-2 zone with an
approved conditional use permit.
There are presently approximately 18 service stations with front
bays and 8 with rear bays. Staff does not believe thru-bays
would have a detrimental effect on adjacent properties. The
doors should remain closed when InstaTune is not in operation.
Because there is no residential property in the immediate area,
it is staff's opinion that the 24-hour operation will not be
detrimental to the surrounding neighborhood.
RECOMMENDATION
The Planning Department recommends approval of C.U.P. 77-7
subject to the following conditions:
1. The landscape area shall be cleaned and maintained.
2. The trash bin shall be kept in the trash enclosure located
north of the building.
