RESOLUTION NO. 981 A RESOLUTION OF TilE PLANNI!lG COI'lMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT TO ADD A DRIVE-THRU WINDOl'J TO THE EXISTING CARL'S JR. EATING ESTABLISHMEllT AT 165 E~ST DUARTE ROAD. WHEREAS, on January 25, 1977, an application was filed by Carl Karcher Enterprises, Inc., Planning Department Case No. C.U.P. 77-4, to add a drive-thru window to the existing Carl's Jr. eating establishment on property commonly known as 165 East Duarte Road, more particularly described as follows: . Lots 19, 20 and 21 and the easterly 27 feet of Lot 18, plus that portion of the vacated alley adjacent to the northerly boundary of Lots 18 and 21, all in Block 62 of Arcadia Tract, as per map recorded in Book 16, page 58, of M.R., in the office of the Recorder of Los Angeles County. WHEREAS, a public hearing was held on l1arch 8, 1977 at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANlIING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Planning Department in the attached staff report is true and correct. SECTION 2. This Commission finds that: 1., The granting of a conditional use permit as herein- after provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone . or vicinity. -1- 981 . . . . . 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. 3. The site for the proposed use is adequate in size and shape to accommodate said use, including all yards, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the General Plan. 6. The use applied for will not have a significant effect on the environment. 7. The proposed use will not substantially increase vehicular traffic on any street in a residentially zoned district. B. The proposed use will not lessen the suitability of any nearby commercially zoned property for commercial use by inter- fering with pedestrian traffic. 9. The proposed use will not create increased traffic hazards to pedestrians when located near a school, church, auditorium, theater or other place of. assembly. SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a conditional use permit to add a drive-thru window to the existing Carl's Jr. eating establishment upon the following conditions: 1. The property shall be improved and maintained in -2- 9Bl . . . . . accordance with plans on file in the subject Case No. C.U.P. 77-4. 2. A IS-foot radius corner cut-off shall be dedicated at the northwest corner of Duarte Road and Second Avenue. 3. A modification shall be granted for 37 parking spaces in lieu of 44 parking spaces required. 4. The planting strip located along the northerly property line shall be increased in length to 47 feet and said plan shall be submitted to the Planning Department for its review and approval. 5. The drive-thru lane shall be 10 feet in width. 6. The parking area shall be restriped as per Section 9269.8.A of the Arcadia Municipal Code. 7. If any additional lighting is proposed, a lighting plan shall be submitted to the Planning Department for its review and approval. 8. Directional signs shall be submitted to the Public Works Department for i tsreview and approval. SECTION 4. March 8, 1977 TO: PLANNING COMMISSION FROM: PLANNING DEPARTMENT SUBJECT: C.U.P. 77-4 165 EAST DUARTE ROAD APPLICATION This application was filed on January 25, 1977 by Carl Karcher Enterprises, Inc. (dba Carl's Jr.) and requests a conditional use permit to add a drive-thru window to the existing Carl's Jr. eating establishment at 165 East Duarte Road. LAND USE AND ZONING The subject site is zoned C-2 and developed with Carl's Jr. eating establishment. Properties to the north are zoned R-2 and developed with single-family dwellings; properties to the east are zoned C-l and developed with a service station and offices; properties to the south are zoned C-2 and developed with the Alpha Beta shopping center and a service station; and properties to the east are zoned C-2 and are vacant and developed with a single-family dwelling. (See the attached Land Use and Zoning Map.) HISTORY On December 21, 1971, the City Council approved C.U,P. 71-23 for a Carl's Jr. on this site. This approval included a modification allowing 42 parking spaces in lieu of 44 required. PROPOSAL The applicant is proposing to add a drive-thru window to the east side of Carl's Jr. The eating establishment contains approximately 2,230 square feet and has seating for 75 persons. The drive-thru will result in a 21 square foot addition to the east side of the . . . . . C.U.P. 77-4 2 building. This addition will provide space for serving the drive-thru customers. Seating will remain the same. The site contains approximately 23,640 square feet. Forty-two 10-foot by 20-foot parking spaces exist on the site. The staff in its previous C.U.P. 7l-23 noted "the additional increase in the size of the parking spaces would be more desirable and a reduction of two spaces would not be detrimental." If the drive-thru were installed, five parking spaces would be eliminated north of the building. The stacking lane, however, would accommodate fLve cars without obstructing the westerly driveway and parking spaces. The applicant is requesting a modification for 37 parking spaces in lieu of 44 required. A 33-foot long planting area is proposed along the northerly property line, separating the drive-thru lane from the alley. The menu board and speaker box will be located in this planting area. Landscaping meets Code requirements. Entrance to the drive-thru will be restricted to the westerly driveway and egress will be limited to the easterly driveway on Duarte Road. The drive-thru lane is 10 feet in width and reduces to 8 feet in width along the east side of the building. The lane would allow for a 28-foot driveway on the east side of the building. ANALYSIS Planning Department staff visited the Carl's Jr. drive-thru in West Covina during lunch hour. During 30 minutes at this site, nine cars used the drive-thru facility. It took approximately 30 seconds to order and from l~ minutes to 3 minutes to process orders. There were a maximum of two cars in line at anyone time. This lane would accommodate 7-8 cars. The inside take-out area had minimum seating. Staff observed no one coming inside and placing a take-out order. The applicant has submitted a memo indicating the number of ~ parking stalls during a six-day period between the hours of-rf:30 a.m. and l:30 p.m. At no time were there less than 23 spaces available. Several site inspections by staff concur with these figures. . . C.U.P. 77-4 3 . The applicant has indicated that the drive-thru window will be an "added facility to better service the existing Carl's Jr. customers." The Planning Department believes the drive-thru window would not create a substantial increase in traffic but would probably reduce the number of people parking cars and coming inside and placing take-out orders. It is the Planning Department's opinion that the proposed use is appropriate for the site and is compatible with the zoning and the General Plan. The Planning Department would recommend that the northerly plant- ing area length be increased to a minimum of 47 feet. This would ensure that vehicles entering from the alley would not disrupt automobile traffic in the drive-thru lane. Entrance to the drive-thru from the alley should be prohibited. There is not enough turning area for cars to easily manuever into the lane from the alley. The Planning Department would also recommend that the menu board be located easterly in the planting area, thus allowing more than one car in the stacking lane while a car is ordering. . The width of the drive-thru lane should be increased to lO feet in width adjacent to the building. This would allow for a 26-foot wide westerly driveway. If the applicant proposes any additional lighting, a plan for said lighting should be submitted to the Planning Department for its approval. Any change to the existing directional signs should be submitted to the Public Works Director for approval. Pursuant to the provisions of the California Environmental Quality Act, the Planning Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minera~s, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. Before the Planning Commission takes action on this project, the Commission should "move to approve and file the Negative Declaration and find that the project will not have a signifi- cant effect on the environment." . . . . . . C.U.P. 77-4 4 RECOMMENDATION The Planning Department recommends approval of C.U.P. 77-4 subject to the following conditions: l. Conditions as outlined in the attached report from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works. 2. That entrance to the drive-thru be prohibited from the alley. 3. That a modification be granted for 37 parking spaces in lieu of 44 parking spaces required. 4. That the planting strip located along the northerly property line be increased in length to 47 feet and that said plan be submitted to the Planning Department for its review and approval. 5. That the drive-thru lane be 10 feet in width. 6. That the menu board be relocated in the planting area in a location approved by the Planning Department. 7. That the parking area be restriped as per Section 9269.8A of the Arcadia Municipal Code. 8. If any additional lighting is proposed, a lighting plan shall be submitted to the Planning Department for its review and approval. 9.
