RESOLUTION NO. 979
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARCADIA GRANTING A CONDITIONAL
USE PERMIT TO CONSTRUCT A DRIVE-THRU EATING
ESTABLISH~lliNT AT 841 SOUTH BALDWIN AVENUE.
WHEREAS" on January 31, 1977, an application was filed by
Carlson Design and Construction Co., Planning Department Case
No. C.U.P. 77-5, to construct and operate a Kentucky Fried Chicken
drive-thru eating establishment on property commonly known as
841 South Baldwin Avenue, more particularly described as follows:
Portions of Lots 22 and 23, Tract 2731 in the City of
Arcadia, County of Los Angeles, State of California, as
per map recorded in Book 33, page 29 of Maps in the office
of the County Recorder of said County.
WHEREAS, a public hearing was held on February 22, 1977 at
which time all interested persons were given full opportunity to
be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Planning
Department in the attached staff report is true and correct.
SECTION 2. This Commission finds that:
1. The granting of a conditional use permit as herein-
after provided will not be detrimental to the public health or
welfare or injurious to the property or improvements in such zone
or vicinity.
2. The use applied for at the location indicated is
4It properly one for which a conditional use permit is authorized.

3. The site for the proposed use is adequate in size
and shape to accommodate said use, including all yards, parking,
'loading, landscaping and other features required to adjust said use
with the land and uses in the neighborhood.
4. The site abuts streets and highways adequate in
width and pavement type to carry the kind of traffic generated by
the proposed use.
5. The granting of such conditional use permit will not
adversely affect the General Plan.
6. The use applied for will not have a significant
effect on the environment.
7. The proposed use will not substantially increase
vehicular traffic on any street in a residentially zoned district.
8. The proposed use will not lessen the suitability of any
nearby commercially zoned property for commercial use by interfering
with pedestrian traffic.
9. The proposed use will not create increased traffic
hazards to pedestrians when located near a school, church, auditorium,
theater or other place of assembly.
SECTION 3. That for the foregoing reasons, subject to
approval of the City Council, this Commission grants a conditional
use permit to construct a drive-thru eating establishment upon the
following conditions:
1. The property shall be improved and maintained in
accordance with plans on file in the sUbject Case No. C.U.P. 77-5.

. approval of the Director of Public Works.
3. Full parkway width P.C.C. sidewalk shall be installed
, and existing driveway apron not to be used on Baldwin Avenue shall
be closed.
4. One, l5-gallon holly oak tree shall be planted in
Baldwin Avenue sidewalk at location to be determined by Public Works
Department.
5. That a covenant in a form and content approved by the
City Attorney be filed guaranteeing access from the property at
841 Baldwin through 855 Baldwin.
6. That egress from the dtive-thru driveway and Sizzler
driveway be restricted to "right hand turn only."
7. That all signs shall conform to Code.

8. That the "drive-thru" directional sign be deleted and
directional type signs shall be subject to approval of the Director
of Public Works.
9. That a planting buffer be located adjacent to the
easterly portion of the office building and said plans for land-
scape buffer be submitted to the Planning Department for its review
and approval.
10. That a planting area be provided north of the trash
enclosure. Said landscaping to be submitted to the Planning
Department for its review and approval.
11. That wheel stops be provided in accordance with
Section 9269.9A of the Arcadia Municipal Code.

14. The hours of operation shall be limited from 7:00 a.m.
to 11:00 p.m.
SECTION 4. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.

841 SOUTH BALDWIN AVENUE
APPLICATION
This application was filed on January 31, 1977 by Carlson Design
and Construction Co. and requests a conditional use permit to
construct and operate a Kentucky Fried Chicken drive-thru eating
establishment at 841 South Baldwin Avenue.
LAND USE AND ZONING
The subject site is zoned C-2 and COO D and vacant. Properties
to the north are zoned CoO D and C-2 and are vacant and developed
with mixed commercial uses. Properties to the east are zoned
C-2 and developed with a restaurant and mixed commercial uses.
Property to the south is zoned C-2 and developed with the Sizzler
Restaurant. _ Properties to the west are zoned R-3 and developed
with apartments. (See the attached Land Use and Zoning Map.)
HI STORY
On October 12, 1976, the Planning Commission approved lot split
L-76-18 which would create two new lots; one of them, the subject
site. The final parcel map has not been recorded.
PROPOSAL
The subject site contains 24,793 square feet, (10,393 square feet
fronts on Baldwin Avenue and is zoned C-2; 14,400 square feet is
. zoned CoO D).
The applicant is proposing a 1,584 square foot Kentucky Fried
Chicken eating establishment with a drive-thru window on the C-2
portion of the site. The seating capacity will be 20. A 640
square foot office building is proposed on the CoO D portion.

The KFC building exterior will be brick veneer and stucco with a
tile mansard roof. The office building will be stucco with a
shake roof.
There will be a freestanding sign, not to exceed 150 square feet
total area located in front of the bUilding, and wall"signs
located on the north, south and east elevation. The east wall
sign (front of building) contains 57 square feet in lieu of 48
square feet allowed. An "exit only" sign and "drive-thru"
sign will be located adjacent to the driveways. A rear order menu
sign (20 square feet) will be located west of the building.
Thirty-four parking stalls are required for the eating establish-
ment and office building; 34 are prpposed. Three parking spaces,
including one handicap space, will be located dircctly bchind
KFC. Thirty-one spaces will be located on the COO D portion.
Six cars can be stacked in the drive-thru lane without obstructing
the driveway off of Baldwin Avenue. All parking spaces meet Code
requirements. Wheel stops are not shown.
Ingress to the lot will be from a 20-foot wide driveway on
Baldwin Avenue. Egress from the drive-thru will be from a
13-foot wide driveway south of the building. Cars not using the
. dri ve - thru mus t exit through the Si z zler lot and driveway.
A 26-foot driveway opening will be located along the southerly
property line between the Sizzler property and the KFC site.
This driveway will reduce the Sizzler parking by 3 (80 spaces
presently exist, 77 would remain). The Sizzler eating establishment
requires 86 parking spaces.
One hundred eighty-seven feet of the existing northerly Sizzler
wall will be removed.
The trash enclosure will be located behind the building. Land-
scaping exceeds Code requirement.
ANALYSIS
It is the Planning Dcpartment's opinion that this usc is compatible
with the zoning and Gcneral Plan.

Also staff feels this site is better suited for the proposed KFC
than their prior proposed application (C.U.P. 76-21) on the
Sizzler property.
The reduction in the Sizzler parking is insignificant. Staff
does not believe there will be a significant increase in traffic
out the Sizzler driveway than what would have been realized if the
KFC were on the same site as the Sizzler.

In order to facilitate proper development of the site, the
Planning Department recommends the following conditions:
1. That a covenant be filed with the owner of the Sizzler
property to ensure access to Baldwin Avenue.
2. That cars exiting onto Baldwin Avenue from the drive-thru and
the Sizzler driveway be restricted to "right hand turns
only."
3. That the "drive-thru" sign on Baldwin Avenue be eliminated.
Staff does not feel said signing is necessary.
4. To protect the proposed office building from thcdrive-thru
traffic, staff recommends a planting buffer be installed.
5. That planting be located north of the trash area for additional
screening.
If during peak hours the drive-thru lane creates a stacking problem
in the driveway that serves as access to the parking area, the
Planning Department would suggest that the applicant be willing
to close the drive-thru and restrict the use to walk-in/take-out.
Pursuant to the provisions of the California Environmental Quality
Act, the Planning Department has prepared an initial study for
the proposed project. Said initial study did not disclose any
substantial or potentially substantial adverse change in any
of the physical conditions within the area affected by the
project including land, air, water, minerals, flora, fauna,
ambient noise, and objects of historical or aesthetic significance.
Therefore, a Negative Declaration has been prepared for this
proj ect.
Before the Planning Commission takes action on this project, the
Commission should "move to approve and file the Negative
Declaration and find that the project will not have a significant
effect on the environment."
RECOMMENDATI ON
The Planning Department recommends approval of C.U.P. 77-5 subject
to the following conditions:
1. Conditions as outlined in the attached report from the
Director of Public Works shall be complied with to the
satisfaction of the Director of Public Works.
2. That a covenant in a form and content approved by the City
Attorney be filed guaranteeing access from the property at
841 Baldwin through 855 Baldwin.
