RESOLUTION NO. 977
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARCADIA GRANTING A CONDITIONAL
USE PERMIT TO OPERATE A GENERAL AUTO REPAIR
GARAGE AND TOWING SERVICE AT 149 LA PORTE
STREET.
WHEREAS, On January 21, 1977, an application was filed by
Orlando DePietro, Planning Department Case No. C.U.P. 77-3, to
operate an auto repair garage, towing dispatch office and auto parts
store on property commonly known as 149 La Porte Street, more
particularly described as follows:
Lot 13 of Santa Anita Tract in the City of Arcadia, County
of Los Angeles, State of California, as per map recorded
in Book 15, pages 89 and 90, of M.R., in the office of
the Recorder of said County.
WHEREAS, a public hearing was held on February 8, 1977, at
which time all interested persons were given full opportunity to
be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLYES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Planning
Department in the attached staff report is true and correct.
SECTION 2. This Commission finds that:
1. The granting of a conditional use permit as herein-
after provided will not be detrimental to the public health or
welfare or injurious to the property or improvements in such zone
or vicinity.
2. The use applied for at the location indicated is
properly one for which a conditional use permit is authorized.

3. The site for the proposed use is adequate in size
and shape to accommodate said use, including all yards, parking,
loading, landscaping and other features required to adjust said use
with the land and uses in the neighborhood.
4. The site abuts streets and highways adequate in
width and pavement type to carry the kind of traffic generated by
the proposed use.
5. The granting of such conditional use permit will
not adversely affect the General Plan.
6. The use applied for will not have a significant
effect on the environment.
SECTION 3. That for the foregoing reasons, subject to
approval of the City Council, this Commission grants a conditional
use permit to operate a general auto repair garage and towing service
upon the following conditions:
1. The property shall be improved and maintained in
accordance with plans on file in the subject Case No. C.U.P. 77-3.
2. Towed cars shall not be stored on the lot.
3. All repair work shall be done inside the building.
4. Vehicles being serviced by the garage shall not be
kept in the parking area.
5. The trash area shall be enclosed on three sides by a
6-foot high decorative block wall.
6. The parking area shall be restriped and comply with the
following regulations: Sections 9269.7B, 9269.8B, and 9269.9B.
Said parking plans shall be submitted to the Planning Department
prior to restriping.

7. Signing shall comply with Code.
8. The applicant shall file a lot consolidation for 149 and
153 La Porte Street no later than December 31, 1977. The buildings
at 153 La Porte shall be demolished and the property improved with
parking in compliance with the Zoning Ordinance.

SECTION 4. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.
I HEREBY CERTIFY that the foregoing resolution was
adopted at a regular meeting of the Planning Commission held on
the 22nd day of February, 1977, by the following vote:

9. Landscaping or screening to be provided along the
northerly property line adjacent to the alley. A landscape/screening
plan shall be submitted to the Planning Department for its review and
approval prior to installation.

APPLICATION
This application was filed on January 21, 1977, by Orlando John
DePietro and requests a conditional use permit to operate an
auto repair garage, dispatch office and auto parts store at
149 La Porte Street.
LAND USE AND ZONING
The subject site contains approximately 7,682 square feet, is
zoned M-I and is developed with an industrial building. Properties
to the north are zoned M-I and are vacant and developed with
apartments. Properties to the east are zoned M-I and developed
with single-family residences and a vacant lot. Properties to
the south are zoned M-I and developed with mixed residential
uses. Properties to the west are zoned M-I and developed with
mixed residential uses. (See the attached Land Use and Zoning
Map.)
PROPOSAL AND ANALYSIS
The applicant is proposing to operate a general auto repair
garage, a dispatch office for towing service and an auto parts
store (wholesale and retail) in the existing 2,178 square foot
building. The applicant has indicated (1) all repair work
and storage will take place inside the building, (2) towed
cars will not be stored on the premises and (3) that they work
on only 4-5 cars per day.

Parking will be located north of the building with access from
the alley. Seven parking spaces are proposed; 5 paiking spaces
are required.
A 3-foot high block wall is located along the easterly and
westerly property lines and a 6-foot high chain link fence and
gate are located along the northerly property line adjacent to
the alley. '
A trash enclosure is proposed adjacent to the northw~st corner
of the building.

The City has received several complaints from neighboring
residents that the garage is presently operating. Staff has
noted on several site inspections that tow trucks have been
parked on La Porte and on one occasion on the paved area
north of the alley. Also, on all occasions, the parking area has
been full with a minimum of 8-10 cars. The Planning Department
staff has been unable to determine if the applicant is operating
the garage. Several of the cars parked in the area seem to be
inoperable.
The applicant has been advised that operation of said business
without a business license and approved conditional, use permit
is a violation of the Arcadia Municipal Code.
The applicant has indicated his business has four tow trucks
and one small truck and will employ four people. Two of the tow
trucks are driven home by the employees during the evening.
The Planning Department believes that an automobile garage and
dispatch office for towing service is a compatible use in an
M-I zone, however, it is staff's opinion that seven parking
spaces are not adequate for the parkin~ of the tow trucks and
employees' vehicles as well as parking for the automobiles which
are to be serviced'and/or for people wishing to purchase auto-
motive parts. ' ,

Pursuant to the prOVISIons of the California Environmental Quality
'Act, the Planning Department has prepared an initial study for
the proposed project. Said initial study did not disclose any
substantial or potentially substantial adverse change in any
of the physical conditions within the area affected by the
project including land, air, water, minerals, flora, fauna,
ambient noise, and objects of historical or aesthetic significance.
Therefore, a Negative Declaration has been prepared for this
proj ecL
Before the Planning Commission takes action on this project, the
Commission should "move to approve and file the Negative

Declaration and find that the project will not have a significant
effect on the environment.
RECOMMENDATION
Because of the inadequate parking, the Planning Department
recommends denial of C. U. P. 77- 3.
If the Planning Commission wishes to approve this conditional
use permit, the following conditions should be required:
1. That towed cars not be stored on this lot.
2. That all repair work be done inside the building.
3. Vehicles being serviced by the garage shall not be kept in
the parking area.
4. That the trash area be enclosed on three sides by a 6-foot
high decorative block wall.
5. That the parking area be restriped and comply with the
