RESOLUTION NO. 975
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARCADIA GRANTING A ZONE VARIANCE
TO PERMIT A RESIDENTIAL LOT WITH A WIDTH OF
65 FEET IN LIEU OF 75 FEET AT 305 NORTH
FIFTH AVENUE.
WHEREAS, on January 10, 1977, Edwards-Newlin Investments
filed an application for a lot split and variance to permit a
residential lot with a width of 65 feet in lieu of 75 feet required
for property located at 305 Fifth Avenue and 306 Fourth Avenue, more

particularly described as follows:
A portion of the vacated Pacific Electric Railroad
right~of~way and Lot 8 of Tract 13949, in the City of
Arcadia, County of Los Angeles, as per map recorded in
Book 35, pages 25 and 26, of Maps, in the office of the
Recorder of said County.
WHEREAS, a public hearing was held on said matter on
January 25, 1977, at which time all interested persons were given
full opportunity to be heard and to present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the
Planning Department in the attached staff report is true and
correct.
SECTION 2. This Commission finds that:
1. There are exceptional or extraordinary circumstances
or conditions applicable to the property involved, or to the
. intended use of the property, that do not apply generally to the
property or class of use in the same zone or vicinity.

2. The granting of such variance will not be materially
detrimental to the public health or welfare or injurious to the
property or improvements in such zone or vicinity in which the
property is located.
3. That such variance is necessary for the preservation
and enjoyment of a substantial property right of the applicant
possessed by other property in the same zone and vicinity.
4. That the granting of such variance will not adversely
affect the comprehensive general plan.
SECTION 3. That for the foregoing reasons, subject to
approval of the City Council, this Commission grants a zone
variance for the division of existing property into a new lot with
a lot width of 65 feet in lieu of 75 feet upon the following
conditions:
1. That all utilities for new dwellings shall be under-
ground.
2. The applicant shall dispose of drainage water from
FoutthAvenue in a manner subject to the approval of the Director
of Public Works.
SECTION 4. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.

APPLICATION
This application was filed by Edwards-Newlin Investments on
January 10, 1977 and proposes to redivide two existing vacant
lots into two new residential lots.
LAND USE AND ZONING
The subject sites are vacant and zoned R-I. All adjacent
privately owned property is developed with and zoned for residen-
tial uses. The Foothill Freeway is adjacent to a portion of the
southern boundary of the subject site.
DEVELOPMENT ALTERNATIVES
The R-I zoning on the subject sites allows for such uses as
nursery schools, community buildings, private clubs, schools,
churches and parks with a conditional use permit. The proximity
of these lots to Eisenhower Park (on Second Avenue north of
Colorado Blvd.) would, in the opinion of staff, eliminate the
sites from consideration as a mini-park. The Planning Department
feels that many of the other aforesaid uses permitted with a
conditional use permit for this property would be less appropriate
than single-family dwellings.
PROPOSAL AND ANALYSIS
The applicant proposes to create two lots from an abandoned
remnant of the old Pacific-Electric right-of-way and residual
portion of a smaller lot adjacent to the Foothill Freeway.

The subject sites contain approximately 24,002 square feet and
would be divided into the following two new lots:

The application for a lot split requires a zone variance because
proposed Lot 2 would not meet, the standard Code requirement of
75 feet of street frontage. However, the applicant could con-
struct a new house in the same approximate area Lot 2 would
occupy. This apparent inconsistancy can be credited to the
Arcadia Municipal Code which permits construction on lots divided
prior to 1949. The remnant of the old Pacific-Electric right-of-
way would fall into the aforementioned category. Staff feels
the proposed lot split would be generally beneficial for the area
as it would eliminate a land-locked lot and provide for two
new single-family dwellings which could resolve any associated
property maintenance problems. '
In the opinion of the Planning Department staff, the existing
property meets the requirements for a zone variance. The
proposed division of this property is not materially detrimental
to the public health or welfare or injurious to the property
or improvements in the area and is located in such a position
(adjacent to a freeway and a portion of an abandoned right-of-
way) that could be considered exceptional or extraordinary.
The proposed lot split would create lots which are consistent
with the General Plan for the area.
Pursuant to the provisions of the California Environmental Quality
Act, the Planning Department has prepared an initial study for
the proposed lot split. Said initial study did not disclose
any substantial adverse change in any of the physical conditions
within the area affected by the project including land, air,
water, minerals, flora, fauna, ambient noise, and objects of
historical or ae.stheti.c significance. Therefore, a Negative
Declaration has becin prepared and filed for this project.
Before the City Council takes action on this project, the
Council should "move to approve and file the Negative
Declaration and find that the project will not have a signifi-
cant effect on the environment."

RECOMMENDATION
The Planning Department recommends approval of L-77-2 and V-77-1
subject to the following conditions:
1. Conditions as outlined in the attached report from the
Department of Public Works shall be complied with to the
satisfaction of the Director of Public Works.
2. That the Commission make the following findings:
a. That there are exceptional or extraordinary circum-
stances or conditions applicable to the property
involved, or to the intended use of the property,
that do not apply generally to the property or class
of use in the same zone or vicinity.
b. That the granting of such variance will not be
materially detrimental to the public health or wel-
fare or injurious to the property or improvements in
such zone or vicinity in which the property is located.
c. That such variance is necessary for the preservation
and enjoyment of a substantial property right of the
applicant possessed by other property in the same
zone and vicinity.
d. That the granting of such variance will not adversely
affect the comprehensive general plan.
3. That all utilities for new dwellings be underground.

P.E. Right-of-Way North of the 210 Freeway
Adjacent to Fourth and Fifth Avenues
The drainage from Fourth Avenue presently flows to Fifth Avenue through a ditch
on the northerly side of this property. The Pacific Electric Railroad Company,
present owners of this land, had agreed to dedicate a drainage easement to the
City. However, to date said easement has not been granted.
The following items should be made conditions of approval of subject lot split:
1. The preparation and recordation of a parcel map in accordance with the
requirements of the State Subdiv~on Map Act. The map shall be submitted
to the County Engineer for checking, and after checking, the County Engineer's
letter recommending approval and map shall be submitted to the City Engineer
for map certification. Concurrent with the map being submllted to the
County Engineer for checking, the applicant should submit a copy of the
City's conditional requirements to enable the County Engineer to check for
applicable conditions.
2. Dedicate right-of-way at the south end of Fourth Avenue to provide for a
12 foot parkway width. A 30 foot radius may be used to provide for this
dedication.
3. Dedicate a drainage easement, 10 feet in width lying along the northerly
side of Parcels 1 and 2. There shall also be a covenant in the new deeds
that will not allow the owners of said parcels to restrict the drainage
flow. The City will be responsible for the maintenance of the drainage
rlitch.
NoTE: It may be possible to divert drainage from Fourth Avenue into
an existing concrete channel on the northerly right-of-way
line of Route 210. Any connection to this channel will require
approval by the State Dept. of Transportation.
4. Install 6 inch sewer laterals to property line to serve Parcels 1 and
2. Obtain all necessary easements and permits for the construction of
sewer laterals.
5. Arrange for utility service and dedicate necessary easements to utility
companies.
