RESOLUTION NO. 967 A RESOLUTION OF THE PLANNING COMMISSION OF THE.CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR AN AUTOMOBILE STORAGE YARD AT 135-141 WHEELER AVENUE. WHEREAS, on November 29, 1976, an application was filed by the Arcadia Redevelopment Agency, Planning Department Case No. C.U.P. 76-28, on the property commonly known as 135-141 Wheeler Avenue, more particularly described as follows: Lots 9 and 10, Arcadia Santa Anita Tract, City of Arcadia, County of Los Angeles, State of California, as per map recorded in Book IS, pages 89 and 90, of M.R., in the office of the Recorder of said County. WHEREAS,a public hearing was held on December 14, 1976, at which time all interested persons .were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the' Plan- ning Department in the attached staff report is true and correct. SECTION 2. This Commission finds that: 1. The granting'of a conditional use permit as herein- after provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicnity. 2. The use applied for at the location indicated is -1- 967 . . . . . and shape to accommodate said use, including all yards, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the General Plan. 6. The use applied for will not have a SUbstantial adverse impact on the environment. SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a .conditional use permit for an automobile storage yard upon the following conditions: 1. The property shall be improved and maintained in accordance with plans on file in the SUbject Case No. C.U.P. 76-28. 2. That a.six-foot high fence be installed around the subject site and screen the parking lot from adjacent property. Screening material shall be submitted to the Planning Department for its approval prior to installation. 3. That the parking lot be cleared of all weeds and debris. 4. That lighting be installed on the site subject to the approval of the Planning Department. 5. Ingress and egress from the alley shall not be allowed. It is felt that vehicular towing operations would not -2- 967 . . . be desirable in a narrow alley. 6. That portion of Wheeler Avenue, which will serve as an entrance to the proposed parking lot, shall be paved in accordance with plans to be approved by the Director of Public Works. 7. That this conditional use permit shall run concurrent with a valid towing contract with the City for this lot. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. December 14, 1976 TO: PLANNING COMMISSION FROM: PLANNING DEPARTMENT SUBJECT: C.U.P. 76-28 135-141 WHEELER AVENUE APPLICATION This application was filed on November 29, 1976 by the City of Arcadia Redevelopment Agency and requests a conditional use permit to operate an automobile storage yard at 135-141 Wheeler Avenue. LAND USE AND ZONING The subject site contains two vacant lots zoned M-I. to the north, south, east and west are zoned M-I and with industrial and residential uses. (See attached and Zoning Map.) Properties developed Land Use PROPOSAL The subject site contains 16,000 square feet. A lot consolidation was approved for this site on November 9, 1976. The property is owned by the Redevelopment Agency and, at this time, is not earmarked for any specific project. The proposed automobile storage would be a temporary use of the property. A 6-foot high chain link fence with barbed wire encloses the property on the north, east and south. The fence on the south is located on City property, as is the gate on Wheeler. Entrance to the site would be from Wheeler Avenue only. There would be no access from the alley to the north. No buildings are proposed on the site. . . . . . C.U.P. 76-28 2 ANALYSIS An automobile storage yard is a permitted use in an M-I zone and is consistent with the General Plan designation of Industrial. This site would be used for a towing service operation which may have a police towing contract with the City. The Police Department has indicated it is desirable to have a site in close proximity to central Arcadia. The towing service would tow vehicles as requested by the Police Department, as well as other vehicles. The Public Works Department does not recommend removal of the fence located in the public right-of-way at this time. It is their opinion that the fence creates a barrier between the public right-of-way and the railroad tracks, and until such time as development takes place on said property, it is desirable to leave the fence in its present location. A 6-foot high fence should be constructed along the westerly property line. All fencing should screen the site from adjacent properties and public right-of-ways. Said screening should be of a material approved by the Planning Department. All weeds should be removed from the parking area, and the drive- way entrance from Wheeler Avenue should be paved as noted in the Public Works report. It is the recommendation of the Police Department and Planning Department that lighting be installed on the site. This would aid in preventing vandalism as well as assisting the police in their routine property checks. Pursuant to the provision of the California Environmental Quality Act, the Planning Department reviewed the proposed .project"and determined that the proposal would not have a significant adverse impact on the environment. A Negative Declaration has been pre- pared and filed for this project. Before the Planning Commission can act on this item, the Commission must first act on the Negative Declaration and "move to approve and file the Negative Declaration and find that the project will not have a substantial adverse impact on the environ- ment." The Commission may then proceed to act on this item. . . . , . C.U.P. 76-28 3 RECOHMENDATION The Planning Department recommends approval of C.U.P. 76-28 for an automobile storage lot subject to the following conditions: I. Conditions as outlined in the attached report from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works. 2. That the parking lot be cleared of all weeds and debris. 3. That a 6-foot high fence be installed around the subject site and screen the parking lot from adjacent property. Screening material shall be submitted to the Planning Depart- ment for its approval prior to installation. 4. December 3, 1976 TO: PLANNING DEPARTMENT FROM: DEPARTMENT OF PUBLIC WORKS SUBJECT: PROPOSED AUTOMOBILE STORAGE YARD AT 135 - 141 WHEELER AVENUE--TENTATIVE C.U.P. 76-28 The approved conditions of approval for Lot Split 76-20 required that deficient off-site improvements be constructed concurrent with the development of this property, However, the proposed use as an automobile storage yard does not require full development of this property, and it is recommended that complete street improvements not be required at this time. The following conditions of approval are recommended: 1. Ingress and egress from the alley shall not be allowed.
