RESOLUTION NO. 966
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARCADIA DENYING A CONDITIONAL
USE PERMIT FOR A RESTAURANT AT 101 WEST
HUNTINGTON DRIVE.
WHEREAS, on November 8, 1976, an application was filed by
Sambo's Restaurants for a restaurant, Planning Department Case
No. C.U.P. 76-26, on the property commonly known as 101 West
Huntington Drive, more particularly described as follows:
A portion of Lot 1, Tract 949, in the City of Arcadia,
County of Los Angeles, State of California, as per
map recorded in Book 17, pag~ 13, of Maps, in the
office of the Recorder of said County.
WHEREAS, a public hearing was held on November 23, 1976,
~ at which time all interested persons were given full opportunity
to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Plan-
ning Department in the attached staff report is true and correct.
SECTION 2. That the Commission finds that a precedent
of not allowing a 24-hour restaurant adjacent to a residential
area had previously been set; that the plans as submitted did not
meet Code parking and landscaping requirements; and that the grant-
ing of the conditional use permit could be detrimental to the
public health and welfare and injurious to the property or improve-

SECTION 3. That for the foregoing reasons, this

Commission denies the conditional use permit as requested by the
applicant.
SECTION 4. The Secretary shall certify to the adoption
'of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.

SAMBO'S RESTAURANT
APPLICATION
This application was filed on November 8, 1976 by Samba's
Restaurants and proposes to construct a restaurant at 101 West
Huntington Drive, the northwest corner of Huntington Drive ahd
Santa Clara Street.
LAND USE AND ZONING
The subject site comprises two lots under separate ownership which
contain a total area of 50,821 square feet. The lot on the
northwest corner of Huntington Drive and Santa Clara Street
contains 48,594 square feet, is vacant and zoned C-2. The second
lot fronts on San Rafael Road, contains 2,227.5 square feet, is
developed with an automobile garage which will be removed and
zoned C-2. Properties to the north are zoned R-I and developed
with single-family dwellings. Property to the east is zoned
C-2 D and developed with Huntington Ford Motors. Properties to
the south are zoned 5-2 and C-2 and developed with the Arcadia
County Park and the "100 to One" Club, respectively. Properties
to the west are zoned C-2 and developed with an office building,
a vacant lot and the Cinemaland theater building. (See the
attached Land Use and Zoning Map.)
HISTORY
On June 27, 1973, the City Council approved plans for a Hungry
Tiger Restaurant on this site. This restaurant had a floor area
of 8,645 square feet and proposed to operate from 7:30 a.m. to
2:00 p.m.
. PROPOSAL
The proposed restaurant will contain 4,573 square feet and be

open 24 hours. The seating capacity will be 119 persons. There
will be three shifts with 10 employees per shift.
The building will be 18 feet in height with concrete shake roof,
stucco facia with plywood trim, imitation stone veneer and
painted concrete block. The east elevation (Santa Clara Street)
will be painted concrete block.
The building will be set back 66 feet from Huntington Drive
property line and 11 feet from the proposed property line on
Santa Clara Street.
Restroom facilities meet Code requirements with the exception
thaI one additional urinal is required.
Forty-six parking spaces are required for this use; 71 are shown
on the plan. The applicant is requesting a modification to
allow 24 parking spaces located along the north property line to
be 17'6" in lieu of 20 feet required. A 5-foot landscape
buffer is required along the north property line. If cars are
allowed to overhang 2\ feet into this 5-foot planting area, the
effectiveness of this buffer is reduced.
The new parking requirements state that "planted area contained
in the required ~arkin~ space shall not be considered as part
of any requlred lmenSlons of landscape buffer." The plans also
show single-Ilne striping; hairpin striping is required.
Ingress and egress will be from driveways located on Huntington
Drive, Santa Clara Street and San Rafael Road. The driveway on
Huntington Drive is located approximately 45 feet from the inter-
section of Santa Clara Street and Huntington Drive.
Landscaping exceeds minimum Code requirements. The 5-foot
landscape buffer located along the northerly line will be
planted with ivy and a vine. Landscape berms will be located
in front of the building and in the northeast planting area.
A 6-foot high wall 267t feet in length is proposed along a
portion of the northerly property line. Code requires a 6-foot
high ornamental masonry wall to be installed where parking areas
abut ~esidentially zoned property.
The trash enclosure is located adjacent to the northeast corner
of the building and will be ~nclosed by walls and a gate.
The plans show a free-standing sign with approximately 252.8
square feet in lieu of 150 square feet allowed. The applicant
has indicated they are willing to design a sign which meets
Code requirements. They are also proposing a 16 square foot
"Par~ing Entrance" sign to be located on Santa Clara Street.

ANALYSIS
Restaurants are a permitted use in a C-2 zone with an approved
conditional use permit. This proposal is consistent with the
Commercial designation on the General Plan.
In order to ensure that the two lots will not be sold
separately in the future, a covenant should be recorded.
Staff does not believe that 17'6" stalls are adequate. Approval
of substandard parking spaces could set a precedent for future
developments.
Because of the close proximity of the driveway located on
Huntington Drive to the intersection, the Planning Department
recommends egress from said driveway be limited to right-hand
turns only.

The 5-foot landscape buffer along the northerly property line
should be planted with a material that would provide a better
buffer for the residential properties to the north.
The 6-foot high masonry wall along the north property line
should be extended the full length of the property line (338.65
fe et) .
The City, in the past, has not approved a 24-hour restaurant
operation adjacent to a residential area. The Planning Department
does not believe that such an operation is compatible with
residential properties and, therefore, would recommend that the
hours of operation be restricted to 6:30 a.m. to 1:00 a.m.
If the Commission allows th& l4,hour restaurant operation, it
may wish to alleviate potential noise problems for property
owners to the north by requiring the applicant to close the
rear portion of the parking area after 1:00 a.m.
Pursuant to the provision of the California Environmental Quality
Act, the Planning Department reviewed the proposed conditional
use permit and determined that the project would not have a
significant effect on the environment. A Negative Declaration
has been prepared and filed. The Initial Study and Negative
Declaration have been attached for your consideration.
The Planning Commission prior to its action must move to
approve and file the Negative Declaration and find that the project
will not have a substantial adverse impact on the environment.

RECOMMENDATION
The Planning Department recommends that this item be continued in
order to allow the applicant time to submit revised plans which

comply with Code. However, if the Planning Commission wishes to
proceed and approve this application, the Planning Department
recommends the following conditions of approval:
I. Conditions as outlined in the attached report from the
Department of Public Works shall be complied with to the
satisfaction of the Director of Public Works.
2. That a covenant approved by the City Attorney as to form and
content shall be recorded in the office of the County
Recorder guaranteeing that the parking located on the
lot fronting on San Rafael Road shall be maintained as long
as said buildings or land use is maintained at 101 West
Huntington Drive.
3. That a revised parking plan be submitted to the Planning
Commission for its review and approval which meets Code
requirements and contains essentially the same number of
parking spaces.
Egress from the driveway on Huntington Drive shall be
limited to "right hand turns~ only and posted accordingly.
That the 6-foot high wall extend the entire length of the
north property line.
That a revised landscaping plan be submitted to the Planning
Department for its review and approval prior to installation.
That signing meet Code requirements.
That the hours of operation be limited to 6:30 a.m. to
1:00 a.m.
That all deliveries be restricted to 7:00 a.m. through
10:00 p,m.
That restroom facilities comply with the Uniform Plumbing
Code.
Architectural treatment of the east wall shall be consistent
with the decorative treatment on the south elevation and
such plans be submitted to the Planning Department for its
review and approval.

Plans for the proposed development show that two parcels of property are to be
used. If a lot consolidation is required, this department may recommend conditions
in addition to those listed below.
The following conditions of approval are recommended for this conditional use
permit :
1. Dedicate a 25 ft. radius corner cut-off at the northwest corner of Santa
Clara St. and Huntington Drive; dedicate right of way to provide for a
parkway eight feet in width, on Santa Clara Street.
2.
Close existing driveway aprons not to be used; construct sidewalk on
Santa Clara Street in accordance with City Standards, including a handicap
ramp at the northwest corner of Santa Clara and Huntington; parkway tree
wells and trees shall be required in accordance with plans to be approved
by the Director of Public Works.
Note: The work required under this condition may be done concurrent
with construction of the development.
3.
Submit grading and drainage plan for approval of the Director of Public Works.
