RESOLUTION NO. 963 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR AN EATING ESTABLISHMENT AT 400 SOUTH BALDWIN AVENUE (MRS. SIMMONS PASTRIES) . WHEREAS, on October 21, 1976, an application was filed by Jack Dixon on behalf of Mrs. Simmons Pastries for an eating establish- ment, Planning Department Case No. 76-25, on the property commonly known as 400 South Baldwin Avenue (Santa Anita Fashion Park), more particularly described as follows: Parcell of Parcel Map 4626 in the City of Arcadia, County of Los Angeles, State of California, as per map recorded in Parcel Map Book 50-51. WHEREAS, a public hearing was held on said matter on November 9, 1976 at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Planning Department in the attached staff report is true and correct. SECTION 2. This Commission finds that: 1. The granting of a conditional use permit as herein- after provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. -1- 963 . . . , . . 3. The site for the proposed use is adequate in size and shape to accommodate said use, including all yards, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the General Plan. 6. The use applied for will not have a substantial adverse impact on the environment. SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a conditional use permit for the operation of an eating establishment upon the following conditions: 1. The property shall be improved and maintained in accordance with plans on file in the subject Case No. C.U.P. 76-25. 2. All conditions of City Council Resolution 4185 shall be complied with. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. November 9, 1976 TO: PLANNING COMMISSION FROM: PLANNING DEPARTMENT SUBJECT: C.U.P. 76-25 400 SOUTH BALDWIN AVENUE APPLICATION This application was filed on October 21, 1976 by Jack Dixon and proposes an eating establishment~in Santa Anita Fashion Park. LAND USE AND ZONING The subject site is zoned C-2 D & H and developed with Santa Anita Fashion Park. Properties to the north and east are zoned R-I and Sol and developed with the Santa Anita Race Track stables and parking lot. Properties located to the south are zoned C-2 and developed with commercial uses. Properties to the west are zoned R-I and CoO and developed with medium-density residential and a service station. PROPOSAL AND ANALYSIS The applicant proposes to operate a pastry shop with seating for approximately 16 persons located in the upper level of the mall near the Broadway store. The proposed eating establishment contains 1,348 square feet. Entrance will be from the mall area. Two restrooms are provided which meet the handicapped requirements but are short only one urinal to meet the Uniform Plumbing Code requirements. However, due to the limited seating capacity and the take-out nature of the business, staff does not believe the restroom requirements in the Uniform Plumbing Code are appropriate for this use. Pursuant to the provision of the California Environmental Quality Act, the Planning Department reviewed the proposed conditional use permit and determined that the proposal would not have a significant effect on the environment. A Negative Declaration has been prepared and filed for this project. . . . . . C.U.P. 76-25 2 The Negative Declaration and Initial Study have been attached for your consideration. The Planning Commission in its approval or denial of the proposed conditional use permit must make the determination that the proposed project would or would not have a substantial adverse impact on the environment. RECOMMENDATION The Planning Department recommends approval of C.U.P. 76-25 subject to compliance with all condition~ of City Council Resolution UBS.
