RESOLUTION NO. 960 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA RECOMMENDING APPROVAL OF TEXT AMENDMENT TO ALLOW ADMINISTRATIVE MODIFICATION OF CERTAIN EXISTING IMPROVE- MENTS CONSTRUCTED PRIOR TO THE ENACTMENT OF THE PRESENT CODE IN ZONES R-O, R-l AND R-2. WHEREAS, a public hearing was held on November 9, 1976 before the Planning Commission to consider expanding the authority of the administrative modification procedure to include R-2 lots containing one single-family dwelling and to include administrative modifications of existing improvements which do not comply with present Code requirements. . WHEREAS, all interested persons were given full oppor- tunity to be heard and to present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA RECOMMENDS TO THE CITY COUNCIL: SECTION 1. That Section 9292.2.3 of the Arcadia Municipal Code be amended to read as follows: "9292.2.3. AUTHORITY. Administrative modifications as may be necessary to secure an appropriate improvement may be granted upon the joint approval of the Planning Division and Building Division. Administrative modification may permit such modification of the side yard, rear yard, distance between buildings, existing garage size, existing front yard setback, existing building height, existing floor area of accessory ~ buildings, existing accessory buildings occupying more than -~ 960 . . . . . 25 percent of the rear yard, existing garage openings less than 20 feet from the street side lot line and existing lot coverage." SECTION 2. The Planning Commission finds that the public necessity, convenience, general welfare and good zoning practice justify the above recommendation. SECTION 3. The Secretary shall- certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. November 9, 1976 TO: PLANNING COMMISSION FROM: PLANNING DEPARTMENT SUBJECT: TEXT AMENDMENT NO. T.A. 76-10 AND RESOLUTION 960 RECOMMENDING CHANGES IN THE ADMINISTRATIVE MODIFICATION PROCEDURE On April 13, 1976, the attached staff report on this subject was presented to the Planning Commission as T.A. 76-4. On April 27, 1976, the Planning Commission passed Resolution 936 (attached) recommending specific changes in the existing administrative modification procedure. The City Council concurred with the judgment of the Planning Commission. However, a clerical error was made in the drafting of Ordinance 1565 and the following was omitted: "existing garage size, existing front yard setback, existing building height, existing floor area of accessory buildings,". The omission of these words changed the intended scope of the ordinance substantially. To correct Ordinance 1565 requires a new text amendment and resolution. To effect the earliest possible implementation, the Planning Department recommends approval of T.A. 76-10 and the attached Resolution 960 concurrently. PLANNING DEPARTMENT ~ THOMAS W. T.A. 76-4' REVISIONS TO ADMINISTRATIVE MODIFICATION PROCESS In the past two years, the Modification Committee has received several applications for modifications of existing legal improvements constructed prior to the present code. Because of the large number of ~lder dwellings in Arcadia there are a substantial number of homes which do not meet the current code standards and must apply for and receive a modification for these deficiencies prior to any new construction on the lot. This action takes a minimum of three weeks in processing, hearing and appeal period time. Staff feels a solution to this situation would be to include in the Administrative Modification process the following existing improvements which do not comply with present code requirements: 1. Front building setback. 2. Building height. 3. ,Floor area of accessory buildings. 4. Garage openings less than 20 feet from the street side lot line. 5. Lot coverage. 6. Accessory buildings occupying more than 25% of the rear yard. The Planning Department is also recommending that R-2 lots con- taining one single-family dwelling be included in the Administra- tive Modification process since a single-family dwelling is a permitted use in an R~2 zone. The Administrative Modification process requires all adjacent property owners to review and approve the applicant's proposed plans before they are accepted and reviewed by the Planning Department and Building Division. By .dding the aforementioned existing conditions and including the R-2 zone under the Administrative Modification procedure, the . . . . . T .A. 76-4 2 total processing time could be reduced to seven days in most cases. The Planning Department recommends that the following sections of the Arcadia Municipal Code be amended: "9292.2.2 CREATION. There is hereby created a procedure whereby certain modifications to lots containing one single- family dwelling and accessory buildings in Zones R-O, R-I and R-Z may be granted upon the joint approval of the Planning Division and Building Division."
