RESOLUTION NO. 958
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARCADIA GRANTING A CONDITIONAL
USE PERMIT FOR A HANDBALL/RACQUETBALL/
HEALTH CLUB AT 21 MORLAN PLACE.
WHEREAS, on September 27, 1976, an application was filed
by Dana Gaul and David Cubitt to operate a handball/racquetball/
health club, Plan~ing Department Case No. C.U.P. 76-22, at
21 Morlan Place, more particularly described as follows:
Portion of Lot 5, Tract 13768, in the City of Arcadia,
County of Los Angeles, State of California, as per map
recorded in Book 273, page 73, in the office of the
Recorder of said County.
WHEREAS, a public hearing was held on said matter on
. October 12, 1976, at which time all interested persons were given
full opportunity to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Planning
Department in the attached staff report is true and correct.
SECTION 2. This Commission finds that:
1. The granting of a conditional use permit as herein-
after provided will not be detrimental to the public health or
welfare or injurious to the property or improvements in such zone
or vicinity.
2. The use applied for at the location indicated is
properly ,one for which a conditional use permit is authorized.

3. The site for the proposed use is adequate in size
and shape to accommodate said use, including all yards, parking,
loading, landscaping and other features required to adjust said
use with the land and uses in the neighborhood.
4. The site abuts streets and highways adequate in width
and pavement type to carry the kind of traffic generated by the
proposed use.
5. The granting of such conditional use permit will not
adversely affect the General Plan.
6. The use applied for will not have a substantial
adverse impact on the environment.
SECTION 3. That for the foregoing reasons, subject to
approval of the City Council, this Commission grants a conditional
use permit to operate a handball/racquetball/health club upon the
following conditions:
1. The property shall be improved and maintained in
accordance with plans on file in the subject Case No. C.U.P. 76~22.
2. Existing asphalt sidewalk and drive apron on Morlan
Place shall be replaced with P.C.C. drive apron and sidewalk.
3. Grading and drainage plan of proposed parking lot
shall be submitted for review and approval of the Director of
Public Works.
4. That all landscape buffers and walls shall meet Code
requirements.
5. That the trash enclosure be located in an accessible
. area approved by the Planning Department.

6. That a modification be granted for 54 parking spaces in
lieu of 96 required.
7. That parking meet all Code requirements and that a
revised parking plan be submitted to the Planning Department for
its review and approval.
8. That the parking area at 149-159 Santa Anita be
redesigned and restripped to meet Code requirements.
9. That a covenant approved by the City Attorney as to
form and content shall be recorded in the office of the County
Recorder guaranteeing that access across the rear of the property
at 149-159 Santa Anita and that mutual use of the parking area on
said property shall be maintained as long as said building or land
use is maintained at 21 Morlan Place.
10. All signs shall comply with Code.
11. The conditional use permit shall terminate at the end
of a two-year period at which time said permit shall be subject to
renewal by the Planning Commission should the Commission find that
the parking is adequate. If the Commission finds that the parking
is inadequate, the permit may be renewed if the applicant
obtains additional parking to the satisfaction of the Commission.
No further filing fees shall be required.
SECTION 4. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the city of Arcadia.

APPLICATION
This application was filed on September 27, 1976 by Dana Gaul
and David CUbitt, and requests a conditional use permit to
operate a handball/racquetball/health club at 21 Morlan Place
(The Dome).
Lfu~D USE ANO ZONING
The subject site is zoned C-l D and developed with a vacant
building (the Arcadia Oome). Property to the north is zoned
C-l 0 and is vacant. Properties to the east are zoned C-l D
and developed with mixed commercial uses. Properties to the
south are zoned C-l 0 and, developed with offices and parking.
Properties to the west are zoned C-2 D and developed with a
motor vehicle storage lot, (See attached Land Use and Zoning
map. )
PROPOSAL AND ANALYSIS
The applicant is proposing to convert the existing buUding at
21 Morlan Place into a handball/racquetball/health club, The
site contains I,Ol+ acres. The existing building contains
18,844 square feet: The applicant is proposing an addition of
246 square feet, for a total area of 19,090 square feet,
The subject site has a frontage on ~lorlan Place of 211.48 feet.
There is no frontage on Santa Clara Street, Entrance to the
building will be on the north side.
The proposed use will have eight handball/racquetball courts,
viewing area, men and women's locker roem, exercise room, game
room, TV lounge, snack bar, eating area, office, employees'
lounge and laundry room.

Forty-one percent of the floor area is composed of courts and
exercise room.
Hours of operation will be from 7:00 a.m. to 11:00 p.m. The
applicant has stated that total membership will be 1~300, that
the peak hour is 6:30 p.m. and that occupancy during the peak
hour is 36 (4 staff, 32 members).
The proposed landscape buffers on Morlan Place do not meet Code
requirements. The parking lot could be designed to meet Code.
Interior landscaping exceeds Code requirements.
A trash enclosure is shown next to the building; however, its
location would not be easily accessible for trash pick-up.

Ninety-six parking spaces would be required for this use based
on the requirements for "other permitted uses" in the commercial
zone of 5 spaces per 1,000 square feet of gross floor area.
The applicant is requesting a modification for 46 spaces.
Vehicular access would be from Morlan Place. Vehicular access
to Santa Clara Street is proposed across the rear of the property
at 149-159 Santa Anita Avenue. There are 20 parking spaces
located on this property. If the parking lot were redesigned
to allow access from 21 Morlan Place to Santa Clara, the lot
could accommodate 20 spaces.
The applicant has submitted a revised parking plan for 58 spaces.
However, some of these spaces do not meet Code requirements.
Landscaping is decreased, but still exceeds the 3 percent Code
requirement. It is the opinion of staff that this plan could
be designed to facilitate a maximum of 54 parking spaces.
The property owner at 149-159 Santa Anita is also the owner of
21 Morlan Place. He has indicated that the majority of businesses
at his Santa Anita location close at 5:00 p.m. and this parking
area could be used for the proposed health club. Also, there is
an ample amount of on-street parking during the peak business
hours on Santa Clara Street and Morlan Place.

Staff believes that the proposed use is one of the least
intensive uses that would be permitted on this C-l lot. The
only other type of use which would be less intensive is a ware-
house, which would require a zone variance. The peak use
period is 6:30 p.m., after normal business hours. On-street
parking and the combined use of the parking lot at 149-159 Santa
Anita would alleviate the parking deficiency.
As noted in the applicant's application, attempts have been
made to secure additional property for parking.

The Planning Department has contacted the cities of Pasadena
and Glendale which have recently approved similar facilities.
Their parking requirements are 4 spaces per court, which they
feel is adequate.
The Planning Department recommends approval of a modification
to allow 54 parking spaces as per revised plans in lieu of
96 required. Approval of this modification would prevent an
unreasonable hardship on the applicant and property owner and
would allow a development which would create less of a demand
for parking than most other uses permitted in this zone.
A covenant should be filed with the County Recorder's office
guaranteeing access to Santa Clara Street across the rear of
the property at 149-159 Santa Anita and insuring mutual use of
"the parking area.
Pursuant to the provision of the California Environmental Quality
Act, the Planning Department reviewed the proposed conditional
use permit and determined that the proposal would not have a
significant effect on the environment. A Negative Declaration
has been prepared and filed for this project.
The Planning Commission in its approval or denial of the proposed
conditional use permit must make the determination that the
proposed project would or would not have a substantial adverse
impact on the environment.
RECOMMENDATION
The Planning Department recommends approval of C.U.P. 76-22,
subject to the following conditions:
1. Conditions as outlined in the attached report from the
Department of Public Works shall be complied with to the
satisfaction of the Director of Public Works.
2. That all landscape buffers and walls meet Code requirements.
3. That the ,trash enclosure be located in an accessible area
approved by the Planning Department.
4. That a modification be granted for 54 parking spaces in
lieu of 96 required.
5. That parking meet all Code requirements and that a revised
parking plan be submitted to the Planning Department for its
review and approval.
6. That the parking area at 149-159 Santa Anita be redesigned
and restripped to meet Code requirements.

Addition to No.6:
Located to the north of the subject site is a parcel of
approximately 6,000 square feet form~rly owned by the City
of Arcadia. It is the applicant's understanding that when
the 6,000 square foot parcel was sold to its present owner
(Babe Dahlgren), the City's intent was to have it joined
to the subject parcel (which Dahlgren owned at that time).
Unfortunately, the terms and conditions of sale did not
require a filing of a lot corisolidation and when the Arcadia
Dome was sol~ the ownership of the 6,000 square foot parcel
remained with Mr; Dahlgren. The p~operty owner in this
application is willing to correct this condition if the City
can require the consolidation at a fair market price established
by an independent appraiser.
Parking for said project is of the lowest in density of most
all uses for this site. We feel the project can easily
operate with existing parking and the above is a statement by
the owner of the site to participate with the City of
Arcadia.
