RESOLUTION NO. 955 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT TO OPERATE AN EXISTING CAR DEALERSHIP AND TO EXPAND MOTOR VEHICLE PARTS AND AUTOMOBILE PREPARATION CENTER AT 333 EAST HUNTINGTON DRIVE. WHEREAS, on July 26, 1976, an application was filed by Arcadia Datsun to operate an existing car dealership and to expand a motor vehicle parts and an automobile preparation center, Planning Department Case No. 76-17, on the property commonly known as 333 East Huntington Drive, more particularly described as follows: . Portions of Lots 3 and 4, Block 84 of Santa Anita Tract, in the City of Arcadia, County of Los Angeles, State of California, as per map recorded in Book 34, pages 41 and 42, of Miscellaneous Records in the office of the County Recorder of said County. WHEREAS, public hearings were held on August 10, August 24, and September 14, 1976 at which times all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Planning Department in the attached staff report is true and correct. SECTION 2. This Commission finds that: 1. The granting of a conditional use permit as herein- after provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone 4It or vicinity. 2. The use applied for at the location indicated is -~ 955 . . . properly one for which a conditional use permit is authorized. 3. The site for the proposed use is adequate in size and shape to accommodate said use, including all yards, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width I and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the General Plan. 6. The use applied for will not have a substantial adverse impact on the environment. . SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a conditional use permit to operate an existing car dealership and to expand a motor vehicle parts and automobile preparation center upon the following conditions: 1. The unpaved areas on the subject site which are used for parking, vehicle storage and/or access shall be paved subject to the approval of the Public Works Department and the Planning Department. 2. The driveway extending north from Huntington Drive shall be repaired in those areas designated by staff and in a manner approved by the Public Works Department. 3. Such lights shall be hooded and screened from adjacent properties and streets. 5. A landscape planter with the elimination of a three- foot high wall similar to those existing shall be installed in the areas used in the operation except for the Zerell property and a I~ landscape planter shall be installed on the Zerell property within ~' , . , . three years or on the acquisition of said property, whichever date occurs first. 6. All materials stored outside and on the building roof shall be removed and/or stored inside a building. 7. The Planning Department shall review the site annually for compliance with the conditions of this permit. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. August 10, 1976 TO: PLANNING COMMISSION FROM: PLANNING DEPARTMENT SUBJECT: C.U.P. 76-17 333 EAST HUNTINGTON DRIVE APPLICATION This application was filed on July 26, 1976 by Arcadia Datsun and requests a conditional use permit for the existing car dealership and to expand the motor vehicle parts storage and preparation area at 333 East Huntington Drive and 25 North Fourth Avenue LAND USE AND ZONING The subject site is zoned C-2 D and M-l and developed with Arcadia Datsun and City-owned property. Properties to the east are zoned M-l and developed with the Santa Anita Wash and indus- trial uses. Properties to the south are zoned C-2 D and developed with motels, an eating establishment, residential dwellings and mixed commercial uses. Properties to the west are zoned C-2 D and M-l and developed with a body shop, single-family residences and commercial uses. Property to the north is vacant and zoned M-l. (See the attached Land Use and Zoning Map.) PROPOSAL AND ANALYSIS The applicant is proposing to lease 68,750 square feet of City- owned property located at 25 North Fourth. This property con- tains a masonry building which has approximately 7,000 square feet of floor area. The existing motor vehicle sales site contains 111,016 square feet. There is no conditional use permit for the existing_operation. No improvement other than renovation of the masonry building on the City property is proposed on the entire site. This build- ing will be used for parts, storage and new car preparation center. The land north of the masonry building and extending northwest and southeast is unpaved. Cars are often parked in this area. . . . . . C.U.P. 76-17 2 The Municipal Code requires that parked or stored motor vehicles be located on paved surfaces only. The driveway running north from Huntington Drive has several potholes and depressions which should be repaired. Ma terial. is being requires is stored on Building "C's" roof. Also some material stored outside of buildings. The Arcadia Municipal Code that all goods and materials be stored inside a building. , The string lights located in the used car lot are nonconforming. Section 9263.6.1 requires lighting to be "hooded and arranged to reflect away from adjoining properties and streets. Light standards shall be a maximum. IS inches in height." A modification was granted to Arcadia Datsun on December 10, 1974 to allow installation of 20-foot high light standards to replace the non- conforming string lights. These were never installed. A 2-foot wide planter is located in front of Building "A" and in front of the used car lot. However, no landscaping buffer is located in front of the covered parking or along the most easterly parking area fronting on Huntington Drive. The property north of the proposed site is also City-owned. To ensure that this property will not be used, a fence with access gate should be installed along the northerly perimeter of the leased' property. The Planning Department believes that the proposed use of the property would not be detrimental to the area. However, staff would encourage proper maintenance of the entire site. Pursuant to the provision of the California Environmental Quality Act, the Planning Department reviewed the proposed conditional use permit and determined that the proposal would not have a significant effect on the environment. A Negative Declaration has been prepared and filed for this project. The Planning Commission in its approval or denial of the proposed conditional use permit must make the determination that the proposed project would or would not have a substantial adverse impact on the environment. RECOMMENDATION The Planning Department recommends approval of C.V.P. 76-17 subject to the following conditions: 1. That the area shown on the subject site as unpaved be paved subject to the approval of the Publii Works Department. 2. That the driveway extending north from Huntington Drive be repaired in those areas designated by staff and approved by the Public Works Department. . . . . . C.U.P. 76-17 3 3.
