RESOLUTION NO. 954
A RESOLUTION OF THE PUU~NING COMMISSION OF
THE CITY OF ARCADIA RECOMMENDING APPROVAL
OF A TEXT AMENDMENT RELATING TO SELF-
SERVICE STATIONS, TO PERMIT SUCH STATIOnS
IN A C-O OR ANY LESS .RESTRICTIVE COMMERCIAL
OR INDUSTRIAL ZO~E ON A CONDITIONAL USE
PERMIT BASIS.
WHEREAS, public hearings were held on August 24, 1976
and September 14, 1976 before the Planning Commission to
consider amending the conditional use permit section of the Arcadia
Municipal Code to allow self-service stations; and
WHEREAS, all interested persons were given full opportunity
to be heard and to present evidence;

NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA RECOMMENDS TO THE CITY COUNCIL:
SECTION 1. That Section 9275.4.14 of the Arcadia
Municipal Code be deleted.
SECTION 2. That Section 9275.1.39.2 be added to read
as follows:
"9275.1.39.2. AUTOMOBILE SELF-SERVICE STATIONS. C-O or
any less restrictive commercial or industrial zone'."
SECTION 3. That Section 9275.4.7 (3) be added as follows:
"9275.4.7. ACTIVITIES PERMITTED AND PROHIBITED.
3. Automobile Self-Service Stations. Self-service
gasoline dispensing shall be permitted provided that approved
. dispensing such as, but not limited to, remote control, token-
operated and card-operated types are used. Said use shall comply

with requirements of the Fire Department. There shall be at least
one qualified attendant on duty at all times while the station is
open to the public, for each 16 single dispensing units or
combination thereof. It shall be the responsibility of the
attendant to supervise, observe and control the dispensing of
gasoline, to prevent the dispensing of gasoline into portable
containers that are not approved as per Section 15.703(d) of the
Fire Code, control sources of ignition, to immediately handle
accidental spills and fire extinguishers if needed and to lend
assistance to handicapped persons in the dispensing of gasoline.
At an automobile self-service station no activities other
than the following shall be conducted: dispensing ga~oline,
oil, grease, tires, batteries and automobile accessories directly
to users of motor vehicles; tuning motors; wheel and brake adjust-
ment and other minor repairs and servicing of motor vehicles
only to the extent of installation of tires, batteries and
automobile accessories directly to users of motor vehicles; con-
ducting a commercial towing service by the operator of such self-
service station, provided that wrecked or damaged vehicles shall
not be towed to, nor stored upon, such service station property.
All other activities are prohibited including, but not limited
to, upholstering work, auto glass work, painting, welding, tire
recapping, and auto dismantling. There shall be no distribution
or sale on the subject site of food, carbonated drinks and cigarettes
except from dispensers within a building, or other items not
incidental to the operation of motor vehicles. There shall be no
storage, sale, display or advertisement for sale or lease of

motor vehicles,trucks or trailers on the subject site."
SECTION 4. The Planning Commission finds that the public
necessity, convenience, general welfare and good zoning practice
justify the above recommendation.
SECTION 5. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.
I HEREBY CERTIFY that the foregoing resolution was
adopted at a regular meeting of the Planning Commission of the
City of Arcadia held on the 28th day of September, 1976, by the

REVISION OF ZONING ORDINANCE TO
PERMIT SELF-SERVICE STATIONS
An application was filed by Pan Nova, Inc., on August 4, 1976
requesting that the City's Zoning Ordinance be amended to allow
self-service automobile stations.
The application ~equests amendment of Section 9275.4.14 of
the Arcadia Municipal Code which reads:
"Service Station Operation. No service stations shall be
operated in a self-service manner."
The applicant is proposing that this section be amended to read:
"Self-service gasoline dispensing shall be permitted provided
that approved dispensing such as,' but not limited to, remote
control, token-operated and card-operated types are used; and
that there is at least one qualified attendant on duty at all
times while the station is open to the public, The attendant's
sole function shall be to supervise, observe and control the
Jispensing of gasoline. It shall be the responsibility of
the attendant to prevent the dispensing of gasoline into
portable containers that are not approved. control sources of
ignition, and to immediateLy h~ndle accidental spills and
.fire extinguisher if needed." .
In the July-August ]973, ASPO report on service stations, it
was noted that "while service stations as a whole appear to be
declining in absolute numbers, self-service operations are
growing." It is estimated that "self-service stations will
ultimately get 30-40% of the market."
The Planning Department believes there is a need for self-
service stations and that they should be allowed in the City.
However, staff recommends that self-service stations be subject
to the same restrictions as automobile iervice stations and

that prior to operation must receive a conditional use permit.
This would also include conversion of a regular automobile
service station to a self-service operation in order to ensure
suitability of the site for a self-service station, and to bring
the station into conformance with Code requirements. The Fire
Department has indicated there would be no problems with self-
service stations as long as they complied with all regulations
of the Fire Code.
Staff recommends that Section 9275.4.14 regarding service
station operation be deleted, and that the following sections
be included:
"9275.1.39.2. AUTOMOBILE SELF-SERVICE STATIONS. C-O or any
less restrictive commercial or industrial zones."

the public necessity, convenience, general welfare and good zoning

Self-service has been a gasoline marketing practice since
1945 and has expanded to virtually every state in the nation.
In California, over 50% of all gasoline sold is throu~h self-
service gasoline pumps,
Self-service has an unparalleled safety record. and these type
of stations are cleaner than conventional stations because
greater emphasis is placed on cleanliness, which is an impor-
tant part of self-service retailing.
Most major branded dealers offer self-service on at least one
pump island, and all the communities surrounding Arcadia offer
self-service. Therefore, it can be assumed that a portion of
Arcadia's residents shop outside the city limits in order to
use self-service and save money,
Self-serve dispensing of gasoline has given the customer the
opportunity to purchase gasoline at a savings of 5~ - 7~ a
gallon under major branded stations, Coupled with 24 hour
availability, 365 days a year, this type of operation not only
meets the public necessity, but exceeds anything in operation
within the city at this present time; and makes the purchasing
of gasoline more pleasant, easy and economical for the custome~.

ARCADIA MUNICIPAL CODE requires a filing fee of $200.00 to be paid at
the time of filing an application for a text amendment. This fee is to
partly cover the ~ost to the City of advertising, investigations and
handling the application through its various stages.
