RESOLUTION NO. 953
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARCADIA GRANTING A CONDITIONAL
USE PERMIT FOR AN EATING ESTABLISHMENT AT
221 EAST FOOTHILL BOULEVARD.
WHEREAS, on August 30, 1976, Hsing-Yao Fang filed an
application for an eating establishment, Planning Department Case
No. 76-19, on the property commonly known as 221 East Foothill
Boulevard, more particularly described as follows:
Lot 3, Tract 12834 in the City of Arcadia,
County of Los Angeles, State of California,
as per map recorded in Book 226, page 24,
in the office of the Recorder of said County.
WHEREAS, a public hearing was held on said matter on
... September 14, 1976 at which time all interested persons were
given full opportunity to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Planning
Department in the attached staff report is true and correct.
SECTION 2. This Commission finds that:
1. The granting of a conditional use permit as herein-
after provided will not be detrimental to the public health or
welfare or injurious to the property or improvements in such zone
or vicinity.
2. The use applied for at the location indicated is
properly one for which a conditional use permit is authorized.

3. The site for the proposed use is adequate in size
and shape to accommodate said use, including all yards, parking,
loading, landscaping and other features required to adjust said
use with the land and uses in the neighborhood.
4. The site abuts streets and highways adequate in width
and pavement type to carry the kind of traffic generated by the
proposed use.
5. The granting of such conditional use permit will not
adversely affect the General Plan.
6. The use applied for will not have a substantial
adverse impact on the environment.
SECTION 3. That for the foregoing reasons, subject to
approval of the City Council, this Commission grants a conditional
use permit for the operation of an eating establishment upon the
following conditions:
1. That the property shall be improved and maintained
in accordance with plans on file in the subject Case No. C.U.P. 76-19.
2. That a trash enclosure be provided as per Section
9263.6.6 of the Arcadia Municipal Code and that said plans for a
trash enclosure be submitted to the Planning Department for its
review and approval.
3. Seating shall be limited to 16 people.
SECTION 4. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.

221 EAST FOOTHILL BLVD.
APPLICATION
This application was filed on August 30, 1976 by Hsing-Yao
Fang and requests to operate an eating establishment at 221 East
Foothill Blvd, Ralph's Shopping Center.
. LAND USE AND ZONING
The subject site contains four lots, is zoned C-2 D and is developed
with a shopping center. Properties to the north are zoned
C-2 D & R-l and developed with Ralph's loading area and single-
family dwellings. Properties to the east are zoned C-2 and PR-l
and developed with mixed commercial uses, eating establishments
and parking. Properties to the south across Foothill Boulevard
are zoned C-2 and developed with offices and residential uses.
Property to the west is zoned C-2 D and developed with Ralph's
market. (See attached Land Use and Zoning Map.)
PROPOSAL AND ANALYSIS
The applicant is presently operating Her Royal Majesty's Fish
and Chips in Ralph's Shopping Center. This shopping center
contains four lots which are under two separate ownerships. The
market is located on three lots (which have one ownership) and
the shops are located on a fourth lot which is under separate
ownership.

The applicant is proposing to add four tables which will seat
16 people. There is presently one table with four chairs and
five with student arms in the establishment. A conditional use
permit was not obtained when thes~ were put in the store.
The restauran~ contains 1,600 square feet, 380 square feet is
dining area, 200 square feet is kitchen area and the remainder

is storage and restrooms. There are two restrooms located at
the rear of the building which are shared by the applicant and
the shoe repair shop.
Because of the take-out nature of the business and the limited
seating, staff does not believe the restroom arrangement would
create any problem.
The shopping center contains 144 parking spaces, 210 spaces are
required by Code. The site is substandard in terms of parking,
landscaping, buffers and trash enclosures.
Any major improvements to the site would create a substantial
burden to the applicant. The Planning Department, however, does
recommend that a trash enclosure.be provided for this use at
the rear of the building.
Pursuant to the provision of the .California Environmental
Quality Act, the Planning Department reviewed the proposed
conditional use permit and determined that the proposal would
not have a significant effect on the environment. A Negative
Declaration has been prepared and filed for this project.

The Planning Commission in its approval or denial of the pro-
posed conditional use permit must make the determination that
the proposed project would or would not have a substantial
adverse impact on the environment.
RECOMMENDATION
The Planning Department does not believe the addition of 16 seats
to the fish and chips eating establishment would generate
increased traffic and recommends approval of C.U.P. 76-19
subject to the following conditions:
1. That a trash enclosure be provided as per Section 9263.6.6
of the Arcadia Municipal Code and that said plans for a
trash enclosure be submi~ted 'to the Planning Department
