RESOLUTION NO. 946 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A COlmITIONAL USE PERMIT FOR AN EATING ESTABLISHMENT AT 400 SOUTH BALDWIN AVENUE. WHEREAS, on July 12, 1976, an application was filed by Richard Schanz and Andre Oviedo to operate an eating establishment, Planning Department Case No. C.U.P. 76-14, on property commonly known as 400 South Baldwin Avenue, more particularly described as follows: Parcell of Parcel Map 4626 in the City of Arcadia, County of Los Angeles, State of California, as recorded in Book 51, page 50, in the office of the Recorder of said County. WHEREAS, a public hearing was held on said matter on July 27, 1976 at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Plan- ning Department in the attached staff report is true and correct. SECTION 2. This Commission finds that: 1. The granting of a conditional use permit as herein- after provided will not be detrimental to the public health or 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. -1- 946 . i I , i I I I ! I i i I. . . . 3. The site for the proposed use is adequate in size and shape to accommodate said use, including all yards, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the General Plan. 6. The use applied for will not have a substantial adverse impact on the environment. SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a conditional use permit for an eating establishment provided that the property shall be improved and maintained in accordance with the plans which are on file in C.U.P. 76-14 and applicable provisions of Resolution No. 4185. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. -2- 946 !. I I I i ! i I I i I' , !. July 27, 1976 TO: PLANNING CO~WISSION FROM: PLANNING DEPARTMENT SUBJECT: C.U.P. 76-14 400 SOUTH BALDWIN AVENUE APPLICATION This application was filed on July 12, 1976 by Richard Schanz and Andre Oviedo and proposes to operate an eating establish- ment in Santa Anita Fashion Park. LAND USE AND ZONING The subject site is zoned c-2 D & H and developed with Santa Anita Fashion Park. Properties to the north and east are zoned R-l and S-l and developed with the Santa Anita Race Track stables and parking lot, Properties located to with commercial uses. and c-o and developed service station. the south are zoned c-2 and developed Properties to the west are zoned R-l with medium density residential and a PROPOSAL AND ANALYSIS The applicant proposes to operate a pizza parlor with booth seating for 12, located in Space D-3 of the lower level near Kaplan's Restaurant. The proposed eating establishment contains 875 square feet. Entrance will be from the mall. Only one restroom is provided, however, due to the limited seating and take-out nature of the business, staff ~6es not' believe this is a problem. Eighteen parking spaces would be required for the proposed eating establishment. The shopping center contains 5,090 parking spaces; 4,847 spaces are required as per code. Seven restaurants and 4 eating establishments are presently locate~ in the mall. . . . . . C,U.P. 76-14 2 Pursuant to the provision of the California Environmental Quality Act, the Planning Department reviewed the proposed conditional use permit and determined that the proposal would not have a significant effect on the environment. A Negative Declaration has been prepared and filed for this project. The Planning Commission in its approval or denial of the proposed conditional use permit must make the determination that the proposed project would or would not have a substantial adverse impact on the environment. RECOMMENDATION The Planning Department recommends approval of c.D.P. 76-14 subject to compliance with all conditions of City Council Resolution 4185. DEPARTMENT ~ D NNA L.
