RESOLUTION NO. 1082 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA AMENDING CONDITION 16 OF RESOLUTION 974 GRANTING A CONDITIONAL USE PERMIT TO OPERATE A HANDBALL/RACQUET- BALL CLUB AT 1001 SOUTH FIRST AVENUE. WHEREAS, on December 1, 1978, a request was filed by John G. Valentine on behalf of the Arcadia All-Pro Athletic Club to amend Condition 16 of Resolution 974, granting Conditional Use Permit 77-2 to operate a handball/racquetball club at 1001 South First Avenue, more particulary described as follows: Lots 9, 10, 11, 12, 13, 14 and 15 of Tract 13252 in the City of Arcadia, County of Los Angeles, State of California, as per map recorded in Map Book 345, pages 6-8 in the office of the Recorder of said County. WHEREAS, a public hearing was held on January 23, 1979, at which time all interested persons were given full opportunity to be heard and to present evidence: HOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the factual data submitted by the Plan- ning Department in the attached staff report is true and correct. SECTION 2. This Commission finds that the on-site sale of beer and wine will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. SECTION 3. That for the foregoing reason, subject to approval of the City Council, Condition 16 of Resolution 974 should be amended to read: -1- 1082 . . . . ' "16. The sale of beer and wine shall be permitted on the site. The sale and consumption of alcoholic beverages shall be restricted to the second floor snack bar lounge area." SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. BUTLER ASSISTANT PLANNER Attached is a letter from John Valentine requesting amendment of Condition 16 of Resolution 974 which prohibits the sale of alcoholic beverages on the site. The Planning Commission at its January 9, 1979 meeting requested that a public hearing be scheduled on this item. Public hearing notices were mailed on January 12, 1979 to all property owners within 300 feet of the subject site. In the original application submitted by Starwood Leisure Company,' it was stated that there would be a "snack bar serving health food drinks..." and this condition was based on that information. Since this time, however, there has been a change in the applicants. Mr. Valentine indicated they would like to serve beer and wine on the second floor lounge area. The applicant has submitted a list Of clubs that, serve beer and wine. It is staff's opinion that the on site sale of beer and wine is an ancillary use to the racquetball club operation. The Planning Department recommends that Condition 16 of Resolution 974 be amended to read: "The sale of beer and wine shall be permitted on the site. The consumption of alcoholic beverages shall be restricted to the second floor snack bar lounge area." The majority of all racquetball facilities offer beer and wine and we would like to be able to do the same. We are interested only in beer and wine and the sale and consumption of said beverages will be restricted to the second floor snack bar lounge area.
