RESOLUTION NO. 1079
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARCADIA GRANTING A CONDITIONAL
USE PERMIT FOR A DRIVE-THRU EATING ESTAB-
LISHMENT AT 9974 LAS TUNAS DRIVE.
WHEREAS, on August 21, 1978 an application was filed by
Volunteer Quality Foods, Inc. for a drive-thru eating establishment,
Planning Department Case No. C.U.P. 78-16, on the property commonly
known as 9974 Las Tunas Drive, more particulary described in
attached Exhibit "A".
WHEREAS, a public hearing was held on said matter on
December 12, 1978 at which time all interested persons were given
full opportunity to be heard and to present evidence;

NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Plan-
ning Department in the attached staff report is true and correct.
SECTION 2. This Commission finds that:
1. The granting of a conditional use permit as herein-
after provided will not be detrimental to the public health or
welfare or injurious to the property or improvements in such zone
or vicinity.
2. The use applied for at the location indicated is
properly one for which a conditional use permit is authorized
3. The site for the proposed use is adequate in size
and shape to accommodate said use, including all yards, parking,
~ loading, landscaping and other features required to adjust said
use with the land and uses in the neighborhood.

4. The site abuts streets and highways adequate in width
and pavement type to carry the kind of traffic generated by the
proposed use.
5. The granting of such conditional use permit will not
adversely affect the General Plan.
6. The use applied for will not have a significant
effect on the environment.
7. The proposed use complies with all requirements set
forth for the issuance of a conditional use permit.
8. The proposed use will not substantially increase
vehicular traffic on any street in a residentially zoned district.
9. The proposed use will not lessen the suitability of
any nearby commercially zoned property for commercial use by
interfering with pedestrian traffic.
10. The proposed use will not create increased traffic
hazards to pedestrians when located near a school, church,
auditorium. theater or other place of assembly.
SECTION 3. That for the foregoing reasons, subject to
approval of the City Council, this Commission grants a conditional
use permit for operation of a drive-thru eating establishment upon
the following conditions:
1. The property shall be improved and maintained in
accordance with plans on file in the subject Case No. C.U.P. 78-16.
2. A 2S-foot radius corner cut-off shall be dedicated
for street purposes at the southwest corner of Baldwin Avenue
and Las Tunas Drive.

shall be removed and replaced. A handicap ramp shall be constructed
at the southwest corner of Baldwin Avenue and Las Tunas Drive.
Parkway trees shall be planted in accordance with plans to be
approved by the Director of Public Works.
4. A grading and drainage plan shall be submitted for
approval of the Director of Public Works.
5. ,C.U.P. 78-16 shall not take effect until the owner and
applicant have executed a form available at the Planning Department
indicating acceptance of the conditions of approval.
6. All parking, landscaping, buffers and walls shall
comply with Code.
7. All signing shall comply with Code.
8. A final parcel map shall be approved and filed with
the County Recorder's office prior to the expiration of the
tentative parcel map.
9. A new trash enclosure be provided for the existing
building and that the existing trash/storage area be removed.
10. All lighting shall comply with Code.
11. A covenant shall be recorded in the office of the
County Recorder in a form and content approved by the City Attorney
that the owner of the lots at 9956 and 9974 Las Tunas Drive will
hold and develop the lots as one parcel.
12. The lease of any structures on the subject properties
included in L-78-26 (9956 and 9974 Las Tunas) shall be a lease of
airspace only.

PARCEL 1:
That portion of lot 1 in block "w" of Santa Anita Land
Company's Tract, as per map recorded in book 6 page 137
of Maps in the office of the county recorder of said
county, described as follows:

Beginning at the intersection of the southerly line of
Las Tunas Drive with the westerly line of Baldwin Avenue,
as hath were established by the final decree of condemna-
tion entered in Case No. 269622, Superior Court of said
county: a certified copy of which being recorded on
August 18, 1933 as instrument No. 354 in book 12289 page
277 of Official Records of said county; thence along said
westerly line of Baldwin Avenue, South 80 50' East 62.96
feet; thence at right angles to said westerly line, South 810
10' West 110.00 feet; thence at right angles North 80 50'
West 106.86 feet to a point in said southerly line of
Las Tunas Drive, said point being in a curve concave south-
westerly having a radius of 450 feet, a radial line of
said curve through said point hears North 50 21' 32" East;
thence southeasterly along said curve, through a central
angle of 150 01' 38", an arc distance of 118.02 feet to
the end of said curve: thence tangent to said curve, ~outh
690 36' 50" East n.77 of a foot to the point of beginning.
PARCEL 2:
An easement and right of way for passage over that portion
of said lot 1 in block "w" of Santa Anita Land Company's
Tract included within a strip of land 30 feet wide and extend-
ing from the said westerly line of Baldwin Avenue (as
described in said final decree of condemnation entered in
,Case No. 269622, Superior Court) to the southerly prolongation
of the westerly line of the land described in parcel 1 above:

SECTION 4. The Secretary shall certify to the' adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.

drive-thru eating establishment
The subject site contains two lots, one with a
vacated market and the other with a vacated
service station, and is zoned C-2 and R-3 P
(southerly 100 feet).
The subject property contains a total area of
98,528 square feet.
The two lots contain approximately 369 feet of
frontage on Las Tunas Drive and approximately 223
feet of frontage on Baldwin Avenue.

SPECIAL INFORMATION
On December 13, 1977, a Pizza Hut restaurant was approved south
of the proposed location for the Wendy's drive-thru. This
application has expired and the property owner has advised staff
that a new application will not be filed.
The existing service station will be removed. The property owner
has stated that the vacant market which contains 19,200 square
feet will be used for a retail business.
Proposed Wendy's Drive-Thru
Size: 2,400 square feet with seating for 78 persons,
Exterior Design: Brick veneer with resawn trim and facia.
The restaurant will be located at the northeast corner of the
subject property, approximately 20 feet from the Baldwin Avenue
property line and approximately 45 to 69 feet from the Las
Tunas property line. The site presently consists of two lots
which the applicant is proposing to consolidate (L-78-26).

A trash enclosure is proposed for the eating establishment, south
of the building. Presently, there is a trash/storage area located
south of the market, which does not comply with Code. This
trash area should be removed and a new trash enclosure, which
complies with Code, should be provided for the vacant market.
Parking and Landscaping
One hundred and seventy (170) 9-feet by 20-feet parking spaces
are proposed on the site; 144 parking spaces are required, 48 for
the eating establishment and 96 for the existing building (based
on five parking spaces per 1,000 square feet of gross floor
area) .
The drive-thru lane is located north, south and east of the
eating establishment, This lane will stack five cars and circulate
traffic through the drive-thru without interfering with the
traffic circulation on the site.
Ingress and egress to the parking lot will be from five driveways:
two located on Baldwin Avenue, two on Rowland Avenue and one on
Las Tunas Drive.

A five-foot wide landscape planter is proposed along the perimeter
of the property as well as a wall to screen parking from the
streets and residential properties to the south. There is an
existing wall located along the southerly property line, This
wall is damaged and in need of major repairs.

The Public Works Department is requiring a 25-foot radius corner
cut-off at Baldwin Avenue and Las Tunas Drive. This requirement
will reduce the landscape planter in this location and may
require relocation of the building a few feet to the west in
order to accommodate the drive-thru lane and required landscaping.
Approximately 2,300 square feet of landscaping is required in the
parking area; plans show approximately 750 square feet.
Signing
There is an existing free-standing sign advertising dairy products
which should be removed, The applicant has not submitted sign
plans; however, all signs must comply with Code.
MISCELLANEOUS INFORMATION
The applicant has noted that the hours of operation will be
Sunday through Thursday 10:30 a.m. to 10:00 p.m. and Friday and
Saturday 10:30 a.m. to 11:00 p.m. There will be approximately
12 to 16 employees during peak hours.

Las Tunas and Baldwin Avenue are both major arterials. The
most current traffic counts show that Baldwin Avenue south of
Las Tunas carries approximately 18,301 cars per day (north and
southbound). On Las Tunas Drive, east of Baldwin Avenue, there
is approximately 16,820 cars per day (east and westbound on a
race day).
There are existing light standards in the parking lot. These
standards exceed the 15 feet allowed by Code.
ANALYSIS
A drive-thru eating establishment is a permitted use in a C-2
zone with an approved conditional use permit. The site is
appropriate for this type of business and the circulation and
parking are adequate to accommodate both uses. The drive-thru
will be located a minimum of 120 feet away from the residential
properties to the south, and should have an insignificant impact
on dwellidgs located in this area.
Staff believes that all landscaping, parking and wall requirements
should meet Code requirements,

Pursuant to the provisions of the California Environmental
Quality Act, the Planning Department has prepared an initial
study for the proposed project. Said initial study did not
disclose any substantial or potentially substantial adverse
change in any of the physical conditions within the area affected
by the project including land, air, water, minerals, flora, fauna,
ambient noise, and objects of historical or aesthetic significance.

Therefore, a Negative Declaration has been prepared for this
project,
Before the Planning Commission takes action on this project, the
Commission should "move to approve and file the Negative Declara-
tion and find that the project will not have a significant effect
on the environment,"
RECOMMENDATION
The Planning Department recommends approval of C.U.P. 78-16
subject to the following conditions:
1, Conditions as outlined in the attached report from the
Department of Public Works shall be complied with to the
satisfaction of the Director of Public Works.
2. C,U.P. 78-16 shall not take effect until the owner and
applicant have executed a form available at the Planning
Department indicating acceptance of the conditions of approval.
3. That all parking, landscaping, buffers and walls shall comply
with Code.
4, All signing shall comply with Code,
5. That a lot consolidation shall be approved and filed with the
County Recorder's Office prior to issuance of the occupancy
permit for Wendy's eating establishment.
6. That a new trash enclosure be provided for the existing
building and that the existing trash/storage area be removed.
7, All lighting shall comply with Code.

Attachments
After taking action on this application, the Planning Commission
should direct staff to prepare a resolution for adoption at its
next meeting. The Planning Commission's action shall not be
final until adoption of the resolution, The appeal period for
this action commences at the time the Commission adopts the
resolution.
