RESOLUTION NO. l076 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA RECOMMENDING AMENDMENT OF THE USES PERMITTED SECTION OF THE M-I ZONE AND ESTABLISHING PARKING REQUIREMENTS FOR ARCHITECT AND ENGINEERING USES. WHEREAS, the Planning Commission held a public hearing on November 14, 1978 to consider certain changes in the zoning ordinance relating to uses permitted in the M-I zone, and parking requirements for architect and engineering uses; and WHEREAS, all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RECOMMENDS TO THE CITY COUNCIL THAT THE FOLLOWING . AMENDMENTS BE MADE TO THE ARCADIA MUNICIPAL CODE: SECTION 1. That Section 9266.1. be amended to read: "9266.1. USES PERMITTED. No building or land shall be used and no building shall be hereafter erected, constructed or established except for the uses specified and such other uses as the City Council may deem to be included in the following subsections." SECTION 2. That the following be added to Section 9269.5: "USE PARKING SPACES REQUIRED Architects and Engineers 4 spaces per 93 sq. meters (1,001 sq. ft.) of gross floor areall SECTION 3. The Planning Commission finds that these proposed changes will provide more flexibility in the code, will establish necessary parking regulations for architects and engineers, and . that the pUblic necessity, convenience, general welfare and good zoning practice justify the above recommendations. -1- 1076 ~ . . BUTLER ASSISTANT PLANNER GENERAL INFORMATION APPLICANT: City of Arcadia REQUEST: Text amendment expanding the "Uses Permitted" section of the M-l zone and establishing parking regulations for architectural and engineering uses. PROPOSAL On October 17, 1978 the Planning Department submitted a report to the City Council relative to the appropriateness of architectural and engineering firms in the M-I zone (see attached report). After review of this report, the Council directed staff to initiate a text amendment incorporating the recommendations in this report. It was staff's recommendation that parking requirements should be established for Architects and Engineers and that these uses along with drafting services, surveyors, and graphic artists should be allowed in the M-l zone. Staff also suggested that the "Uses Permitted" section of the M-I zone be expanded to allow either the Planning Commission or the City Council the authority to determine if certain uses may be permitted in the M-I zone which are not specifically identified in said section. The Planning Department recommends the following changes and additions to the code: Section 9266.1. USES PERMITTED (in the M-I zone) should be amended to read: J T.A. 78-9 2 . "9266.1. Section 9266.1.1. should be amended to read: "9266.1.1. SAME. Architects, engineers, surveyors, drafting services," The following should be added to Section 9269.5., the "Off Street Parking Requirements": PARKING SPACES REQUIRED USE Architects, Engineers, Surveyors, Drafting Services and Graphic Services 4 spaces per 93 square meters (1,001 sq. ft.) of gross floor area. . If any of the uses noted above wished to construct a new building in the M-I zone, it would have to comply with the new parking regulations. If anyone of these uses were proposed to locate in an existing M-I development, they would have to comply with code or a modification would be required for insufficient parking. The applicant, in applying for a modification, should demonstrate that available on-site parking is adequate for all businesses on the site, including the proposed use. The City will maintain control over these types of uses through the Business License procedure. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise, and objects of historical or aesthetic significance. Therefore, a Negative Declaration has been prepared for this project. . Before the Planning Commission and City Council take action on this project, the Commission and Council should "move to approve and file the Negative Declaration and find that the project will not have a significant effect on the environment." RECOMMENDATION The Planning Department recommends approval of T.A. 78-9 as outlined in the staff report. ~ . ~ October 17, 1978 HONORABLE MAYOR AND MEMBERS OF CITY COUNCIL ARCADIA, CALIFORNIA SUBJECT: ARCHITECTURAL AND ENGINEERING USES IN THE M-l ZONE Gentlemen: As per the City Council's request, this report studies the appropriateness of architectural and engineering firms in the M-l zone. The Planning Department contacted 20 engineering and architectural firms within the area, requesting the number of employees in the firm and the square footage which each firm occupies. The average occupancy was one person per 273 square feet of office space. Based on this density (one per 273 square feet), 3.66 parking spaces would be required per 1,000 square feet of gross floor area. The parking requirements for the M-I zone are two spaces per 1,000 square feet of gross floor area. The general office parking requirement is four spaces per 1,000 square feet of gross floor area. Based on these parking figures, staff believes that engineering and architectural uses are too intensive for the typical M-l development. However, if the parking requirements for these uses were increased to four spaces per 1,000 square feet, any architectural and engineering firm wishing to locate in the M-l zone would have to comply with these parking regulations. It is staff's opinion that these uses should be permitted in the M-l zone but should provide parking at four spaces per 1,000 square feet. The "Uses Permitted" section of the M-l zone is so restrictive that it prohibits anything but those specific uses identified in the Code. This section should be expanded to allow the Planning Commission the flexiblity in determining if certain uses may be permitted in the M-l zone which are not specifically identified in said section. Also, staff believes that if the parking requirements for architectural and engineering firms are increased, drafting services, surveyors and graphic artists should be included as permitted uses in the M-l zone.
