RESOLUTION NO. 1070
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARCADIA GRANTING A CONDITIONAL
USE PERMIT FOR AN AUTO UPHOLSTERY BUSINESS
AT 86 WEST LIVE OAK AVENUE.
WHEREAS, on September 5, 1978, an application was filed
by Samuel Moran Arellano to operate an auto upholstery business,
Planning Department Case No. C.U.P. 78-17, on the property
commonly known as 86 West Live Oak Avenue, more particularly
described as follows:
The westerly 55 feet of Lot 2, Tract 12049 in the City
of Arcadia, County of Los Angeles, as recorded in Book
224, page 21, of Maps, in the office of the Recorder
of said County.
WHEREAS, a public hearing was held on September 26, 1978,
. at which time all interested persons were given full opportunity
to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. That the factual data submitted by the Plan-
ning Department in the attached report is true and correct.
SECTION 2. This Commission finds that:
1. The granting of conditional use permit as hereinafter
provided will not be detrimental to the public health or welfare
or injurious to the property or improvements in such zone or vicinity.
2. The use applied for at the location indicated is
properly one for which a conditional use permit is authorized.
3. The site for the proposed use is adequate in size
. and shape to accommodate said use including all yards, parking,

loading, landscaping and other features required to adjust said
use with the land and uses in the neighborhood.
4. The site abuts streets and highways adequate in width
and pavement type to carry the kind of traffic generated by the
proposed use.
5. The granting of such conditional use permit will not
adversely affect the General Plan.
6. The use applied for will not have a significant effect
on the environment.
SECTION 3. That for the foregoing reasons, subject to
approval of the City Council, this Commission grants a conditional
use permit for an auto upholstery business upon the following
conditions:

I. The property shall be improved and maintained in
accordance with the plans which are on file in the subject Case
No. C.U.P. 78-17 and applicable regulations of the Arcadia
Municipal Code.
2. That the applicant repaint the front of the building.
3. That parking of all customer and employee vehicles
be restricted to the property at 86 West live Oak Avenue.
4. That both. the north and south gates adjacent to Live
Oak and the alley be proyided with a visual screening material.
5. That a trash area be provided to comply with Code.
6. That a modification be granted for three parking spaces
in lieu of ten parking spaces required.
7. Traffic on the property shall be one-way, entering
. on Live Oak and exiting on the alley.
8. All work shall be performed inside the building.

SECTION 4. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.
I HEREBY CERTIFY that the foregoing resolution was
adopted at a regular meeting of the Planning Commission of the
City of Arcadia held on the 10th day of October, 1978, by the
following vote:

Sargis

Approximately 55 feet on Live Oak Avenue
The subject site is zoned C-M and is developed
with a commercial building now used as an auto
parts store. ' ,
The property to the north and east is zoned C-M
and is developed with commercial & industrial
uses. The property to the west is zoned C-M
and contains an old parn. The property to the
south in Temple City is developed with residential
uses.
Commercial
A conditional use permit ,for an automotive garage was approved
by the Planning Commission on October 26, 1971. At the time
this cond~tional use, permit was approved, the employees and
patrons of the garage were prohibited from parking on public
streets. '

ANALYSIS

An auto upholstry business is permitted in a C-M Zone with an
approved conditional use permit. The existing building contains
~,7~O square feet and has several entrances large enough for
vehicles. The applicant does not plan to expand the existing
building. Staff feels the property is of adequate size for an
auto upholstry business; however, the applicant should repaint
the front of the building and provide screening for the existing
gates at both ends of the driveway.
PARKING
The zoning ordinance requires 10 parking spaces for an industrial
use. Staff feels the existing site could accommodate three
employees and customer parking. The standard requirements for
parking is not necessarily appropriate in all cases, especially
where the nature of the business involves work on vehicles.
An impact on the residential property to the south and the
adjacent commercial properties can be avoided if the applicant
restricts the parking of employees and customers to his own
property.
Pursuant to the prov~s~ons of the California Environmental
Quality Act, the Planning Department has prepared an initial
study for the proposed proj.ct. Said initial study did not
disclose any substantial or adverse change in any of the physical
conditions within the area affected by the project including
land, air, water, minerals, flora, fauna, ambient noise, and
objects of historical or aesthetic significance. Therefore, a
Negative Declarat.ion has been prepared for this project.
Before the Planning Commiss.ion takes action on this project, the
Commission should "move to approve and file the Negative Declara-
tion and find that the project will not have a significant effect
on the environment."
RECOMMENDATION
,The Planning Department recommends approval of C.U.P. 78-17
subject to the followingcondi tions:
1. That the applicant repaint, the front of the building.
2. That parking of all customer and employee vehicles be
restricted to the property at 86 W. Live Oak Avenue.
3. That both the north and south gates adjacent to Live Oak
and the alley be provided with a visual screening material.
Both gates are' to be kept closed except to permit vehicles
to enter and exit.

After taking action on this application, the Planning Commission
should direct staff to prepare a resolution for adoption at its
next meeting. The Planning Commission's action shall not be
final until adoption of the resolution. The appeal period for
this action commences at the time the Commission adopts the
resolution.
